INDIANA PACERS/IVY TECH CHAMPIONS’ SCHOLARSHIPS GUIDELINES FOR 2008-2009
I. Special Scholarship Program. The Indiana Pacers (“Pacers”), with administrative offices located at 125 S. Pennsylvania Street, Indianapolis, IN46204, and Ivy Tech Community College of Indiana (“College”), with administrative offices located at 50 W. Fall Creek Parkway, North Drive, Indianapolis, IN 46208, have established a special scholarship program for the National Basketball Association’s 2008-2009 regular season. This special scholarship program is known as the “Indiana Pacers/Ivy Tech Champions’ Scholarships Program.” The College will provide separate scholarships of two thousand dollars ($2,000) each to six (6) individuals selected by the Pacers/Ivy Tech Scholarship Committee.
II.Not Eligible to Participate. The following individuals are not eligible to receive an Indiana Pacers/Ivy Tech Champions’ Scholarship:
1)an employee of the Pacers;
2)an employee of the College; and
3)a member of the immediate family of an individual who is an employee of either the Pacers or the College.
III. Scholarship Criteria. The criteria that an individual must meet to receive an Indiana Pacers/Ivy Tech Champions’ Scholarship are as follows:
1)Each scholarship recipient must be a resident of the State of Indiana.
2)Each scholarship recipient must be a citizen, or lawful permanent resident, of the United States.
3)Each scholarship recipient must be at least eighteen (18) years of age.
4)Each scholarship recipient must be interested in attending, and eligible for admission to, the College.
5)Each scholarship recipient must agree to be present at a designated Pacers’ home game, as a guest of the Pacers, for recognition as a recipient of an Indiana Pacers/Ivy Tech Champions’ Scholarship.
6)In consideration for being awarded a scholarship, each recipient also must agree, without further authorization, compensation or remuneration of any kind, to use of the individuals name, likeness, voice, photograph, performance, personal statement or biographical information, or any combination of those items, in any and all advertising, promotions, and other publicity conducted by the Pacers, the College, the National Basketball Association and its Member Teams, NBA Properties, Inc., or any parent, subsidiary, affiliate, successor, or assign of any of those entities.
7)Each scholarship recipient must complete an essay of not more than two hundred (200) words in response to the following questions, using the space and following the directions provided in the on-line scholarship application:
“What are your educational goals and how canan Indiana Pacers/Ivy Tech Champions’ Scholarship help you obtain those goals?”
IV. Scholarship Application Process.College has established an on-line application form that must be used by individuals to apply for an Indiana Pacers/Ivy Tech Champions’ Scholarship. The Pacers and College have created links to the on-line application form on their official websites, and respectively. Only those scholarship applications that are received by the College through this on-line application process will be considered. Applications can be submitted beginning November 1, 2008. The College will continue receiving and considering on-line applications for an Indiana Pacers/Ivy Tech Champions’ Scholarship until all six (6) scholarships have been awarded by the Pacers/Ivy Tech Scholarship Committee. However, a particular individual may submit just one (1) application for an Indiana Pacers/Ivy Tech Champions’ Scholarship. By submitting an application for an Indiana Pacers/Ivy Tech Champions’ Scholarship, the applicant agrees to receive periodic communications via e-mail regarding the Champions’ Scholarships game announcements and other promotional messages or offers, or both, from the Pacers or the College, or both. It is the sole responsibilityof eachapplicant to notify College if his or her contact information or e-mail address, or both, changes. To do so, send an e-mail to ith the new contact information. Scholarship applications become the property of the College and will not be returned to the applicants.
V. Special Transmission and Identification Provisions. Pacers, College, the National Basketball Association and its Member Teams, NBA Properties, Inc., and each of their respective parents, subsidiaries, affiliates, directors, trustees, officers, shareholders, owners, successors, assigns, employees and agents are not responsible for lost, interrupted or unavailable network, server or other connections, miscommunications, failed phone or computer hardware or software or telephone transmissions or technical failures, garbled or jumbled transmissions or other errors of any kind, whether human, mechanical or electronic, including without limitation the incorrect or inaccurate capture of entry information online, or for lost, late, incomplete, damaged, destroyed, delayed, stolen, misdirected or illegible entries. On-line application forms that have been tampered with or altered are void. In case of a dispute as to the identity of an applicant, the application will be treated as having been made by the registered user of the e-mail account. If eligible, the applicant may be required to provide College with proof that the applicant is the authorized account holder of the e-mail address associated with the on-line application.
