Actions from last site visit:
  • Additional silos at the DSM should be removed for compliance with planning permission ref ESS/07/05/COL.
  • Details of the proposed silt lagoon are requested – e.g. how would it be constructed, where on site, how would the existing lagoon be restored, etc.
  • A planning application for the temporary retention of redundant kit should be submitted prior to Christmas 2011 following the Parish liaison meeting on 7th Dec.
  • The current operations of the asphalt plant should be confirmed within the next month.
  • Submissions of details required as above from Tarmac, Cory and Tarmac DSM.
  • Condition 6 of ESS/06/09/COL due before Christmas 2011.
  • Cory to continue to actively pick litter in areas surrounding the site.
  • Cory to submit the requested further detail for condition 20 attached to ref ESS/07/01/COL/REV within 1 month.
  • Cory to clarify on a drawing what the current state of each phase is and provide details of the levels survey once results are in.
  • Tarmac to clarify whether ‘maintenance payment’ required by S106 has been paid.
  • The next liaison meeting scheduled for 7th Dec will be attended by the Environment Agency. All representatives from Tarmac and Cory should make every effort to attend.

Inspection Results Summary:
  • There is a small section of pipeline remaining at the Warren Lane end of the Hart Field and a redundant electricity cable running the entire length of the field. This should have been removed and the land properly restored to agriculture by 31 December 2010 as required by condition 2 of permission ref ESS/09/09/COL. MM informed me this would be done w/c 27/02/12.
  • A new hardsurfaced area was being constructed to the rear of the offices in the Stanway Hall area, to the south of the internal DSM haul route. This appears to extend beyond the application area permitted by ref ESS/07/05/COL. It is understood the intention is to move the silos to this area for compliance with the permission, however this must be within the permitted area.
  • An open-sided container is located on the western edge of the DSM area. This should not be permanently retained.
  • The haul route leading to Stanway Hall was muddy. This should be kept clear to ensure no tracking onto Warren Lane.
  • Condition 6 associated with ESS/48/01/COL(R) has not been submitted. This is overdue. Tarmac stated this will be submitted by end of March 2012.
  • Condition 6 associated with ESS/06/09/COL has been submitted to the MPA.
  • The landfill phases (ESS/07/01/COL/REV) were assessed on site with MH. Cory are still requested to provide this on a drawing to ensure compliance with ESS/07/01/COL/REV and the accompanying S106 phasing drawings. Details of levels survey to be provided once results received.
  • The outstanding S106 ‘maintenance payment’ was paid by Tarmac Feb 2012.
  • A hardstanding area has been constructed near to the current tipping area. There is no planning permission for this and it should be removed.
  • A planning application has not been received for surplus kit. This is required to regulate a breach of planning control.

Tarmac
  • Pipeline and cable to be removed from Hart Field and the land restored to agriculture as required by permission ref ESS/09/09/COL by end of w/c27/02/12. Note: Since the visit it was discovered that this requirement was not carried out, however Tarmac have stated that the work has now commenced (on 12/03/12).
  • Tarmac to confirm the extent of the new DSM area for compliance with permission ref ESS/07/05/COL.
  • The open-sided container to the west of DSM area is to be removed.
  • The haul route to Stanway Hall is to be kept clear of mud and debris.
  • ESS/48/01/COL(R) condition 6 is overdue. This is a breach of the planning permission. Details are to be submitted by end of March 2012 (this is a Bellhouse permission so Cory will also have involvement).
  • A planning application is required for the temporary retention of surplus kit. This is overdue.
  • The current operations of the asphalt plant should be confirmed. This is overdue.
  • The Management Plan required by the S106 Agreement attached to permission ref ESS/07/02/COL/REV is overdue as of 18 February 2009 and must be submitted urgently (this is a Bellhouse permission so Cory will have involvement).
My letter of 09 February 2012 is relevant and should be complied with.
Cory
  • Hardstanding area adjacent to current tipping area to be removed.
  • Cory to clarify on a drawing what the current state of each phase is and provide details of the levels survey once results are in.
  • Further details for condition 20 attached to ref ESS/07/01/COL/REV have still not been provided. It was agreed at the meeting on 23rd Feb that these would be submitted asap.
Note:The actions noted in this report are required in order to ensure adequate progress is made and to avoid potential enforcement action against a breach of planning control.
