MayorBruce Brown called the regular meeting of the City Council to order. Present were Councilmen Milford Ashworth, Chris Hazlett, Tom Litherland and Steve Zoellner, City Clerk Debra Blevins,withAttorney Lee Phillips being absent.

Minutes for the February 15, 2017were approved as written.

CITY ADMINISTRATORREPORT:

City Administrator, Ray DuBois stated, Marketing and Events Director, Steve Kitzman gave an update on the Ice Festival: It was a good event. The temperature did not cooperate, we set record highs. Great media coverage for the event. One of the carvers was new this year and has participated in Breckenridge. For the two weekends, there were around 77,000. Kitzman introduced Adam Biddle the new Marketing and Events assistant.5th Annual Teller County Economic Forecast (mini conference): a) Presentation given by Steve Kitzman on February 22, 2017 in Woodland Park b) Steve will review the presentation at City Council meeting on March 15, 2017; Water/Sewer New Rate Structure: a)notices being sent out with water bills on March 1st with a letter b) new rates take effect on April 1, 2017.

APPROVAL OF STAR BUILDING USE AGREEMENT BETWEEN THE CITY OF CRIPPLE CREEK AND GOLD CAMP THEATER FOUNDATION:

Finance Director, Paul Harris, stated the agreement is for 5 years. There was no public comment. Motion by Zoellner, seconded by Litherland, to approve the Use Agreement between the City of Cripple Creek and Gold Camp Theater Foundation, and motion carried.

APPROVAL OF BUTTE THEATER LEASE BETWEEN THE CITY OF CRIPPLE CREEK AND GOLD CAMP THEATER FOUNDATION:

Finance Director, Paul Harris, stated the lease is for 5 years. There was no public comment. Motion by Hazlett, seconded by Ashworth, to approve the Butte Theater lease between the City of Cripple Creek and Gold Camp Theater Foundation, and motion carried.

APPROVAL OF VICTORIAN LANDY LEASE BETWEEN THE CITY OF CRIPPLE CREEK AND GOLD CAMP THEATER FOUNDATION:

Finance Director, Paul Harris, stated this lease is for 5 years. Harris also informed the council number 18 states the Gold Camp Victorian Society, has the use of the front parlor room exclusive for their use only. There was no public comment. Motion by Mayor Brown, seconded by Zoellner, to approve the lease between the City of Cripple Creek and Gold Camp Theater Foundation, and motion carried.

RECONSIDERATION OF ITEM TABLED DECEMBER 21, 2016 – REQUEST TO ALTER CRIPPLE CREEK CITY CODE CHAPTER 6, ARTICLE 8, INCLUDING SECTION 40 AND SECTION 80 IN RELATIONSHIP TO RECREATIONAL MARIJUANA, A POSSIBLE CANNABIS CLUB MODEL FOR THE CITY:

Administrator, Ray DuBois read Chapter 6, Article 8; CHAPTER 6 – BUSINESS LICENSES AND REGULATIONS; ARTICLE 8 – MEDICAL AND RECREATIONAL MARIJUANA; SEC. 6-8-40- PROHIBITED ACTIVITIES, (a) IT IS UNLAWFUL FOR ANY PERSON TO OPERATE, CAUSE TO BE OPERATED OR PERMIT TO BE OPERATED IN THE CITY A MEDICAL MARIJUANA CENTER, OPTIONAL PREMISES CULTIVATION OPERATION OR FACILITY FOR WHICH A MEDICAL MARIJUANA-INFUSED PRODUCTS MANUFACTURERS’ LICENSE COULD OTHERWISE BE OBTAINED, AND ALL SUCH USES ARE HEREBY PROHIBITED AT ANY LOCATION IN THE CITY. (b) IT IS UNLAWFUL FOR ANY PERSON TO OPERATE, CAUSE TO BE OPERATED OR PERMIT TO BE OPERATED IN THE CITY A MARIJUANA ESTABLISHMENT, AND MARIJUANA ESTABLISHMENTS ARE HEREBY PROHIBITED AT ANY LOCATION IN THE CITY. SEC. 6-8-80- PENALTY VIOLATIONS OF THIS ARTICLE SHALL BE PUNISHABLE AS SET FORTH IN CHAPTER 1, ARTICLE 4 OF THIS CODE. There was public comment from: Kari Wilson, Laureen Murray, Betty Clark-Wine, Edith Smith and Gary Wine, against the approval of marijuana sales in Cripple Creek, with Dr. John Jones speaking in favor of marijuana sales in Cripple Creek. Each Council member spoke with their opinions of marijuana sales in Cripple Creek. Motion by Zoellner, seconded by Ashworth, request to alter Cripple Creek City Code Chapter 6, Article 8 including Section 40 and Section 80 in relationship to recreational marijuana, a possible cannabis club model for the City be denied, motion carried, with Hazlett voting No.
