Wildlife (Game) Amendment Regulations 2012

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Wildlife (Game) Regulations 2012 to make minor miscellaneous amendments.

2Authorising provisions

These Regulations are made under sections22A and 87 of the Wildlife Act 1975.

3Principal Regulations

In these Regulations, the Wildlife (Game) Regulations 2012[1] are called the Principal Regulations.

4Definition of secured

r. 4

In regulation 5 of the Principal Regulations, in the definition of secured—

(a)in paragraph (a), after "container locked in the boot or" insert "stowed in a";

(b)in paragraph (b), after "in a part of the vehicle" insert "that is".

5Condition of certain game licences

In regulation 22(1)(a) of the Principal Regulations, for "that allows the" substitute
"that allows".

6Power of Secretary to cancel registration of a hound

In regulation 25(1)(e) of the Principal Regulations, for "conditions"substitute "condition".

7Power of Secretary to suspend registration of a hound

In regulation 26(1)(e) of the Principal Regulations, for "conditions"substitute "condition".

8Approved methods for hunting Hog Deer, Chital Deer or FallowDeer

In regulation 35(c) of the Principal Regulations, for "22 kilograms"substitute"20kilograms".

9Possession of spotlight and firearm

In regulation 36(1), (2) and (3) of the Principal Regulations, for "30 minutes before sunset until 30 minutes after sunrise"substitute "30minutes after sunset until 30minutes before sunrise".

10Prohibited deer hunting areas

r. 10

(1)In regulation 71(1) of the Principal Regulations, for "indicated by" substitute "shown by".

(2)At the foot of regulation 71(1) of the Principal Regulations insert—

"Penalty:20 penalty units.".

11Areas for hunting Sambar Deer with the use of hounds

(1)In regulation 72(1)of the Principal Regulationsomit "other than within the permitted hunting area".

(2)For regulation 72(2) of the Principal Regulations substitute—

"(2) Subregulation (1) does not apply to a person who hunts or takes Sambar Deer with the use of hounds or destroys Sambar Deer—

(a)within the permitted hunting area; or

(b)other than within the permitted hunting area, if the person has written authorisation given by the Secretary to do so; or

(i) is an owner or occupier of private land when doing so on that private land; or

(ii) has permission given by the owner or occupier of private land, when doing so on that private land.".
