To enhance and promote the health and wellness of all the citizens of Maryland, the MAHPERD organization provides advocacy and professional development opportunities designed to advance and unify the professions of health education, physical education, recreation, and dance education.

CONSTITUTION

ARTICLE INAME

Section 1The name of the Association shall be the Maryland Association for Health, Physical Education, Recreation and Dance (MAHPERD), affiliated with the American Alliance for Health, Physical Education, Recreation and Dance (AAHPERD) and the Eastern District Association (EDA) of AAHPERD and a department of the Maryland State Teacher’s Association (MSTA).

ARTICLE IIPURPOSE

Section 1The purposes of this Association are to:

  1. Awaken an interest in health education, physical education, recreation, and dance programs.
  2. Assist in research and experimentation and disseminate accurate information.
  3. Encourage and support quality programs throughout the state.
  4. Promote high standards of teaching and leadership.
  5. Cooperate with the state and local departments of education.
  6. Cooperate with the AAHPERD, the EDA, the National Education Association (NEA), the MSTA and other associations interested in the growth and development of children, youth and adults in health education, physical education, recreation and dance.

ARTICLE IIIORGANIZATION

Section 1The Association for operational and functional purposes shall be organized into divisions, sections and committees.

ARTICLE IVMEMBERSHIP

Section 1The Association shall consist of members as provided for in Article II in the By-Laws.

ARTICLE VOFFICERS AND DUTIES

Section 1The officers of MAHPERD shall be the President; President-Elect; Past President; Executive Director; Vice Presidents of Athletics, Dance, Health Education, Physical Education and Recreation; Secretary, Treasurer, Student Representative and three (3) Members-At-Large elected as provided for in Article IV in the By-Laws.

Section 2The officers shall perform the duties as provided for in Article III in the By-Laws.

ARTICLE VIGOVERNMENT

Section 1The Association shall be governed by the Executive Board, the voters at the General Membership Meeting(s) and committees constituted as provided for in the By-Laws.

Section 2The Executive Board shall formulate policies concerning the Association and the general nature and scope of its activities. Such policies shall be consistent with the policies of AAHPERD and EDA.

ARTICLE VIIHONOR AWARDS

Section 1The Association may grant honor awards to persons for meritorious service as provided for in Article XII in the By-Laws.

ARTICLE IXAMENDMENTS

Section 1The Constitution may be amended by a two-thirds (2/3) vote of the membership present at a General Membership Meeting or by mail vote. If a mail vote is taken, ten (10) percent of the membership must respond and three-fourths (3/4) of the respondents must vote in the affirmative. Amendments are considered adopted when passed at a General Membership Meeting or by mail vote.

Section 2All proposed amendments shall first be submitted to the Executive Board, after which they shall be presented to the voters at a General Membership Meeting or by mail.

ARTICLE IORGANIZATION

Section 1The Association shall be organized into divisions as follows:

Athletics, Dance Education, Health Education, Physical Education

and Recreation

Section 2The Association recognizes a number of sections, as named in

Section 4 below, to serve the relatively specific professional interests of the membership.

To form a new section, a group must submit a request signed by twenty-five (25) association members to the Executive Board for consideration. Upon approval by the Executive Board, the new section may operate tentatively as a section through the next regular convention. After an evaluation by the Executive Board, the tentative section will either be recommended for permanent status or for discontinuation at the next General Membership Meeting.

Section 3Sections may be organized on the basis of professional interest.

Section 4Sections are hereby assigned to Divisions as follows:

Athletic Division – none.

Dance Education Division – none.

Health Education Division – none.

Physical Education Division

Adapted Physical Education Section

Aquatics Section

Elementary Physical Education Section

Middle School Physical Education Section

High School Physical Education Section

Recreation – none.

Section 5Organizations whose service deals primarily with the promotion of Athletics, Dance Education, Health Education, Physical Education and Recreation, may become affiliated members under conditions as established by the Executive Board.

ARTICLE IIMEMBERSHIP

Section 1Membership in the Association shall be granted upon the payment of dues.

Section 2Membership in the Association shall be designated as Active, Associate, Honorary, Student and Retired.

