Draft Agreement to Job Share

This agreement is entered into this ______(date) for the following stated considerations, between ______County and ______.

I, ______, am a current employee of ______County. I have read, understand and agree to comply with all policies and procedures of _____ County during the time I am working as a part-time employee of the County in the position of ______. In consideration for the County allowing me to work part-time in this position, which is normally a full-time position, and for other good and valuable consideration including ______(you may list here any benefits to which a part-timer is not usually entitled which the incumbent may receive), I hereby acknowledge and agree as follows:

______agrees that while employed by ____ County in this part-time position s/he shall devote his or her best efforts in pursuit of all duties in this position, and to the best of his or her ability, experience and talents, perform all that may be required of her or him as an employee. ______agrees that s/he shall observe and conform to the policies and directions established by the management of ______County, and that s/he will faithfully assume and perform all duties customarily performed by a ______(position title). ______agrees that’s/he will devote his or her full time, ability and attention to the public concerns of the office of ______County ______and that s/he will neither directly nor indirectly provide any services of a business, commercial or professional nature to any other person, firm, corporation, organization or entity for compensation without prior written consent and approval of the Board of County Commissioners.

______and ______County agree that the position of ______currently includes but may not be limited to the duties described on the Job Description attached hereto and made a part of this agreement. The parties further agree that the County expressly reserves the right to alter, change amend, modify and add to or remove from that description of duties at any time and for any reason for which the County sees fit.

The County agrees to compensate ______(name) as follows: (specify completely).

The hours and days of the job share position will be as follows: (specify arrangement including reporting times and number of hours per week, or if exempt position, the expectations for coverage beyond 40 hours in the case of emergencies or other business necessities). This schedule shall commence on _____ (date) and continue until the County gives notice of a need for a change. The parties further agree that the County expressly reserves the right to alter, change amend, modify and add to or remove days and/or hours from that schedule at any time and for any reason for which the County sees fit.

In the event that it becomes necessary for this position to become a full-time position once again, the County agrees to give the employee two weeks’ notice of the starting date of a full-time employee in this position. Any decision to fill that full-time position will be in the sole and absolute discretion of the county and may be based on any legal factor which the County, in its sole and absolute discretion, shall decide.

I, ______, hereby acknowledge and agree that my employment with Garfield County has been and continues to be, as an at-will employee and that neither this agreement nor any other written or verbal statements by Garfield County representatives are intended to alter that relationship. I acknowledge that either Garfield County or I have the right to terminate my employment at any time and without cause.

This agreement shall be interpreted under the laws of the State of Colorado and may not be modified except in writing, signed by both parties. . Should any part of this agreement be found to be unenforceable, for any reason, the validity, legality or enforceability of any other provisions shall not be affected.
