Dear Mr. Buhayar:

As part of the evaluation of the California Charter School Association Assessment program/project (the “Project”), to further legitimate educational interest, certain information such as school and class level data (i.e. data which is not personally identifiable student information or otherwise subject to regulation under FERPA) are necessary to inform and assess the Project. As such, we grant permission for Northwest Evaluation Association (“NWEA”) to allow the California Charter Schools Association (the “CCSA”) access to aggregate de-identified school level and class level information resulting from assessments administered [provide timeframe].

We permit the CCSA to use this information solely for the Project. Additionally, we permit the CCSA to use the information only if the Project is conducted in a manner that limits sharing of personal identification of parents and students to those individuals within the CCSA that need to know it to complete the Project. Our permission also requires that the CCSA take steps to maintain the confidentiality of all personally identifiable information at all stages of the study by using appropriate disclosure avoidance techniques. This permission shall expire either when the information is no longer needed for the purposes of the Project or two years from the delivery date of the information by NWEA, whichever earlier.

We understand that our school retains the right to all data resulting from these assessments and that this request does not in any way waive our rights to the data. By signing below, I acknowledge that I have the necessary authority to give this permission and that our school will record this redisclosure and include in our annual notification to parents, as required by law.

Additionally, I affirm that our school is a charter school in California.

As a Project participant, [Charter School] is eligible for the discount negotiated by CCSA. However, during the first year of participation, [Charter School] will not receive a refund equal to the discount per student, but will be eligible for a credit towards its discounted payment during Year 2.

AMENDMENT TO MASTER SUBSCRIPTION AGREEMENT

This Amendment to the Master Subscription Agreement is entered into by and between Northwest Evaluation Association, an Oregon nonprofit corporation (“NWEA”), and the school or school district or other similar entity on the signature page (“Subscriber”), and is based on the following facts and circumstances:

RECITALS

WHEREAS, NWEA and Subscriber have previously entered into Master Subscription Agreement.

WHEREAS, Subscriber will be participating in the California Charter School Association Accountability Project (“Project”).

WHEREAS, based on its participation in Project, Subscriber is eligible for a discount to license Measures of Academic Progress® (MAP®) assessments in Math, Reading, and Language Arts and MAP for Primary Grades (MPG) assessments, and training and professional developmentunder a Marketing and Services Agreement between the California Charter School Association (“CCSA) and NWEA.

WHEREAS, Subscriber must agree to NWEA’s re-disclosure of school and class level data (i.e. data which is not personally identifiable student information) to CCSA as a condition of participating in the Project and receiving the discount.

AGREEMENT

NOW THEREFORE, NWEA and Subscriber hereby agree to an amendment of the Master Subscription Agreement as follows. Section 9. Research is hereby deleted in its entirety and replaced with the following:

9. Research. Subscriber authorizes NWEA to use the Student Information for research purposes, including but not limited to, norming studies, longitudinal, or alignment studies, provided that the data are handled in a manner that protects student anonymity. In addition, NWEA is authorized to use the Student Information in the GRD maintained by NWEA, which houses Subscriber’s test data for each student in a secure database for legitimate educational research purposes. Further, Subscriber hereby authorizes NWEA to redisclose data aggregated at the class and school level (i.e. data that is not PII) to California Charter School Association, of which the subscriber is a charter school in California.

Except as expressly noted in this amendment the Master Subscription Agreement remains unmodified and in full force and effect.
