City of Oviedo Parking Laws

The following information and links are supplied by the Oviedo Police Department to raise awareness to HOA members of parking laws and parking concerns in neighborhoods. The most common calls for police service related to parking violations are: blocking sidewalks; blocking driveways; parking on the grass; parking facing the wrong direction on a roadway; parking within 30 feet of stop signs; stopping on or over crosswalks near schools during school hours; school pick up line vehicles blocking resident driveways while waiting in line. If you park your car in your driveway remember that you car cannot extend over the sidewalk. This creates an unsafe situation where children and bicyclists begin to use the street instead of the sidewalks. And remember the number one parking problem in the City of Oviedo are cars left parked unattended with doors unlocked, allowing easy access for car burglars. Please lock your car doors.

The following parking information is taken from the Florida Drivers License Handbook. (website listed below).

“When parking on a public road, move as far away from traffic as possible. If there is a roadside shoulder, pull as far onto it as you can. If there is a curb, pull close to it - you must not park more than one foot away.

Always park on the right side of the roadway, unless it is a one-way street. Make sure your vehicle cannot move. Set the parking brake and shift to park with an automatic transmission or reverse with a manual transmission. Turn off the engine and lock the vehicle. Florida law requires that you take the keys out of your vehicle before leaving it. Always check traffic behind you before getting out, or get out on the curb side. Before you leave any parked position, look over your shoulder to the rear to make sure the way is clear. Give the proper turn signal if driving from a curb and yield to other traffic.

Where Parking is not Allowed

  • On the roadway side of another parked vehicle (double parking).
  • On crosswalks.
  • On sidewalks.
  • In front of driveways.
  • By curbs painted yellow or where "No Parking" signs are posted.
  • Within intersections.
  • Within 15 feet of a fire hydrant.
  • Within 20 feet of an intersection.
  • Within 20 feet of the entrance to a fire, ambulance or rescue squad station.
  • Within 50 feet of a railroad crossing.
  • On the hard surface of a highway where parking spaces are not marked.
  • On any bridge or overpass or in any tunnel.
  • Within 30 feet of a rural mail box on a state highway between 8 a.m. and 6 p.m.
  • Within 30 feet of any flashing signal, stop sign or traffic signal.
  • In such a way that you block or create a hazard for other vehicles.”

The next information comes from City Ordinance, Sec. 50-49. - Vehicles on public right-of-way and deals with prohibitions of parking commercial vehicles in neighborhoods in the City of Oviedo (web link is listed below).

Large vehicles in right-of-way adjacent to residential property; exception. No person shall stop, park, or leave standing any portion of any boat trailer, boom truck, dump truck, camping trailer, recreational vehicle, semitrailer, temporary living quarters, trailer, travel trailer, truck camper, truck tractor, truck trailer, wrecker, or single-unit truck in a public road right-of-way directly adjacent to any property zoned R-1AAA, R-1AA, R-1A, R-1, R-1B, R-1BB, R-2, R-3, MH-1, PUD-R-3, and residential use areas of R-P, MUD, PUD, and C-PUD, as established by the zoning ordinance of the city. The following are exempted from the provisions of this subsection: (1) Vehicles that are actively being used in support of street construction, maintenance and repair. (2) Truck equipment, trailers, and vehicles used by the public service utility companies actively engaged in repairing or extending public service utilities. (3) Motorbuses, when taking on or discharging passengers at designated bus stops. (4) Vehicles parked at a designated loading/unloading zone. (5) Vehicles parked in a designated parking zone. (6) Any vehicle which develops a mechanical defect after such vehicle has commenced to operate en route, making it unsafe to proceed further. In such event it shall be lawful to stand or park the vehicle during the time necessary to make emergency repairs, provided that said time does not exceed 24 hours. (7) Any vehicle being utilized at an active permitted construction site. (8) The parking or standing of vehicles for the purpose of expeditiously loading and unloading passengers, freight, or merchandise, or performing services. (9) Emergency vehicles that are being actively used in the course of normal duty.

(c) Prohibited purposes for parking any vehicle in the right-of-way. No person shall park any vehicle within the rights-of-way within the municipal limits of the city for the purpose of: (1) Displaying such vehicle for sale or rent; (2) Washing, greasing, or repairing such vehicle except repairs necessitated by an emergency; and (3) Displaying for sale or rent or selling or renting any merchandise.
