Electricity Safety (Equipment Efficiency) Regulations 1999

S.R. No. 48/1999

Part 1—Preliminary

1. Objectives

The objectives of these Regulations are to—

(a) prescribe standards of energy efficiency and performance for proclaimed electrical equipment;

(b) provide for the registration and labelling of proclaimed electrical equipment;

(c) prescribe fees, penalties and other matters authorised by the Electricity Safety Act 1998.

2. Authorising provisions

These Regulations are made under sections 154 and 157 of the Electricity Safety Act 1998.

3. Commencement

(1) These Regulations, except regulations 6(2) and (3), 8(3), 11(b) and (c), 13(1)(a)(ii) and Schedule4, come into operation on 3 May 1999.

(2) Regulations 6(2) and (3), 8(3), 11(b) and (c), 13(1)(a)(ii) and Schedule 4 come into operation on 1 October 1999.

5. Definitions

(1) In these Regulations—

Reg. 5(1) def. of "AS 1056.1:1991" amended as "AS 1056.1—1991" by S.R.No. 93/2001 reg.5(1)(a).

"AS 1056.1—1991" means AS1056.1—1991 as referred to in Schedule 4 and amended from time to time;

Reg. 5(1) def. of "AS/NZS 1359.5:2000" inserted by S.R. No. 93/2001 reg.5(1)(b).

"AS/NZS 1359.5:2000" means AS/NZS1359.5:2000 as referred to in Schedule4 and amended from time to time;

"AS/NZS 1359.102.3:2000" means AS/NZS1359.102.3:2000 as referred to in Schedule4 and amended from time to time;

"AS/NZS 4474.1:1997" means AS/NZS 4474.1:1997 as referred to in Schedule 3 and amended from time to time;

"AS/NZS 4474.2:2000" means AS/NZS 4474.2:2000 as referred to in Schedule 3 and amended from time to time;

"AS/NZS 4783.1:2001" means AS/NZS4783.1:2001 as referred to in Schedule 3 and amended from time to time;

"AS/NZS 4783.2:2002" means AS/NZS4783.2:2002 as referred to in Schedule 3 and amended from time to time;

"display front" means an assembly which is intended to represent the front of proclaimed electrical equipment;

Reg. 5(1) def. of "registrable fluorescent lamp ballast" inserted by S.R. No. 98/2003 reg.6.

"registrable fluorescent lamp ballast" means a ballast of the type referred to in clause 6.4.1 of AS/NZS 4783.2:2002;

"registration holder" means a person in whose name proclaimed electrical equipment is registered or to whom registration of proclaimed electrical equipment has been transferred;

"the Act" means the Electricity Safety Act 1998.

(2) In these Regulations, a reference to a relevant standard or a Part of a relevant standard in relation to proclaimed electrical equipment is to be taken to be a reference to the applicable standard as amended from time to time for that equipment set out in Schedule 3.

Part 2—Standards

6. Minimum standards for energy efficiency and performance

Reg. 6(1) amended by S. R. No. 93/2001 reg.6(1).

(1) Proclaimed electrical equipment listed in Schedule3 must comply with the performance criteria (other than minimum energy performance standards) set out in the relevant standard when tested in accordance with the relevant standard by a laboratory accredited by the National Association of Testing Authorities or approved by the Office.

(1A) Sub-regulation (1) does not apply to registrable fluorescent lamp ballasts.

(2) Refrigerating appliances must also comply with the minimum energy performance standards set out in clause 3.5 of AS/NZS 4474.2:2000 when tested in accordance with AS/NZS 4474.1:1997 by a laboratory accredited by the National Association of Testing Authorities or approved by the Office.

(3) Storage water heaters must comply with the energy efficiency requirements set out in clause2.4 of AS 1056.1—1991 when tested in accordance with Appendix B of that standard by a laboratory accredited by the National Association of Testing Authorities or approved by the Office.

(4) Three-phase cage induction motors must comply with the minimum efficiency requirements set out in—

(a) clause 2.1 of AS/NZS 1359.5:2000 when tested in accordance with AS/NZS 1359.102.3:2000 by a laboratory accredited by the National Association of Testing Authorities or approved by the Office; or

(b) clause 2.2 of AS/NZS 1359.5:2000 when tested in accordance with AS1359.102.1—1997 by a laboratory accredited by the National Association of Testing Authorities or approved by the Office.

(5) Three-phase airconditioners and heat pumps must comply with—

(a) the performance criterion set out in clause3.2 of AS/NZS 3823.2:2001 when tested in accordance with AS/NZS 3823.1.1:1998 or AS/NZS3823.1.2:2001 (as the case requires) by a laboratory accredited by the National Association of Testing Authorities or approved by the Office; and

(b) the minimum energy performance standard set out in clause 3.3 of AS/NZS 3823.2:2001 when tested in accordance with AS/NZS3823.1.1:1998 or AS/NZS3823.1.2:2001 or AS/NZS3823.3:2001 (as the case requires) by a laboratory accredited by the National Association of Testing Authorities or approved by the Office.

