Tender documents can be obtained in person or through post from Sr.Manager-Materials (Stores),HPCL,Visakh Refinery, Visakhapatnam - 530 011 on payment of a non-refundable tender document cost as indicated above through a Crossed Demand Draft / Pay Order / Bankers Cheque drawn on any scheduled Bank (other than co-operative bank ) in favour of Hindustan Petroleum Corporation Ltd., Visakhapatnam.

Bidder shall forward a request for issue of the tender document in writing, either by post or in person, quoting the

Bidders Name & Correspondence address with Mobile and Landline phone numbers, Fax number and E-mail address. Tender document shall be issued on the name and address appearing on such request letter and all subsequent correspondence shall be made on such name and address only. Tender document shall be issued only on working days. (Monday to Friday ) between 0900 Hrs to 1500 Hrs.

The bidders,who download the Tender document from the website, will have to pay the Tender document cost as indicated above through a separate Demand Draft . In such a case, Envelop-I ( containing EMD ) should be accompanied with separate Demand Draft towards tender document cost as indicated above failing which, bids shall be summarily rejected.

Where Parties are requesting for tender documents by Post, HPCL shall not be responsible for delay due to any reasons including postal delays in receiving the party's request as well as receipt of these documents by the party. HPCL reserves the right to reject any or all bids or even cancel the tender in its entirety without assigning any reason whatsoever thereof.

A.  Terms and Conditions of the Sale Lot :

Material in used/ scrap condition detailed in this document is hereby offered for sale and bids are invited for the same under the following terms and conditions. In submitting the bid, the potential bidder shall agree to comply with all the terms and conditions given in this document.

1.  Material Description:-

1.1  Item offered for sale is Empty ARI/GNFC Chemical Plastic Drums of approx 220 – 240 LT Capacity and is to be sold on “AS IS WHERE IS” and “NUMBER” basis.Refer clause 3.2 below. The description of material is specified by way of identification thereof only and the use of such description shall not constitute a contract of sale by description. The Buyer having such opportunity to examine the materials, the seller shall not be responsible for the quality, quantity or condition thereof for any purpose. The Buyer must take them at his own judgment and risk as result of such examination.

2.  Material Location :-

2.1  Empty Lube oil drums under sale Lot No. 366 is located at drum washing facility near WWTP, in the Refinery premises of Hindustan Petroleum Corporation Ltd., Visakh Refinery, Visakhapatnam.

3.  Approx quantity for sale :

3.1.  The sale order for the approximate quantity of 4000 Nos. shall be placed on the successful bidder. The basic rate quoted and accepted and thus mentioned in such sale order shall remain firm during its execution period.

3.2.  Estimated quantity given in the disposal tender is indicative. However, bidders are required to lift the total quantity of the scrap in the lot specified in the tender at specified location on “as is where is basis” on same terms & conditions of the purchase order. In case available scrap in the lot offered for the sale is less than the estimated quantity, owner does not have any obligation to make the scrap quantity available to bidders from other scrap Lots.

4.  Material Inspection :

4.1  Material is available for inspection by intending agencies, between 9 AM and 3.30 PM on any working day (i.e. except Saturdays, Sundays and Holidays) upto one day before the tender due date and time indicated above. Agencies to note that inspection of material shall not be allowed after the scheduled time and date mentioned above.

5.  Tender Document:

5.1  Tender document can be obtained by bidders by forwarding a request for issue of the tender document in writing, either by post or in person quoting the Bidder Name & Correspondence address with Mobile and Land line phone numbers and Fax number. Tender document shall be issued on the name and address appearing on such request letter and all subsequent correspondence shall be made on such name and address only. HPCL shall not be responsible for any delay that may occur in transit, in case of requests by post.

5.2  Tender document is nontransferable, i.e., document issued to any particular bidder can not be transferred to another bidder.

6.  Clarification regarding Tender terms and conditions :

7.2  In case of any clarifications required by the bidders regarding terms and conditions of tender documents, same may be obtained before submission of their bids. After submission of bids, any deviation from the terms and conditions of tender document shall not be accepted at all.

6.2  No additional correspondence will be made with the bidders regarding the tendering process/finalisation.

6.3  HPCL could take anywhere from a minimum of 3-4 working days before any reply could be given to any letter addressed to HPCL on any matter by the successful bidder before/after finalisation of sale order.

