DEALER TERMS OF AGREEMENT

These Terms of Agreement are effective as of January 1st, 2009 and are applicable to all new and currentdealers in Canada and United States. MILSIG Paintball Canada Ltd.reserves the right to change or modify any of these terms and conditions at any time without notice.
Documentation between MILSIG Paintball Canada Ltd.and dealer shall prevail in the event of any discrepancy between these Terms and Conditions and the dealer’s documentation.
It is the dealer’s responsibility to remain up to date with any changes to our dealer policy andterms and conditions. We will notify all dealers of any important changes to the dealer terms and conditions by email or by phone.

All dealer applicants must be at least 18 years of age.MILSIG Paintball Canada Ltd.reserves the right to demand and receive adequate proof of age at any time.All dealer applications are subject to current and ongoing verification.

  1. Dealer Requirements
  2. Dealers must be a registered business in Canada or United States with proof of business registration and federal tax number.
  3. Dealers must maintain the MSRP/MAP pricing structure as set by MILSIG Paintball Canada Ltd., failure to do so may result in immediate termination of dealer status.
  4. Dealers must purchase a Dealer Starter Package in order to obtain official dealer status.
  5. There is no minimum order requirement to maintain your dealer status.
  6. There are no monthly or periodic minimum purchase requirements.
  7. Agreement Terms
  8. Dealer agreements may be terminated at anytime and without notice.
  9. Dealer must read and acknowledge the terms and conditions in this dealer application.
  10. Dealer prices are only valid for 30 days and subject to chance due to changes in global exchange rates and transportation costs.
  11. Dealer must respect all copyrights, trademarks and patents of the Milsig brand, logo and product design. Copyright infringement is subject to legal prosecution in the court of law.

  17. Selling Restrictions
  18. Dealers are not permitted to sell or advertise MILSIG products on any online auction or classified web sites including but not limited to eBay, craigslist or any similar website. This is strictly enforced and subject to immediate termination of dealer status.
  19. Dealers must sell to responsibility individuals of 18 years of age or older only.
  20. Customers under the age of 18 must be accompanied by a parent or guardian in order to purchase a paintball marker.
  21. Dealers are not to remove any items that are originally included from the factory; you may not remove standard accessories to sell separately.
  22. We recommend dealers make all customers sign a waiver form to protect your business from potential legal liabilities and law suits resulting from injuries caused by the misuse or miscare of a paintball marker.
  23. We also recommend documenting the Serial No. of the marker and obtaining a driver’s license photo-copy of every customer who purchases a marker in the event of a criminal investigation resulting from the unlawful use of the paintball marker.
  24. Payment Information
  25. All Canadian dealers must pay 5% GST.
  26. All dealers in BC who are purchasing for resale do not need to pay 7% PSTwith proof of registration of a valid PST number.
  27. We accept payment by Direct Deposit, Email Money Transfer, Credit Cards, Cheques, Bank Drafts, Bank Wire Transfer, Paypal.

  30. Full payment must be received in full with all funds cleared before any order is shipped out.

  32. All instock items will be shipped within 48 hours upon completion of payment.
  33. All orders are shipped via UPS with online tracking.
  34. Shipping charges are not included and will be calculated depending on the order weight/size and the shipping destination.

  39. Safety & Liability
  40. MILSIG Paintball Canada Ltd. is not responsible for any personal injuries resulting from the use of MILSIG paintball products.
  41. MILSIG Paintball Canada Ltd. is not liable for any damages to public or private property resulting from the use of MILSIG paintball products.
  42. Dealers are responsible for educating the end customer of the basic operations and safety features of the paintball marker and no one should operate a paintball marker before completely reading the User Manual.
  43. Warranty Policy
  44. All MILSIG paintball markers include a one year manufacturer’s warranty against defects in materials and workmanship.
  45. Dealers must provide basic troubleshooting and problem diagnosing before any marker is shipped back to MILSIG Paintball Canada Ltd. for warranty service or claims.
  46. All MILSIG accessories including magazines, conversion kits, stocks, air systems and barrels are not covered with a manufacturer’s warranty. Accessories that are received damaged must be returned to MILSIG Canada within 30 days for exchange or credit.
  47. MILSIG Paintball Canada Ltd. will credit dealers back for parts used for valid warranty repairs.
  48. Dealers who want to provide factory warranty servicing and repairs for MILSIG will be required to attend a technical training course offered by MILSIG Canada in order to be recognized and certified as an official MILSIG factory technician and warranty centre.
  49. MILSIG Paintball Canada Ltd. reserves the right to void the manufacturer’s warranty if a marker has been modified or improperly repaired by a dealer.
  50. Trademark and Copyright Policy
  51. The MILSIG logo is a registered trademark of MILSIG Industries and protected by international copyright laws.
  52. The MILSIG Canada logo is a registered trademark of MILSIG Paintball Canada Ltd. and cannot be used without prior written consent.
  53. All materials and contenton including, but not limited to, all text, graphics, photographs, data and images, are the property of MILSIG Paintball Canada Ltd. and, subject to and protected by copyrights owned by MILSIG Paintball Canada Ltd.
  54. Dealers must receive prior consent from MILSIG Paintball Canada Ltd. to use our trademark, logos, graphics, photographs, data or images.

LEGAL DISCLAIMER

Please note that Milsigpaintball products are designated for use for the recreational sport of Paintball only. These are not real firearms, nor airsoft guns, nor replica firearms. These markers can only fire 0.68 Cal. paintballs and cannot be converted to fire real live ammunition, simunition, 6mm plastic bb pellets, nor 0.43 caliber lead pellets.

These markers are not 1:1 scale to any real firearms to existence. These markers can only shoot at a maximum velocity of 320 fps when using 0.68 Cal. (17.4mm) paintballs. These markers comform to all Canada, USA and United Kingdom federal laws and regulations, and are designed for users 18 years of age and older.

Milsigpaintball markers are not toys and should be treated as if it were a real firearm. The marker should handled with safety and common sense in mind and should be stored and transported securely out of sight from the public. The incorrect or unlawful use of this marker can result in serious bodily injuries or criminal prosecutionin the court of law.