VI. ScholarshipSelection Committee and Criteria. The President of the College will appoint at least three (3) College employees to serve on the Pacers/Ivy Tech Scholarship Committee who have appropriate skills to judge the essay portion of the scholarship applications. The Committee will review the on-line application forms that the College receives for an Indiana Pacers/Ivy Tech Champions’ Scholarship. In selecting the six (6) scholarship recipients, the Committee will consider the scholarship criteria. With respect to the required essay, the Committee will consider originality of thought, excellence in content, responsiveness to the question, use of proper grammar, and the clarity of the essay. The Committee will reject an application if:
1)the application is incomplete;
2)the application is not submitted through the on-line application process; or
3)the applicant submitted more than one (1) application for an Indiana Pacers/Ivy Tech Champions’ Scholarship for the National Basketball Association’s 2008-2009 regular season.
All decisions of the Pacers/Ivy Tech Scholarship Committee, including decisions to reject particular applications and scholarship award decisions, are final and may not be appealed. Notwithstanding the other provisions of these guidelines, the College reserves the right not to award any or all of theIndiana Pacers/Ivy Tech Champions’ Scholarships if no applicant reaches the standards set by the Committee.
VII.Scholarship Application Deadlines. To be considered for a particular scholarship award, the College must receive the applicant’s on-line application before deadline for the Pacers’ home game at which the scholarship recipient will be recognized. The applicable game dates and application deadlines are set forth in the following table:

The individual whom the Committee selects to receive a particular scholarship will be notified by a Pacers representative by phone or email at least five (5) calendar days before the Pacers’ home game at which the scholarship recipient is to be recognized. In the event the selected individual cannot be contacted or declines the scholarship, the Committee may choose another individual to receive that scholarship. All applications received before a particular deadline will be eligible for the scholarships yet to be awarded. However, a particular individual may not receive more than one (1) Indiana Pacers/Ivy Tech Champions’ Scholarshipfor the National Basketball Association’s 2008-2009 regular season. Applications received after 11:59 p.m. on March 29, 2009 will not be considered.
VIII.Scholarship Certificate. At the designated Pacers’ home game at which a particular recipient of an Indiana Pacers/Ivy Tech Champions’ Scholarship is to be recognized, the College will provide the recipient with a certificate for a scholarship of two thousand dollars ($2,000). Each certificate will be valid for a period of two (2) years beginning on the date the certificate is issued. If a recipient of an Indiana Pacers/Ivy Tech Champions’ Scholarship fails to fully utilize a certificate within the period of two (2) years, the certificate will expire, and the recipient will forfeit the remaining balance of the certificate. The recipient may use the certificate for qualified educational expense for regular college credit courses and developmental courses the recipient enrolls in at a campus or other instructional center of the College. For purposes of this section, qualified educational expenses include tuition, mandatory fees, and expenses for course related books, supplies, and equipment. A scholarship certificate may not be redeemed for cash and may not be transferred or assigned to another party.
IX.Additional Award. At the designated Pacers’ home game at which a particular recipient of an Indiana Pacers/Ivy Tech Champions’ Scholarship is to be recognized, the Pacers shall award the recipient with a basketball. The retail value of the basketball is $46.00.
X.Taxes. An individual who accepts an Indiana Pacers/Ivy Tech Champions’ Scholarship from the College or a basketball from the Pacers, or both,is solely responsible for all applicable federal, state and local taxes and any expenses associated with the scholarship or basketball, or both, unless otherwise indicated.
XI.Acceptance of Guidelines, Waiver, and Hold Harmless. By submitting an application for an Indiana Pacers/Ivy Tech Champions’ Scholarship, the applicant accepts and agrees to follow the scholarship guidelines and forever releases, discharges, and waives any and all claims, liabilities and actions of any kind, howsoever caused or arising and whether by negligence, any intentional act or otherwise, that the applicant may have or that may arise against Pacers Basketball Corporation d/b/a Pacers Sports & Entertainment, Indiana Pacers, Conseco Fieldhouse and Home Court, the National Basketball Association and its Member Teams, NBA Properties, Inc., Ivy Tech Community College of Indiana, and each of their respective parents, subsidiaries, affiliates, directors, trustees, officers, owners, shareholders, employees, successors, assigns and agents (“collectively, the “Released Parties”), with respect to or arising out of either the applicant’s participation or the receipt or use of a scholarship or any other prize awarded under this scholarship program. By submitting an application for an Indiana Pacers/Ivy Tech Champions’ Scholarship, the applicant further agrees to defend, indemnify and hold harmless the Released Parties and their insurers against any and all damages, costs, judgments, and expenses (including but not limited to legal fees) they may incur as a result of claims made against them in connection with eitherthe applicant’s participation or the receipt or use of a scholarship or any other prize awarded under this scholarship program.
XII.Right to Change Guidelines. The Pacers and the College reserve the right to change the guidelines for theIndiana Pacers/Ivy Tech Champions’ Scholarship Program at any time.
