● Choose whichever format is easiest for you: I accept single-sided paper copies, CDs, flash drives, or electronic copies via e-mail such as ‘hightail’ or ‘dropbox’

● It is helpful to provide the dates of admissions if the case involves more than one, and to separate the records for each admission, but please do not feel obligated to prepare a case summary or organize the chart in any particular way

● I will always review the original deposition transcripts, so there is no need to prepare a summary

● Please send all the available records pertaining to the case. I hesitate to give case assessments based on only a portion of the records

● Please send all correspondence to my home address listed on my CV.

●Signature for receipt of records upon delivery is not necessary

The assignment- please specify the following:

● Whether I am expected to assess standard of care, causation, damages, etc.

● Which particular provider(s) or facility are you expecting me to assess

● Are there any particular issues I should address, or any that you specifically do not want me to address

● Are there any specific questions you would like answered

Communication- please specify the following :

● Whether e-mails are discoverable in your state

● Whether drafts of written reports are discoverable in your state

What you can expect from me:

● Thorough, thoughtful, informative, detailed, and understandable reviews

● Prompt and reliable communication: e-mails and voice messages will almost always be returned within a few hours, and certainly by the following morning. If I do not respond, it means that I did not get the message, so please try again

● I usually review a case and prepare a verbal presentation of my opinions within two weeks of receipt of the records. If there is a time constraint from your end, such as nearing the statute of limitations, please alert me to this, and I should be able to accommodate you

● Fair and honest billing practices

My experience:

● I review about 50 cases per year, which comprises about 20% of my professional time. My full-time clinical practice accounts for the other 80%.

● About 80% of my cases are for plaintiff attorneys, 20% for the defense.

● For plaintiff cases, I find a deviation from the standard of care in about 50% of cases, and of those cases, I find that causation can be established about 50% of the time. Therefore, on average, I can support approximately 25% of cases that I review. For defense cases, I am able to offer support in approximately 75% of cases.

● I have reviewed about 600 cases in my career, I have been deposed approximately 20 times, and testified in court approximately 10 times.