Section 3Active members shall be professional employees of a public or private agency whose primary purpose is to promote health education, physical education, recreation and dance education.

Section 4Associate membership in the Association may be extended to persons not professionally engaged in health education, physical education, recreation and dance education, but who are interested in the support of these programs.

Section 5Honorary membership may be extended to persons who are deemed worthy of this distinction. Individuals must be recognized by the Executive Board and confirmed by the membership. Honorary members may not vote or hold office.

Section 6Student membership shall be granted to undergraduates or full-time graduate students preparing for health education, physical education, recreation and dance education careers. Student members may vote and hold office.

Section 7Retired membership may be extended to professionals in health education, physical education, recreation and dance education and were members of the Association for a minimum of ten (10) years. Retired members will be recognized upon written request for the retired status. Retired members will not pay membership dues but will pay registration charges to any event that they attend. Retired members may vote and hold office.

Section 8Membership in the Association shall be on an annual basis as determined by the Executive Board.

Section 9Membership dues for Active, Associate, Honorary, Student and Retired members shall be recommended by the Executive Board and decided by vote at a General Membership Meeting.

ARTICLE IIIOFFICERS AND DUTIES

Section 1The officers of MAHPERD shall be the President; President-Elect; Past President; Executive Director; Vice Presidents of Athletics, Dance, Health Education, Physical Education and Recreation; Secretary, Treasurer, Student Representative and three (3) Members-At-Large elected as provided for in Article IV in the By-Laws.

All officers shall be members of MAHPERD as provided for in Article II of these By-Laws.

Section 2The President shall act as Chair of all meetings of the General Membership and the Executive Board and shall appoint committees as provided for in Article VIII, Section 4, of these By-Laws. The President shall vote at all meetings only to break a tie.

Section 3The President-Elect shall automatically succeed to the Office of the President at the conclusion of the Annual Convention; shall act for the President in his/her absence; and in case of death or resignation of the President, shall succeed the President for the unexpired term in addition to the regular term of office for which elected. The President-Elect shall carry out duties assigned by the President and stated in the Operating Code.

Section 4The Past President shall serve as the Convention Planner and Coordinator for the Annual State Convention. The past President shall carry duties assigned by the President and stated in the Operating Code.

Section 5The Executive Director shall serve at the request of the Executive

Committee and fulfill all responsibilities according to the Operating Code/Job Description.

Section 6Vice-Presidents shall act as Chair of their respective divisions. The Vice-Presidents shall assume primary responsibility for the activities conducted throughout the year. The Vice-Presidents shall attend and vote at all Association meetings, serve as members of the Editorial Board of the official MAHPERD Journal and serve as members of the Finance Committee.

Section 7The Vice-President-Elects shall assist their respective Vice-Presidents. They shall automatically assume the Office of Vice-President at the conclusion of the Annual Convention. They shall act for the Vice-President in his/her absence, death or resignation. They shall succeed to the unexpired term of office in addition to the term for which they were elected. They shall serve on the Annual Convention Program Committee as well as the Nominating Committee for their term of office.

Section 8The Secretary shall keep minutes of the Association meetings. The Secretary shall keep the members informed of all proceedings of the Executive Board and the General Membership Meeting(s) and other MAHPERD activities through the MAHPERD Journal and/or other means. The Secretary shall perform such duties as customarily reside within the office or may be delegated by the President or Executive Board.

Section 9The Treasurer shall assume responsibility for all monies of MAHPERD, pay all approved bills of MAHPERD promptly and present an internal annual review of receipts and disbursements to the Executive Board and the general membership for approval. All MAHPERD expenditures must be approved by the President in keeping within the approved budget. The Treasurer shall perform such duties as customarily reside in the office or may be delegated by the President or Executive Board.

Section 10The Members-At-Large shall serve on the Executive Board with a vote and shall fulfill the duties stated or implied by the President, Executive Board and Operating Code.

Section 11The Student Representative shall serve on the Executive Board with a vote and shall fulfill the duties stated or implied by the President, Executive Board and Operating Codes.

