“STORES BOARD SUBMISSION – PHASE 4 CONSTRUCTION AND COMMERCIAL MANAGEMENT SERVICES FOR NORTHERN LINK AND DISPUTE RESOLUTION BOARD MEMBERS”

Brisbane City Council (Council) requires the provision of construction and commercial management services from commencement of construction to completion of construction.
In September 2009, Evans & Peck were selected from the panel in a competitive process as the most suitable consultancy to provide assistance to the Transaction Manager responsible for the delivery of the Northern Link Project.
As a result of this engagement they have gained an intimate knowledge of the Project Deed and the Performance Specification.
Council sought to engage Evans & Peck to provide construction and commercial management services for the duration of the construction phase, expected to commence in December 2010 and be completed by December 2014. Approval was sought through to 30 June 2015, to close out any remaining contractual issues.
The Northern Link Project Deed specifies a Dispute Resolution Board comprised of 3 individuals selected by virtue of previous experience on Dispute Resolution Boards and their legal standing – usually barristers with an engineering background. Council has selected one (Graham Easton), the contractor has selected and will be responsible for paying one (Alan McLennan), and the other (Ron Finlay) has been selected by vote by both individuals, as specified in the project Deed.
The Dispute Resolution Board will be retained from the commencement of their contracts for the duration of the construction phase and will meet formally on a quarterly basis in addition to regular monthly activities and as required in the event of a formal dispute determination.
The Establishment and Coordination Committee approved:
1) Entering into a Contract with Evans & Peck Pty Ltd
To provide Construction and Commercial Management services for the construction phase of Northern Link without seeking competitive tenders from industry in accordance with Section 1.2(c), Sole or Restricted Tendering, of the Procurement Manual pursuant to the City of Brisbane Act 2010. The Contract will be on a schedule or rates price basis for a Maximum Term of 56 months;
2) Entering into Contracts with Graham Easton and Ron Finlay
To provide services as members of the Dispute Resolution Board for the construction phase of Northern Link without seeking competitive tenders from industry in accordance with Section 1.2(c), Sole or Restricted Tendering, of the Procurement Manual pursuant to the City of Brisbane Act 2010. The Contracts will be on a schedule or rates price basis with Graham Easton and with Ron Finlay, for a Maximum Term of 56 months
