- GENERAL INFORMATION
1.1.Introduction
1.1.1.State administration
The state administration related to the railway infrastructure is executed by the following administrative bodies:
a)the Ministry,
b)the Railway Regulatory Authority and
c)self-governing regional authorities.
1.1.1.1.Ministry of Transport, Construction and Regional Development
a)takes role of the appellate body in the administrative proceeding as regards matters handled at first instance by the Railway Regulatory Authority acting as the surveyor’s office and/or the self – governing region;
b)decides on closure of a railway line after an agreement with the Ministry of Defence of the Slovak Republic;
c)defines which railway lines are the main ones and which are the secondary ones and publishes this definition of lines on its webpage;
d)acts as the approval body for approving the types of rolling stock, with the exception of funicular railways.

1.1.1.2.Railway Regulatory Authority
a)issues, decides on suspension of licenses´ validity, or revokes licenses´ of RUs;
b)issues safety certificate and safety permission, decides on its amendments, cancelation, revoking, validity prolongation and checks if the conditions and requirements laid down are fulfilled;
c)issues and revokes permission for operation of railways, except light rail;
d)by generally binding legal regulation lays down the charges for the access to railway infrastructure in the scope of a minimum access package and track access to service facilities under Annexe No. 13 part B of the Railway Act;
e)issues licences as well as supplementary licences for putting the railway vehicles into operation;
f)undertakes state expert supervision as regards railways, except for urban tram and trolley bus lines, and undertakes state expert technical supervision;
g)keeps the National register of vehicles as well as the National register of railway infrastructure and issues certificates on registration,
h)is the regulatory authority for railways, special railways and cableways, imposes fines for infringements and other administrative offences committed along railway tracks, cableways and special railways.

1.1.2.Basic information on the infrastructure manager
Železnice Slovenskej republiky (hereinafter referred to as ŽSR) were created on 1 January 1993 by decision of the Government of the Slovak Republic on establishing a state public enterprise following the separation of the Czecho-Slovak State Railways into two independent entities. The decision of the Government was further elaborated by the Act of the National Council of the Slovak Republic No. 258/1993 Coll. of 30 September 1993 on Železnice Slovenskej republiky as amended by later regulations.
Since 1 January 2002 in accordance with the Project of transformation and restructuring of ŽSR, the company has been split in two independent entities – Železnice Slovenskej republiky(ŽSR) and Železničná spoločnosť, a.s (ZSSK).
ŽSR are enrolled in the Business register of District court Bratislava I, in the Section PO, Insertion 312/B.

The main activities of ŽSR as of 1 January 2002 are the following:
management and operation of railway infrastructure,
allocation of infrastructure capacity,
provision of services related to operation of railway infrastructure,
establishment and operation of railway, telecommunication and radio networks,
construction, modification and maintenance of railway and funicular lines,
other business activities as entered into the Commercial Register,
levying charges for the access to railway infrastructure.
Organisational structure:
1.2.Objective
The Network Statement (hereinafter NS) is a document containing the terms of using the railway network of ŽSR, which has been prepared according to the Act of the National Council of the Slovak Republic No. 513/2009 Coll. on Railways and on amendment and completion of certain acts as amended by later regulation. Its text is in accordance with legal regulations of Slovak Republic and internal legislation of ŽSR and is intended as an informative material for railway undertakings.
The Network Statement provides general information on the railway network, important conditions for the access to railway infrastructure, as well as rules and procedures of railway infrastructure charging and path capacity allocation and information on services provided by the infrastructure manager (ŽSR) for railway undertakings.
1.3.Legal framework
The basic legislative conditions for railway construction, operation of railway infrastructure, operation of transport on railway infrastructure, as well as the rights and obligations of the natural and legal entities related to these activities are stipulated by the Act on railways and its implementing decree, as noted in the next text provisions.

1.3.4.Other requisite regulations
Transport operation on the railway infrastructure is subject to the European and national legislative regulations as well as to uniform technological processes and regulations of the railway undertaking. These activities can be performed by a responsible person defined by the RU.
The rules of the transport operation on the railway infrastructure determine the scope, means and conditions of the train operator’s activities, which are necessary for securing the transport operation, especially:
a)operation of rolling stock
b)driving of rolling stock
c)stopping and breaking of the train
d)accompanying the train
1.4.Legal Status
1.4.1.General Remarks
The Network Statement is aninformatory document based on the legislative regulations of the Slovak Republic and on transposed EU Directives provisions. In the case of uncertainty and lawsuits it is possible to apply respective provisions of legislative regulations of the Slovak Republic.
Comments, suggestion and requests regarding the Network Statement may be addressed to the Trade Department at Directorate General of ŽSR.
1.4.2.Liability
Železnice Slovenskej republiky, Bratislavashall be responsible for the information provided within this Network Statement.
1.4.3.Appeals Procedures
The Regulatory authority is obliged to deal with the suggestions and complaints on unfair and discriminatory decision-making and activities of the infrastructure manager, in matters related to:
a)terms of using the railway infrastructure and criteria listed in these terms,
b)allocation process at providing the infrastructure capacity,
c)access to the railway infrastructure and to the rail services connected to it,
d)enforcement of charges for using of the railway infrastructure.
The Regulatory authority has to decide on complaints and adopt remedial measures within 2 month from beginning of the procedure. The remedial measures are imposing of obligation to refrain from unfair and discriminatory behaviour and imposing of obligation to eliminate the unlawful state of things.
1.5.Structure of network statement
The Network Statement is elaborated in according to the general structure adopted by the RailNetEurope community, namely to the document issued by its Working Group for Network Statement.This organization brings together the majority of the European infrastructure managers. The Network Statement ensures availability of the information for the potential and existent railway undertakings, while following a harmonized format of the Network Statement with other infrastructure managers.
