REGULAR MEETING

DECEMBER 11, 2017

A regular meeting of the Sherrill City Commission was held at 7:00 p.m. on December 11, 2017. Present were Mayor W. Vineall, Commissioners T. Dixon, P. Hubbard,J. Gilbert, J. Merrill, City B. Lovett and City Clerk M. Holmes.

MINUTES

Motion was made by P. Hubbard and seconded by T. Dixon that the minutes of the previous regular meeting be approved as written.

Motion was made by J. Merrill and seconded by J. Gilbert that the following bills be approved for payment and W. Vineall be authorized to sign the warrant.

INCREMENTAL POWER PURCHASE AGREEMENT

M. Holmes reported that our agreement with the New York Power Authority to purchase our incremental power needs when we exceed over hydro allotments. This allows the city to remain full requirement customer. The agreement runs from January 1, 2018 – December 31, 2020.

Motion was made by T. Dixon and seconded by P. Hubbard to authorize the Mayor to executive the Incremental Power Purchase Agreement.

GAMES OF CHANCE LICENSE

M. Holmes reported that he has an application from the American Legion to renew their Games of Chance license for 2018. Motion was made by J. Merrill and seconded by T. Dixon to approve the application.

MODIFY EAST SENECA STREET FOR DOT RECORDS

B. Lovett reported that the DOT record has Sherrill Road running north from Route 5 to the first bend in the road by Sherrill NY Pizzeria. There is a street sign on Route 5 naming it E. Seneca Street from that point. M. Holmes has also conversation with the 911 center previously confirming North of Route 5 as the Start of E. Seneca St. Motion was made by J. Gilbert and seconded by J. Merrill that DOT ID 126801 to be modified to start at E. State Street and still run to Willow Street for a total of .34 miles and DOT ID #126827 be modified to eliminate the section that starts at E. Seneca Street and runs to E. State Street for .20 miles.

P&L EQUIPMENT RESERVE FUND

The following was moved by P. Hubbard and seconded by J. Merrill.

RESOLVED, that pursuant to Section 6-c of the General Municipal Law, as amended, there is hereby established a capital reserve fund to be known as the “P&L Equipment Reserve Fund” (hereinafter “Reserve Fund”. The purpose of this Reserve Fund is to accumulate monies to finance the cost of a type of equipment. This type of P&L equipment to be financed from the Reserve Fund is the acquisition of P&L equipment.

The City Comptroller is hereby directed to deposit and secure the monies of this Reserve Fund in the manner provided by Sections 10 of the General Municipal Law. The City Comptroller may invest the monies in the Reserve Fund in the manner provided by Sections 11 of the General Municipal Law, and consistent with the investment policy of the City of Sherrill. Any interest earned, or capital gains realized in the monies deposited or invested shall accrue to and become part of the Reserve Fund. The City Comptroller shall account for the Reserve Fund in a manner which maintains the separate identity of the Reserve Fund and show the date and amount of each cum paid into the fund, interest earned by the fund and capital gains or losses resulting frim the sale of investments of the fund, the amount and date of each withdrawal from the fund and the total assets of the fund, showing cash balance and schedule of investments,, and shall at the end of each fiscal year, render to the City Commission a detailed report of the operation and condition of the fund.

Except as otherwise provided by law, expenditures from this Reserve Fund shall only be made for the purpose for which the Reserve Fund is established. No expenditure shall be made from the Reserve Fund without the approval of this governing board and such additional actions or proceedings as may be required by Section 6-c of the General Municipal Law or any other law, including a permissive referendum if required by subdivision 4 Section 6-c.

The City Comptroller, Michael Holmes if he keeps a separate bank account is authorized along with the Deputy Comptroller, Renee Zupan to be the authorized signatures on this account when established.

2018 FIRE CONTRACT

M. Holmes reported that he has received the 2018 Fire Contract from Town of Vernon and it has been approved by the Sherrill-Kenwood Fire Board the contract is up to $32,103. Motion was made by J. Gilbert and seconded by J. Merrill to authorize the City Manager and City Clerk to execute it on behalf of the City.

2018 BUDGET HEARING

At 7:20 W. Vineall opened the 2018 Budget Public hearing. There were 3 members of the public present. None of whom spoke either for or against it. M. Holmes read the legal notice summarizing the tax rate $7.30, 2.4% increase and the fund balance re-appropriation. Mayor Vienall closed the public hearing. Motion was made by T. Dixon and seconded by J. Merrill to approve the 2018 proposal budget as presented.

EXECUTIVE SESSION

Motion was made by W. Vineall and seconded by J. Merrill to discuss personal employee reviews of the City Manager and City Comptroller.