ARTICLE IVELECTION OF OFFICERS

Section 1There shall be a Nominating Committee consisting of a Chair and the Vice-President-Elects. The committee shall submit to the general membership a slate of names for' Offices of President-Elect; Vice-President-Elects of Athletics, Dance Education, Health Education, Physical Education and Recreation; three (3) Members-At-Large; and secretary-Elect or Treasurer-Elect according to the sequence described in Section 4 below.

The President-Elect shall not be nominated from the same agency or institution 2 years in succession.

A member shall not accept nomination to an office when holding an active office for the coming year, nor accept nomination to 2 offices of any kind in MAHPERD during the same year except as provided by these By-Laws in Section 4 below.

The Nominating Committee shall secure the written consent of those placed in nomination and shall inform the general membership in advance of the qualifications of the candidates.

Section 2The President-Elect; Vice-President-Elects; Members-At- Large; and Secretary-Elect or Treasurer-Elect shall be elected at the time of the Annual Convention by a plurality vote. The procedures for the elections shall be developed and approved by the Executive Board prior to the Annual Convention.

Section 3The President-Elect and Vice-President-Elects shall serve for one year and shall not succeed themselves in Office except as provided for in Article III, Sections 3 and 7, of these By-Laws.

The Members-At-Large shall serve one year and can succeed themselves in office.

Section 4The Secretary and the Treasurer shall serve as an elect for one year to become familiar with the duties of the office and serve two years in office.

The election sequence shall be alternate year elections:

*2010 – Secretary-Elect nominated and elected.

*2011– Treasurer-Elect nominated and elected.

*2012 – Secretary-Elect nominated and elected.

*2013– Treasurer-Elect nominated and elected.

*2014 – Secretary-Elect nominated and elected.

*2015– Treasurer-Elect nominated and elected.

The Secretary and the Treasurer are exempt from the provisions in Section 1 above and may succeed themselves in office.

ARTICLE VSECTION OFFICERS AND DUTIES

Section 1Each section shall be represented by a chair to be elected at the Annual Convention.

Section 2The Section Chair shall have the following duties:

  • Preside at the section business meeting(s).
  • Represent the section at the General Membership Meeting.
  • Prepare the program for the section in cooperation with their respective Vice-President.
  • Provide for the selection of the incoming Chair.
  • Report significant information, current issues and news to the editor of the Association publication.

ARTICLE VIEXECUTIVE BOARD

Section 1The Executive Board shall be composed of the President; President-Elect; Past President; Executive Director (non-voting); Vice –Presidents of Athletics, Dance Education, Health Education; Physical Education and Recreation; Secretary; Treasurer; Student Representative; and three (3) Members-At-Large.

The Maryland State Department Specialists in Athletics, Health Education and Physical Education shall also be members of the Executive Board and collectively have one (1) vote on the Executive Board.

The state representatives to EDA Council for Services and Council for Conventions, the Journal Editor, and the Parliamentarian shall also be non-voting members of the Executive Board.

All members of the Executive Board shall be members of MAHPERD.

Section 2The administrative control shall be vested in the Executive Board. It is the duty of the Executive Board to suggest legislation and carry on the business of the Constitution and By-Laws.

Section 3The Executive Board shall meet at least five (5) times a year. Special meetings may be called by the President. A quorum of the committee shall consist of one more than half, or a simple majority of the members either present or by proxy, providing the proxy is a member of MAHPERD.

Section 4An Executive Committee shall consist of the President, the President-Elect, the Past President and the Executive Director (non-voting).

This committee is empowered to act on behalf of the Executive Board when all three are in agreement and when it is impractical to poll the Executive Board.

If any one of the three is unable to serve as a member of the Executive Committee over an extended period of time, the most recent past Past President who is available to serve shall be called upon to act as a member of the Executive Committee during an emergency.

This Executive Committee shall perform such duties between meetings of the Executive Board as the board may authorize. It shall act upon questions

requiring immediate decision, provided that none of its acts exceed authority granted by the Executive Board or conflict with action taken by the Executive Board.

Actions of the Executive Committee will be reported to the Executive Board by mail or at the next board meeting.

The Executive Board can rescind the actions of the Executive Committee except in cases of contractual agreement.

ARTICLE VIIVACANCIES

Section 1All vacancies shall be filled by the Executive Board except as provided for elsewhere in the Constitution and By-Laws.
