Vendor Contract for “Best Christkindlmarket Milwaukee” Market
Contract made this______day of______, 2014, by and between “Best Christkindlemarket Milwaukee” 901 W. Juneau Ave. Milwaukee Wisconsin 53203, and ______“Vendor”.
WHEREAS festival is about to produce a program known as “Best Christkindlemarket Milwaukee” for the Year 2014, to take place from November 20 through November 23, 2014.
WHERAS, both parties agree to be bound by the terms and conditions hereinafter set forth.
Term and Permit: Festival agrees to let and lease, and Vendor accepts, for the “Best Place Christkindlemarket” 2014 term only.
Payment and Fees: A rental fee of $50 will charged for a 10ft. x 10ft. space to be located in The Great Hall for the four days of the event.
In addition a 10% commission will be paid to “Best Christkindlemarket Milwaukee” on any sales over $500 dollars.
The fee will include a 10ft. x 10ft. space separated with pipe and drape, (2) 8ft. banquet tables and electric for normal lighting in The Great Hall.
The Vendors will be indoors so heating will not be needed.
The Operators will provide a uniform and holiday themed exterior of garlands, wreaths, lights as determined by the Operator.
Licenses and Permits: Vendor shall obtain all licenses and permits that are, or may be required by any public authority for sale of any of the products.
Festival Right to Control: Festival reserves the right to inspect all displays and remove any merchandise deemed inappropriate for the event. This would include such items as knives, firearms, fireworks any depiction or any other reference to any drugs or drug-related paraphernalia.
Liability, Insurance, and Indemnification: Vendor accepts full responsibility for all liability for damages to persons or property arising out of its use and occupancy of the premise and further understands that the Premises presently are owned by “Best Place at the Historic Pabst Brewery” and it does not assume any responsibility for losses or damages that may occur to the Vendor, its employees, agents, or property by reason of such occupancy.
Vendor shall at least 30 days prior to its use of the Premises, tender to festival, a certified copy of a policy of Public Liability Insurance, naming “Best Place at the Historic Pabst Brewery” as the insured. The minimum liability of not less than $500,000 combined single limit for bodily injury and property damage and liability coverage for product liability. Vendor further agrees to indemnify and hold harmless “Best Place at the Historic Pabst Brewery”.
Rules and Regulations: All Vendors will provide an Application for Vendor Space form fully completed at least 30 days prior to the Festival.
Vendors will be able to set up displays starting Wednesday November 19, 2014 after 4:00pm.
No open flames will be allowed at the event.
This is a non-smoking property, No smoking will be allowed indoors.
Vendors will have their area ready for operation by 4:00pm on Thursday November 20, 2014.
Vendors will remain open for the entire duration of the Festival.

Severability of Provisions: If any provision hereof is declared or adjudicate by a court of competent jurisdiction to be illegal, invalid, or unenforceable, it shall be deemed deleted here from without impairing the legality, validity, or enforceability of the remaining provisions hereof.