7.  How to quote:

7.1  Bidders shall quote only the Basic rate excluding all applicable statutory taxes, cesses, duties & levies etc. If the rate quoted by the bidder is mentioned as inclusive of any / all taxes & duties or if the bidder mentions any conditions or clauses along with the rates quoted, their offer shall be liable for rejection without any correspondence and / or reference to the Bidder.

7.2  Bidder shall quote the basic rate in figures as well as in words to avoid any ambiguity. In case of any variation between the rate quoted in words and the rate quoted in figures, the higher of the two shall be considered.

8.  Where to quote the rate in the tender document :

8.1  The rates shall be indicated only in the specified area of the tender document (Price bid). Rates mentioned elsewhere shall not be considered.

9.  Bids Validity :

9.1  Bids shall be valid for a minimum period of One hundred twenty (120) calendar days from the tender due date/extended due date.

10  Documents to be submitted along with Unpriced Bid :

10.1  Bidders shall furnish TIN of their VAT registration, ECC No. of their Excise Registration, PAN of Income Tax & CST Registration details along with the Unpriced Bid. Vendor outside Andhra Pradesh shall confirm in their offer whether “C” form will be furnished in case of the agency being the successful bidder Offers not furnishing these details shall be liable for Rejection.

10.2  Agency shall furnish any documents as required by the Seller to arrive at the tax rate applicable and shall declare the purpose for which the Scrap is being bought.

11  Authorisation Certificate to be submitted along with unpriced Bid:

11.1  Agency to submit a notarised copy of the Authorisation Certificate issued by Pollution Control Board authorising the agency to operate a facility for collection, reception, handling, transportation of empty / used chemical drums made of plastic/MS (Iron drums) along with Unpriced bid, failing which priced bid shall not be opened and priced bid shall be returned to the bidder in unopened condition.

In case the agency is lifting the material within the penalty period after making payment of applicable penalty along with material cost, the authorisation certificate should remain valid in the penalty period also.

Authorisation certificate must be valid on the Tender due date/extended tender due date and should remain valid for further 120 calendar days from the tender due date/extended tender due date, failing which unpriced bid will be summarily rejected and no correspondence shall be entertained with the bidders in the regard.

Validity of Authorisation Certificate should remain till the completion of lifting of materials available in the sale lot.

12.  Submission of bids:

12.1  All tenders must be written in ink. Pencil written tenders shall be rejected. Erasure alterations and overwriting should be avoided. Any corrections shall be properly authenticated by the signatory of the tender document before submission of the bid.

12.3  The name and address of the Bidder should be written legibly on the left side top corner of the envelope. Sale lot Number should be written in the bold letters on the face of the envelope.

12.3  Tenders shall be submitted in closed/sealed envelopes addressed to the Seller as mentioned below and the envelopes shall clearly indicate the Sale Lot Number on the face thereof.

12.4  Tenders can be submitted in person / through Post / Courier / Speed Post well in advance to reach the seller in time. HPCL takes no responsibility for delay / loss of documents in transit due to any reason. Bids submitted through Telex / Fax / E-mail shall not be accepted.

13.  Tender opening:

13.1  Tender opening may be witnessed by the bidders or their representatives (authorised by the bidders in writing, on their letter heads) at their own cost. For this purpose, bidders or their authorised representatives shall carry a copy of the authorisation letters with them.

14.  Cancellation of Tender/rejection of bids :

14.1  The seller hereby reserves the right to accept or reject any or all TENDERS without assigning any reasons thereof at any stage of Tendering.

14.2  Conditional offers shall be liable for rejection without any correspondence and / or reference to the bidder. Hence, bidders to note that they shall not indicate any conditions on the tender documents (Either on Unpriced Bid or on Price Bid).

15.  Evaluation of Bids:

15.1  When identical competitive offers are received, selection of bidders will be made either by drawing a lot or making equal distribution of quantity to be disposed of, in presence of concerned bidders.

15.2  Tender shall be finalised only on the highest bidder whose unpriced bid and Price bid are technically and commercially acceptable. HPCL reserve the right to reject the tender at this stage without assigning any reason whatsoever.

16.  Sale Order placement:

16.1  An acceptance letter in the form of a Sale Order will be sent to the successful agency.

17.  Mode of Payment:

17.1  Agency shall make the payment by Demand Draft / Pay Order / Bankers Cheque drawn on any scheduled bank (other than Cooperative Bank) payable at Visakhapatnam in favour of Hindustan Petroleum Corporation Ltd., Visakhapatnam. Cheques/cash are not acceptable
