Article1.ThepurposeoftheMinistryofthe
EnvironmentandtheLegalAmazon,whichwascreatedbyLaw

July1994,istoplan,coordinate,superviseandmonitor
activitiespertainingtoNationalEnvironmentalPolicyand

overallnationalpolicyfortheLegalAmazon;
II--participateinarticulatinginitiativestakenby
organizations,relatingtooverallnationalpolicyforthe
LegalAmazon.
Article15.TheroleoftheSecretariatforthe
CoordinationofIntegratedDevelopmentIssuesisto
harmonizeandconsolidateplans,programs,andfinancial
mechanismsintendedtopromotesustaineddevelopmentandto
improvethecountry'senvironmentalquality.
Article16.TheroleofthePlanningandProgramming
Departmentistoanalyzeandproposeplansandprogramsand
articulatethefinancialmechanismsforimplementingthem.
Article17.TheroleoftheDepartmentforSustainable
DevelopmentStudiesistocarryoutsocial,economicand
environmentalstudies,formulateandmonitorthetrendsof
sustainabilityindicators,andpreparestudiesofinterest
totheMinistryofthe EnvironmentandtheLegalAmazon.
SectionVAssociatedAgencies
Article18.TheroleoftheNationalEnvironmental
Councilisto:
I--establish,atthecommandoftheMinistryofthe
EnvironmentandtheLegalAmazon,standardsandcriteria
fortheStatesortheFederalDistricttopermitactualor
potentialpollutingactivities;
II--resolve,whendeemednecessary,tocarryout
studiesofalternativesandthepossibleenvironmental
consequencesofpublicorprivateprojects,requestingfrom
federal,stateandmunicipalagenciesandprivateentities
theinformationnecessaryforevaluatingenvironmental
impactstudiesandtheirrespectivereports,for
constructionprojectsoractivitiesthatseriouslydegrade
the environment,especiallyinareasregardedaspartof
thenationalheritage;
III--renderjudgment,atthehighestlevelof
administrativeappeal,bymeansofadepositinadvance,on
finesandotherpenaltiesimposedbyIBAMA;
IV--ratifyagreementsaimedatreplacingmonetary
penaltieswiththeobligationtotakestepsaimedat
protectingthe environment;
V--resolve,throughrepresentationoftheMinistryof
the EnvironmentandtheLegalAmazon,whenitisamatter
specificallyrelatedtothe environment,thatfiscal
benefitsgrantedbytheGovernmentaretobeforfeitedor
restricted,generallyorconditionally,andthat
participationincreditlinesfromofficiallending
agenciesistobeforfeitedorsuspended;
VI--establish,onanexclusivebasis,national
regulationsandstandardsforcontrollingpollutioncaused
byland,airorwatermotorvehicles,throughformal
consultationwiththecompetentMinistries;
VII--Establishnorms,criteria,andstandardsfor
monitoringandmaintainingenvironmentalqualitywitha
viewtotherationaluseofenvironmentalresources,
especiallywaterresources.
1.Thenormsandcriteriaforpermittingpotentialor
actualpollutingactivitiesmustestablishtherequisites
thatareabsolutelynecessaryforenvironmentalprotection.
2.ThepenaltiesenvisionedinparagraphVofthis
Articleshallonlybeappliedincasespreviouslydefined
inaspecificCONAMAdocument,therebyassuringthatthe
affectedpartyhasampleopportunityforitsowndefense.
3.Inestablishingnorms,criteria,andstandardsfor
monitoringandmaintainingenvironmentalquality,CONAMA
shalltakeintoconsiderationtheself-regenerating
capacityofthereceivingbodiesandtheneedtoestablish
measurablegeneralparameters.
Article19.ItistheroleoftheNationalCouncilfor
theLegalAmazonto:
I--proposeandcoordinatetheintegratednational
policyfortheAmazonregioninconjunctionwithstateand
municipalgovernments,takingintoaccountalldimensions
ofsocialandeconomiclifeandtheimperativesof
sustainabledevelopment,improvementinthequalityoflife
oftheAmazonpopulations,andprotectionandpreservation
oftheAmazon environment;
II--coordinatepoliciesharmonizingtheactivityof
federalagenciessoastoservetheAmazonpopulations;
III--articulateactionsforimplementingthesepolicies
ortorespondtosituationsdemandingspecialmeasuresor
thoseofanemergencynature;
IV--monitortheimplementationofoverallpolicyandof
federallycoordinatedinitiativesfortheLegalAmazon;
V--provideanopiniononproposedlegislationrelated
toFederalGovernmentactivitiesintheLegalAmazon;
VI--deliberateandproposemeasuresforeventsand
situationsrelatingtotheLegalAmazonthatrequirerapid
andcoordinatedactionbytheFederalGovernment.

Article21.TheroleoftheNationalEnvironmentalFund

Article22.ThepurposeoftheBrazilianInstitutefor
the EnvironmentandRenewableNationalResources(IBAMA),
anindependentfederalgovernmentbodygovernedbyspecial
regulation,whichisalegalentitybypubliclaw,
administrativelyandfinanciallyautonomous,andlinkedto
theMinistryofthe EnvironmentandtheLegalAmazon,isto
adviseitintheformulationandcoordinationofnational
