BC Hydro and FortisBC Joint Energy Saving Kit Program
Terms and Conditions
Overview
If you have a gas account with FortisBC Energy Inc. or FortisBC Energy (Vancouver Island Inc.) (together “FortisBC”) and a BC Hydro account, and your household income is below the thresholds set by Statistics Canada’s Low Income Cut-offs (“LICO”), you may qualify to receive a free energy saving kit (“ESK”) from FortisBC and BC Hydro under the ESK Program (the “Program”).
Eligible participants
To be eligible for the Program, applicants (“Applicants”) must have:
•a BC Hydro account in the Applicant’s name;
•a total household income below Statistics Canada’s LICO thresholds;
•a mailing address within the “Joint Service Areas”, which are defined as those areas of British Columbia where the service territories of BC Hydro and FortisBC overlap.
Program process
To apply for the Program, Applicants must call toll-free 1-877-446-8855 and provide the necessary information to the Program agent (the “Application”).
•Processing of Applications may take a minimum of 90 days.
•Neither FortisBC nor BC Hydro are responsible for lost, delayed, misdirected, damaged, illegible or incomplete Applications.
•BC Hydro and FortisBC reserve the right to refuse Applications which it determines, in its sole discretion, are incomplete, inaccurate or otherwise do not meet Program requirements.
Representations and warranties
The Applicant represents and warrants as follows:
•The Applicant has reviewed the above Program eligibility criteria and fully qualifies with same.
•All information provided in the Application and attached thereto or otherwise provided to BC Hydro and FortisBC is true and correct.
•The Applicant has reviewed these terms and conditions and agrees to comply with same.
Additional terms and conditions
•FortisBC and BC Hydro may be amend, modify or terminate this Program at any time and for any reason, without notice.
•The Applicant acknowledges and agrees that FortisBC and BC Hydro have no liability concerning any estimated energy savings in connection with this Program or use of the ESK.
•The Applicant is solely responsible for meeting all Program requirements and complying with any laws, regulations or by-laws regarding permits, codes, restrictions or inspections.
•By applying to this Program, the Applicant agrees that FortisBC, BC Hydro or one or more of their agents may contact the Applicant in the future to participate in a survey about this Program.
•Only one ESK per household and BC Hydro/FortisBC account.
•The Applicant acknowledges and agrees that neither FortisBC nor BC Hydro are the designer or manufacturer of the products available under this Program or contained in the ESK and neither FortisBC nor BC Hydro make any representation or warranty of any kind concerning such products or their installation.
•The Applicant irrevocably waives any and all actions, causes of action, claims, suits and demands (whether based in contract, tort, equity or otherwise) that the Applicant has or may in the future have against, and irrevocably release from liability and agree not to sue, FortisBC, BC Hydro or any of their respective affiliates or respective officers, directors, employees, agents, contractors or representatives for any type of loss or damage that the Applicant may suffer including, without limitation, property loss or damage, financial loss or damage, or personal injury that arise or accrue from, as a result of, in relation to, or in connection with the Applicant’s involvement in the Program or receipt or use of the ESK or the products contained therein.
