A RESOLUTION TO APPOINT THE PROSECUTING ATTORNEY ALSO KNOWN AS THE SOLICITOR FOR THE MUNICIPAL COURT OF THE CITY OF BLUE RIDGE, GEORGIA; TO CLARIFY THE CITY COUNCIL MEETING MINUTES OF OCTOBER 23, 2012 TO PROVIDE THAT JOSEPH HUDSON SHALL BE THE SOLICITOR FOR THE MUNCIPAL COURT; TO SET A TERM FOR SERVICE BY THE SOLICITOR; TO PROVIDE FOR COMPENSATION FOR THE SOLICTOR; AND FOR OTHER PURPOSES.
WHEREAS, O.C.G.A. § 15-18-90, et seq. provides that the City Council of the City of Blue Ridge, Georgia, is authorized to create the office of prosecuting attorney, also known as the Solicitor, of the Municipal Court of the City of Blue Ridge, and to select an attorney to fill said position;
WHEREAS, on October 23, 2012, the City Council of the City of Blue Ridge authorized the selection of an attorney to act as Solicitor for the municipal court, but the minutes of said meeting failed to specifically designate Joseph Hudson as the attorney selected by the Council to fill said position, and therefore said minutes need correction;
WHEREAS, the City Council desires to set the term for the Solicitor, and other aspects of his office as provided herein; and
NOW, THEREFORE, BE IT RESOLVED by the City of Blue Ridge, Georgia, and it is hereby resolved by the authority of the City Charter and the above-referenced authority as amended, as follows:
SECTION 1. CORRECTION OF OCTOBER 23, 2012 CITY COUNCIL
MEETING MINUTES.
The October 23, 2012 City Council meeting minutes authorized the City Council to appoint the prosecuting attorney also known as the Solicitor for the Municipal Court of the City of Blue Ridge, Georgia, but failed to designate the attorney selected by the City Council to fill this position. Therefore, said minutes need correction, and therefore the October 23, 2012 minutes are hereby corrected to provide that the following shall be added to said minutes: Motion to approve the appointment of Joseph Hudson as the prosecuting attorney also known as the Solicitor of the Municipal Court of Blue Ridge, Georgia, and with the term of service to be for the term of the current Council. At the organizational meeting of each new City Council in January of the year following the election, the new City Council can appoint the current Solicitor to another term or make a new selection. The current Solicitor shall be paid in accordance with such terms as are acceptable to the Solicitor and the City Council, and as budgeted by the City Council.
SECTION 2. APPOINTMENT OF PROSECUTING ATTORNEY
ALSO KNOWN AS THE SOLICITOR OF THE
MUNICIPAL COURT OF THE CITY OF BLUE RIDGE,
GEORGIA.
As the corrected October 23, 2012 City Council meeting minutes indicate, the City Council has and does appoint Joseph Hudson as the prosecuting attorney also known as the Solicitor of the Municipal Court of the City of Blue Ridge, Georgia, and subject to the term, and compensation as provided within said corrected minutes. Further, upon the enactment of a prosecuting attorney ordinance for the City of Blue Ridge, Georgia, the City Council does again appoint Joseph Hudson to fill said position, and acknowledges that Mr. Hudson meets the requirements of the ordinance. Subject to the provisions of the prosecuting attorney ordinance,
Mr. Hudson shall continue to serve until December 31, 2017, and may be reappointed for a new term by the new Council at the new Council’s organization meeting in January 2018. The City Council of the City of Blue Ridge, Georgia, does hereby ratify the acts of Mr. Hudson as Solicitor from the time period of October 23, 2012 to the date of enactment of this resolution by the City Council. The City Council further provides for the compensation for the Solicitor, as agreed to between the Solicitor and the City Council, and as provided for by the budget of the City of Blue Ridge, Georgia by the funding of the police department and the municipal court of the City.