(6) Registrable fluorescent lamp ballasts must comply with—

(a) the performance criteria set out in clause 6.2 of AS/NZS 4783.2:2002 when tested in accordance with AS/NZS 4783.1:2001 by a laboratory accredited by the National Association of Testing Authorities or approved by the Office; and

(b) the minimum energy performance standardsset out in clause 6.4.1 of AS/NZS4783.2:2002 when tested in accordance with AS/NZS 4783.1:2001 by a laboratory accredited by the National Association of Testing Authorities or approved by the Office; and

(c) in the case of a ballast labelled with an energy efficiency index classification of A1, the requirements set out in clause5.3.2 of AS/NZS 4783.2:2002 when tested in accordance with AS/NZS 4783.1:2001 by a laboratory accredited by the National Association of Testing Authorities or approved by the Office.

Part 3—Registration

6A. Proclaimed electrical equipment not requiring registration

This Part does not apply to fluorescent lamp ballasts that are not registrable fluorescent lamp ballasts.

7. Regulatory authorities

For the purposes of section 68 of the Act, proclaimed electrical equipment may be registered by—

(a) the Office; or

(b) a person or body in another State or Territory that administers the minimum standards for energy efficiency of electrical equipment for that State or Territory.

8. Applications for registration

(1) A person may apply to the Office for the registration of proclaimed electrical equipment.

(2) An application for the registration of proclaimed electrical equipment that is listed in Schedule 3 must—

(a) be in the form set out in Part 2 of the relevant standard; and

(b) specify whether the equipment complies with the minimum standards prescribed in regulation 6; and

(c) be accompanied by—

(i) the results of testing and calculations referred to in section 2 of Part 2 of the relevant standard; and

(ii) a sample of the electrical equipment label to be attached to the equipment; and

(iii) the results of testing referred to in regulation 6 in the form set out in the relevant standard; and

(iv) the relevant fee set out in Schedule 2.

(2A) Sub-regulation (2) does not apply to registrable fluorescent lamp ballasts.

(3) An application for the registration of a storage water heater must—

(a) be in writing and include—

(i) the applicant's business name, address and telephone and facsimile numbers; and

r. 8

(ii) if the applicant's address is not in Australia or New Zealand, the name and address of a person in Australia or New Zealand who can provide information about the application; and

(iii) a description of the type of equipment and its brand name, model name and model number; and

(iv) a declaration by the applicant or a person authorised by the applicant that the equipment complies with regulation 6(3); and

(b) be accompanied by the relevant fee set out in Schedule 2.

(3A) An application for the registration of a three-phase cage induction motor must—

(a) be made in accordance with the requirements for an application for registration set out in section 4 of AS/NZS 1359.5:2000; and

(b) be in the form set out in Appendix A of AS/NZS 1359.5:2000; and

(c) specify whether the equipment complies with the minimum efficiency requirements prescribed in regulation 6(4); and

(d) be accompanied by the relevant fee set out in Schedule 2.

(3B) An application for the registration of a three-phase airconditioner or heat pump must—

(a) be made in accordance with the requirements for an application for registration set out in section 4 of AS/NZS 3823.2:2001; and

(b) be in the form set out in Appendix C of AS/NZS 3823.2:2001; and

(c) specify whether the equipment complies with the performance criterion and the minimum energy performance standard prescribed in regulation 6(5); and

(d) be accompanied by the relevant fee set out in Schedule 2; and

(e) if the applicant elects to register for energy labelling, include or be accompanied by an application in the form of Appendix B of AS/NZS3823.2:2001, and be accompanied by—

(i) the results of testing and calculations referred to in section2 of AS/NZS 3823.2:2001; and

(ii) a sample of the electrical equipment label to be attached to the three-phase airconditioner or heat pump.

(3C) An application for the registration of a three-phase airconditioner or heat pump for energy labelling, if the airconditioner or heat pump is already registered for the minimum energy performance standard, must—

(a) be made in accordance with the requirements for an application for registration set out in section 4 of AS/NZS 3823.2:2001; and

(b) be in the form set out in Appendix B of AS/NZS 3823.2:2001; and

(c) be accompanied by—

(i) the results of testing and calculations referred to in section2 of AS/NZS 3823.2:2001; and

(ii) a sample of the electrical equipment label to be attached to the three-phase airconditioner or heat pump.

(3D) An application for the registration of a registrable fluorescent lamp ballast must—

(a) be made in accordance with the requirements for an application for registration set out in section 7 of AS/NZS 4783.2:2002; and

(b) be in the form set out in Appendix A of AS/NZS 4783.2:2002; and

(c) specify whether the equipment complies with the performance criteria and the minimum energy performance standards prescribed in regulation 6(6); and

(d) be accompanied by—

(i) the results of testing referred to in regulation 6(6) in the form set out in Appendix G of AS/NZS 4783.1:2001; and

(ii) a likeness of the electrical equipment label to be printed on the equipment; and

(iii) the relevant fee set out in Schedule 2.

(4) An application for the registration of proclaimed electrical equipment may specify a range of models of the one brand under the same application if each of the models referred to in the application has the same relevant physical characteristics, energy efficiency and performance characteristics.

(5) The Office may require the applicant to provide any additional information about the physical characteristics, the energy efficiency and performance characteristics of the electrical equipment that it considers necessary to determine the application.
