EO38 Guidance – Changing the Lead Agency or Other Agency on a Disclosure or Waiver

Lead Agency

Disclosure

If it has been determined that the covered provider needs to change a submitted Disclosurewith regard to the Lead Agency or other agency/agencies, the Lead Agency must first invalidate the Disclosure.

In order to invalidate a submitted Disclosure, the Lead Agency must scroll to the bottom of the applicable Disclosure where it says: “The current status is Submitted. Do you need to change the status?” - Select “Yes” to invalidate that Disclosure.

Waiver

If it has been determined that the covered provider needs to change a submitted Waiver with regard to the Lead Agency or other agency/agencies, the Lead Agency must first change the status of the Waiver.

In order change the status of the waiver, the Lead Agency must scroll to the bottom of the Waiver and select “Request Additional Information”. Add a note in the box that describes the action that needs to be taken.

IMPORTANT NOTE: If you plan on sending the instructions to the provider, please be sure to ONLY include the information that pertains to them, NOT the instructions above.

Covered Provider

Disclosure

Since the previously submitted Disclosure did not have the correct Lead Agency or other agency/agencies, the Disclosure will need to be re-created. To make this easier, it may be helpful to print out a copy of the previously submitted Disclosure. To do this,

  1. Go to the “3. Submit Disclosure” tab,
  2. Select the invalid Disclosure,
  3. Select the “Generate Disclosure PDF” button at the top of the Disclosure, and
  4. Print or save the Disclosure for your use in creating a new Disclosure.

The covered provider will need to create a new covered reporting period (CRP) with the desired Lead Agency and other agency/agencies. To do this:

  1. Go to the “2. Update Details” tab,
  2. Select “Add CRP/Lead Agency” on the right side of the first green title bar,
  3. Complete the information requested and click “submit” when finished.

Now, a new Disclosure can be created.

  1. Go to the “3. Submit Disclosure” tab,
  2. Scroll to the bottom and select the “Add Disclosure” button,
  3. Select the new CRP that reflects the appropriate Lead Agency and other agency/agencies,
  4. Complete the Disclosure using the previously completed Disclosure as a guide and submit.
  5. Be sure to check the box in Step 1 that says that the CEO/CFO has approved submission.
  6. Check the two boxes for the application affirmation.

Waiver

The covered provider will need to create a new covered reporting period (CRP) with the desired Lead Agency and other agency/agencies. To do this:

  1. Go to the “2. Update Details” tab,
  2. Select “Add CRP/Lead Agency” on the right side of the first green title bar,
  3. Complete the information requested and click “submit” when finished.

To change the CRP for a Waiver that has been returned:

  1. go to the “4. Apply for Waiver” tab.
  2. Select “View Submitted Waivers” on the green title bar,
  3. Select the waiver with the yellow triangle with an “!”,
  4. Once in the waiver in the “4.1 Waiver Application tab”, select the new CRP that reflects the appropriate Lead Agency and other agency/agencies,
  5. Go to the “4.4 Affirmation” tab and affirm that the waiver is correct and submit.
