INTRODUCTION

Theauthorityof theFederalCommunicationsCommissiontoimposeandcollectfeesand associatedchargesiscontainedinTitleIII, Section3001, of theOmnibusBudget ReconciliationActof 1989 (PublicLaw101-39), Section8, revising47 U.S.C. § 158, whichdirectstheCommissiontoprescribechargesfor certaintypesof servicesit

providestocommunicationsentitiesoverwhichithas jurisdiction.

TheFCC's EnforcementBureauisprimarilyresponsiblefor enforcementof mostof the provisionsof theCommunicationsActas wellas enforcementof theCommission'srules, orders andauthorizations.Among otherthings,theEnforcementBureauadjudicates Section 208, Data Roaming, and Open InternetFormalComplaintsas well as Section 224 PoleAttachment Complaints. In order to properly file one of these complaints, a filer must pay an Application Processing Fee.

ThisFeeFilingGuideisconsideredareferenceguidetoidentifyanddescribeapplication processing fee requirementsfor theEnforcementBureau.Itismeanttobeahandyreferencefor the servicesandrequestsfor FCC actionsfor whichtheEnforcementBureauhas responsibilitythataresubjecttoanFCC Application Processing Fee.Theguideconsistsof two parts,Parts A and B,as wellas abreakdownof thetypesof applications,formnumbers,feeamounts, paymenttypecodes,andthemailingaddress for eachserviceprovided.Italsocontainsa copyof FCC Form159, FCC RemittanceAdviceForm,andinstructionson itsuse.

DEBT COLLECTION IMPROVEMENT ACT

In accordancewith the Debt CollectionImprovement Act (DCIA), the Commission will beginwithholding actionon applicationsand otherrequests forbenefits upon discovery

that the entityapplying fororseekingbenefits isdelinquent inits non-tax debts owed to the Commission, and willdismiss such applicationsorrequests ifthe delinquent debt isnot resolved.Ourapplicationfeeruleshave been amended to state that we willwithhold

actionon applicationsorotherrequests ifpayment of the delinquent debt isnot made or satisfactoryarrangementsforpayment arenot made. Those ruleamendments areeffective October1, 2004.

REMITTANCE ADVICE - FCC FORM159

TheRemittanceAdvice,FCC Form159, mustaccompanypaymenttotheFederal CommunicationsCommissionfor RegulatoryFees, ApplicationProcessing Fees, Fines, Forfeitures,Freedomof InformationAct(FOIA) billingsor anyotherdebtduetotheFCC. The informationon thisformiscollectedandstoredinadatabasetoensurecreditof fullpaymentof moniesdue,toexpediteanyrefunds due,andtoservicepublicinquiries.PleaserefertoPartB/C of thisguidefor specificformrequirements.Reproducedforms areacceptable.FCC Form159C isa remittanceadvicecontinuationsheetthatmustbeused when payingfor morethantwo call signs inasinglefilingor when payingfor multipleapplicantsinasinglefiling.Eachcallsign and/orapplicantmustbelistedseparatelyon theFCC Form159/FCCForm159C.

METHODOFPAYMENT (DO NOTSEND CASH)

Paymentof Application Processing Feesmaybemadebycheck,bankdraft,moneyorder,creditcard,or wiretransfer.If payingbycheck,bankdraft,moneyorder,or wiretransfer,your remittancemustbedenominated inU.S. dollars,drawn on aU.S. financialinstitutionandmadepayableto"FCC." WAIVERS, FEEDETERMINATIONS, AND DEFERRALS PROCESS

DEFINITIONS OFENFORCEMENT BUREAU SERVICES

TheEnforcementBureauisprimarilyresponsiblefor enforcementofmostof theprovisions of theCommunicationsActas wellas enforcementof theCommission’srules,orders and authorizations.Among otherthings,theEnforcementBureauisresponsiblefor the adjudicationof complaintsagainstcommoncarriersbyothercarriersinvolvingcompetition andothermarket-relatedissues. In addition,theEnforcementBureauisresponsiblefor resolutionof complaintsandenforcementinvolvingpublicsafetyandtechnicalissues such as equipmentrequirementsandunauthorizedconstructionandoperation.TheEnforcement Bureaualsoconductsinvestigations and inspectionsinresponse tocomplaintsandin support of theCommission’soperations.

FormalComplaints

A FormalComplaintisaformalallegationthatacommoncarrierhas failedtocomplywiththe CommunicationsAct.FormalComplaintsarefiledpursuanttosection208 of the CommunicationsAct,47 U.S.C. § 208. TheCommission’sproceduresregardingthefiling, review,andresolutionof such complaintsaresetforthinsections1.720–1.736 of the Commission’srules,47 C.F.R. §§ 1.720–1.736.
