Note: The member contribution amount is based on the cost of a yearly adult bus fare in Canberra.

EXPLANATORY STATEMENT
Defence Determination 2015/18
This Determination amends Defence Determination 2005/15, Conditions of service (the Principal Determination), made under section 58B of the Defence Act 1903 (the Defence Act) and in accordance with subsection 33(3) of the Acts Interpretation Act 1901 (AIA Act). Determinations made under section 58B of the Defence Act are disallowable non-legislative instruments and are subject to the interpretation principles in the AIA Act, as modified by section 58B of the Defence Act.
This Determination amends Chapter 15 of the Principal Determination which sets out provisions dealing with living and working on long-term posting overseas for members of the Australian Defence Force (ADF).
This Determination has the following two purposes.
- To make an adjustment to the amount a member must contribute towards overseas public transport costs.
- To make an adjustment to the amount a member must contribute towards their child's school transport costs.
Clause 1 of this Determination sets out the manner in which this Determination may be cited.
Clause 2 of this Determination provides that the Determination commences upon the date of signature.
Clause 3 specifies that the amendment is made to the Principal Determination, as amended.
Clause4 substitutes subclause 15.3.7.2 of the Principal Determination. The changes aim to clarify the policy by including definitions and by simplifying the calculation table. This clause also adjusts the current contribution amount and includes historic member contribution amounts for context and ease of administration.
Clause 5 inserts subclause 15.6.12.1 into the Principal Determination, which provides definitions for terms used in the clause.
Clause 6 substitutes subclause 15.6.12.4 of the Principal Determination. The changes aim to clarify the policy by including definitions and by simplifying the calculation table. This clause also adjusts the current contribution amount and includes historic member contribution amounts for context and ease of administration.
Clauses 7 and 8are transitional provisions which provide that the rates used to calculate overseas public transport and school transport costs between 1 March 2015 and commencement of this Determination are those used in the previous administrative year. This is to ensure that members are not disadvantaged if claiming during this period.
Criteria are provided for the exercise of discretions under the Principal Determination, as amended by this Determination. Adverse decisions are subject to merits review under the ADF redress of grievance system, including an appeal to the Defence Force Ombudsman.

This Determination is compatible with the human rights and freedoms recognised or declared in the international instruments listed in section 3 of the Human Rights (Parliamentary Scrutiny) Act 2011.
Overview of the Determination
This Determination has the following two purposes.
- To make an adjustment to the amount a member must contribute towards overseas public transport costs.
- To make an adjustment to the amount a member must contribute towards their child's school transport costs.
Human rights implications
The protection of a person's right to remuneration engages Article 7 of the International Covenant on Economic, Social and Cultural Rights. Article 7 guarantees just and favourable conditions of work, including remuneration, safe and healthy conditions, equal opportunity and reasonable limitations.
Legitimate objective: This Determination adjusts member contribution rates towards public transport costs and school transport costs, for members posted overseas.
Reasonable, necessary and proportionate: A philosophy underpinning many aspects of ADF member overseas conditions is that the Commonwealth will provide a subsidy, so that members who are posted to locations that are more expensive to live in than Australia are not disadvantaged by those expensive local conditions. Transport cost benefits are examples of this philosophy.
Members in Australia are not ordinarily reimbursed their costs of getting to work, nor the costs of their children getting to school. It is a long-standing industrial principle that these are private expenses. The public transport and school transport benefits do pay for these expenses, but the member is required to make a contribution. In the case of the public transport costs,the contribution is based on the Australian public transport cost (with Canberra's costs chosen as a benchmark, as there is some fluctuation between States). In the case of the school transport costs, a move to a contribution based on the cost of Canberra student public transport is being phased in.
The requirements on members to contribute towards these benefits ensure that they do not receive a 'windfall gain' by being posted to an expensive overseas location, but have approximate parity with their working conditions in Australia.
This Determination is compatible with human rights because it advances the protection of human rights.
