Pursuant to Article 45 paragraph 1 item 2 of the Law on Local Self-Government ("Official Gazette of Montenegro", no. 42/03, 28/04, 75/05, 13/06 and "Official Gazette of Montenegro", No. 88/09, 03 / 10, 73/10, 38/12 and 10/14), and Article 48 of the Statute of the Capital - Podgorica ("Official Gazette of Montenegro - municipal regulations", Nos. 28/06 and "Official Gazette of Montenegro - Municipal Regulations", No. 39 / 10 and 18/12), the Assembly of the Capital - Podgorica, at the session held on ______passed the
DECISION
on establishing the business zones in the capital Podgorica and incentives for higher employment
Article 1
This Decision establishes the business zones in the capital Podgorica, the types of activities that can be performed in business zones, the requirements for their performance, tax and administrative incentives and other issues of importance to encouraging investments and higher employment in the capital.
Article 2
Business zone referred to in Article 1 of this Decision shall be determined in the area of parcels set out in the tables which are an integral part of this decision, are engaged following planning documents:
- Urban parcels in DUP “Service-storage zone with marshalling yard” area of the project plan is 151,26 hectares, and the total area of urban land that is the subject of this decision is approximately 32,1 hectares.

Article 3
The business zones reffered to in Article 2 of this Decision the business entities can perform the following activities:
1.agriculture, forestry, fisheries,
2.agro-industry (small agribusiness and trade, processing of milk and dairy products, milling pekaraska industry, production of biscuits and confectionery, tobacco distribution storage, processing of fruit and vegetables, production of alcohol and bezalakoholonih beverages, ready meals, meat and meat products, discount sales of meat and smoked meat products),
3.manufacturing (food processing, textile, tobacco, leather and footwear industry, light chemical industry, pulp and paper, metallurgy, mechanical industry, electrical industry, printing industry, building industry, wood industry),
4.transport, storage and refrigeration,
5.information and communication,
6.professional, scientific and technical activities,
7.warehouses open, semi-open and closed,
8.operating plants processing, finishing, packing and expedition
9.showrooms,
10.goods distribution centers,
11.manufacturing trades,
12.economic facilities and
13.service activities.
Article 4
Financial incentives to enterprises engaged in business activities in the zone are:
- Providing land for use for a period of up to 30 years free of charge,
- The release of the obligation to pay fees for communal equipping of buildable land, provided that the investor at his own expense make utility equipping sites, in accordance with the Decision on fees for communal equipping of buildable land;
- The release of the obligation to pay annual fees for use of municipal roads in the business zone for 5 years;
- Exemption from tax on immovable property 5 years, according to the Decision on Property Tax.

The right to a deduction under paragraph 1 of this Article are business entities that within three months from the date of commencement of the activity in a business zone from gaining employment for an indefinite period with a corresponding number of persons with records unemployed in the capital, established a table:

Depending on the size of land used by a business entity within the business zone, the number of newly employed as a condition for obtaining exemptions will be corrected proportionally to the size of the land in relation to the size of the urban lots where land used belongs to.
If entity terminate the relationship with the employee referred to in paragraph 2 of this Article, the user of business zones shall, within 30 days establish working relations with another person registered as unemployed in the capital and needs to inform the controlerof business zone.
Article 5
Facilities and equipment of municipal infrastructure which economic entities will build in the business zone are owned by the Capital City , in accordance with the law governing state property .
Article 6
Locations for construction of facilities in the business zones are assigned to users based on public invitation . Public invitation announced by controller of the business zone.
Public announcement includes:
- precise wording to which urban land in business zones invitation relates;
- requirements that potential users must meet to be able to apply to the public invitation,
- defined financial incentives,
- The deadline for submitting applications to the public call and
- The deadline for a decision on the award of certain urban plots to use.
Interested undertaking to the notification accompanied by:
- proof that he is registered in the Central Registry of undertakings (hereinafter referred to as the CRCC);
- Evidence of the undertaking is not of bankruptcy or liquidation, except for reorganization in accordance with the law governing bankruptcy of business entities;
- evidence that has not been convicted of a criminal offense was committed in the exercise of economic activity;
- evidence that it has settled all liabilities arising from taxes, duties and contributions;
- proof that during the previous 12 months preceding the application has not reduced the number of employees in Montenegro for 10% or more;
- evidence that he did not allocated funds for the same purpose from the budget of Montenegro;
- proof that in undertaking the state or local government has a majority share in the property;
- evidence that is not in difficulty in accordance with the rules on state aid;
- evidence that it is not obliged to refund received illegal state aid;
- investment project and business plan
- evidence on the sources of financing investment.
Public announcement is published on the website of the Capital City and in at least two media. The deadline for submitting applications per advertised public announcement at least 30 days. Mayor of the City of Podgorica formed a commission to evaluate the proposal based on the criteria defined in this Decision. Commission for evaluation of bids has at least five members.
Article 7
Criteria for the selection of the user logged on the public call are: number of employees; the value of investments; Length of land use; assessment of the quality of the investment project; references of the applicant and the Commission's assessment of the secured source of funding. Scoring of a potential users of business zones is done according to these criteria and the range of points defined in the following table:

According to established criteria and procedures of the award for each parcel will sign a contract, which will stipulate the rights and obligations of the parties. The contract with the selected user of land within the business zone will be signed no later than 30 days from the decision of the Commission evaluates the bids.
The contract with the users of business zones are defined: the contract sides, their use of urban parcel in the business zone, the period for which the contract is valid, obligations and responsibilities which should be held by the Contracting Parties, as well as financial benefits for users of business zones .
In case of violation of the contract by the customer or user, it will lose the right to exemptions set forth in this Decision.
Article 8
The authority of the Capital City in charge of affairs of entrepreneurship managed business areas. Controller of the business zone keeps a register of business users of the zone and monitors the users of business zones in respect of compliance with the minimum number of employees.
The register contains the following information: name of the user of business zone, users activity in business zone, the value of customers' investments, the size of land and buildings used by the user, the number of employees at the user and the type and amount of approved and implemented benefits for each user in a business zone.
Changes in these data base for users of the business zone is required to submit to controller of the business zone within 30 days.
Article 9
This Decision hereof shall come into force on the eighth day of its publishing in the " Official Gazette of Montenegro - municipal regulations ", it shall apply from 01 January 2016.
