I, David Jeffery, a Delegate of the Secretary of the Department of the Environment and Energy (the Department) grant this exemption from Part 3 of the Product Emissions Standards Act toMarine Power International Pty Ltd.

This exemption is grantedunder section 32 and in accordance with exemption category 30(1)(f) of the Product Emissions Standards Rules 2017 (the Rules) for the import and supply of the emissions-controlled products specified in Schedule1 to this Notice, subject to the conditions specified in Schedule2 to this Notice.

In accordance with paragraph 32(1)(a) of the Rules this exemption comes into force on the date that it is published on the Department’s website. The expiry date for this exemption is 30 June 2021.

Only the ECPs specified in the table below are included in this exemption.

Unless varied in accordance with section 35 of the Rules, the number of ECPs of each model imported and supplied by the expiry date of this exemption must not exceed the maximum number specified in the last column of the table below.

Schedule 2

Exemption Conditions

In accordance with subsection 34(2) of the Product Emissions Standards Rules 2017, the exemption for the sterndrive engines specified in Schedule1 is granted subject to the following conditions:

  1. The engines must only be supplied for the purposes of repowering vessels fitted with the engines specified in the table below.
  2. The engines being replaced must be in vessels that are already in-service at the date of this exemption notice.
  3. The exemption from the supply provisions of Part 3 of the Act is extended to Marine Power International Pty Ltd’s specialist dealer network, provided the sales and purchasing documentation provided by Marine Power International Pty Ltd to its dealer network in relation to the exempted engines (and the equivalent documentation provided by the dealer to the end user) explicitly states the limitations in conditions1 and 2.
  4. Consistent with the requirements of paragraph 34(1)(b) of the Rules, the engines must be accompanied throughout the supply chain within Australia by a copy of this exemption notice or by information regarding how the exemption can be accessed online. Note the exemption notice is not required to be with the engine at the point of import but should be with the engines as soon as possible thereafter and prior to any subsequent supply.
  5. The engines must not be displayed by any person for sale in a retail showroom or sales area accessible to the public, or sold directly to the public by Marine Power International Pty Ltd.
  6. Exempted engines imported but not supplied by 30 June 2021 will not be able to be supplied under this exemption.
