Job Title

Your position will be Internal Sales Executive based at our Gravesend office. You will be responsible to the Managing Director Distribution. In addition to your duties as internal salesexecutive you may be required to undertake other duties, which the company considers reasonablynecessary to meet the needs of the business. Your duties may require you to work at other places operated by the company or the company’s clients other than the premises you initially work at.

Remuneration

Your basic salary will be £38,000.00, paid monthly by BACS into the bank account of your choice in the UK.We will review your salary after 12 months service.

For Year 1 we will guarantee earnings of £44,000.00 which will be made up the £38,000.00 Basic and Further Special top up payments each of £2000.00 in May, September & December . For year 2 we again guarantee earnings of a minimum of £44,000.00 but will instigate a bonus scheme that will give you the opportunity to earn ote of£46,000.00

For year 3 the basic salary will be £44,000.00 with the potential to increase by 20% on ote as bonus

Payment is made monthly by BACS credit transfer on the 24th of each month. If the 24th falls on a weekend the payment will be made on the nearest working weekday of the month.

Service Contract

For the first 12 months we will offer a fixed service contract for this period, reverting to a rolling contract as set down in our standard terms and conditions thereafter.

Hours

Normal hours –Are 8.30 to 5.30 Monday to Friday .You will also be expected to work 1 in 5 Saturday mornings from 8.30 to 12.00PM.

Payment for additional hours

Your salary takes into account all reasonable hours.

Holidays and Payment

The full annual entitlement exclusive of public holidays is 23 days rising by one day for every full year worked to a maximum of 28 days exclusive of public holidays. The company holiday year runs from 1st January to the 31st of December. During the first year of employment, you are entitled to receive paid holiday on a pro rata basis per month.

Sick pay and absence

There is no payment for sickness other than your entitlement to statutory sickness payments. The Board at their absolute discretion can make additional payments during sickness but any such payments given will not establish any custom and practice to future payments.

Pensions/Healthcare

After initial 3 month period we will be able to join our contributory pensionhealthcare scheme.

Vehicle

Sprint will provide access to a company van that will be available for private use.

Notice of termination

After the initial fixed 12 month period the required written notice which will be given to you is 1 month.

Restrictive clauses

You shall not during your employment with the employer without the prior written consent of the Board be directly or indirectly concerned as a advisor, agent, employee,consultant,sole owner,partner,shareholderor director where this may interfere, conflict or complete with the interests of your employer or any associated company and/or the efficient performance of your duties.

Any breach of the clause above could be regarded as gross misconduct and could result in dismissal and legal proceedings and instituted

Confidentiality of information restrictions

You should use your best endeavours to promote the best interests of the company and protect confidential information.

You shall not, other than in the proper course of your employment, use, publish or otherwise disclose to any person any confidential information relating to the company’s

affairs,finances,business of any of their customers, prospective customer or any person to whom an obligation of confidentiality is owed, and which,for the avoidance of doubt, shall include,without limitation:

  1. Lists or details of the company’s customers or suppliers;
  1. details of relationships or arrangements with or knowledge of the needs or requirements of the prospective customers or suppliers;
  1. information about a customer or prospective customer to which the company owes an obligation of confidentiality;
  1. information of a confidential nature relating to fellow employees and/or directors of the employer; and,
  1. information including software programmes of the company’s business methods,contracts,economics,marketing data,development plans or strategies.

This list is not exhaustive.

Any breach of the clauses above could be regarded as gross misconduct and could results in dismissal.

However, this clause above shall not apply to information which might come into the public domain other than in consequence of your or any other person’s default.

Post employment Restrictive Covenants

You agree with and make a commitment to the company that you will not directly or indirectly following the working of notice period-

For a 3 month period:

  1. entice away or entice away from this company the custom of any customer or prospective customer
  1. solicit or attempt to solicit the customer or any prospective customer in competition with the company;
  1. solicit or entice away from the company any key person;
  1. offer employment to or employ or enter into partnership or association with or offer to do so or retain the services or offer to do so whether as agent,consultant or otherwise of any key person;
  1. supply your services to any customer or any prospective customer in direct competition with the company;
  1. Be employed or otherwise engage by any customer or any prospective customer in a capacity which competes with or which may compete with the services provided by the company; or
  1. Be employed or otherwise engage by a competitor based within a 50mile radius of the company.

At all times:

  1. All confidential items listed under confidential information restrictions in clauses 1 to 7 above.

Definitions

Each of the sub-clause restrictions set out in the above clauses shall be considered separate from other sub-clauses. Each sub-clause may contain more than one restriction.

While restrictions set out clauses above and the definitions of”customer“,“key”,”prospective customer” and “services and products“as set out below are considered by you to be reasonable in all the circumstances it is agreed that if any one or more of such restrictions or definitions shall either taken by itself or themselves together be adjudged to go beyond what is reasonable in all the circumstances for the protection of the legitimate interests of your Employer but would be adjudged reasonable if any particular restriction or definition were deleted then the parties further agree that the said restrictions and definitions shall apply with such deletions.

Customer- An organisation or person for whom you were aware that the company provided any part of a contract for services, advice or products within a twelve month period,in the case of clauses above in the 12 months leading up to your termination.

Key Person-A person with whom you dealt with who held a position of responsibility with the company, in the case of clauses above in the 12 months leading up to your termination.

Prospective customer-An organisation or person for whom you were aware that the company had been in discussion to provide any part of a contract for services, advice or product within a 12 month period.

Services- Any form of services, advice or product of which you were aware were in the course of business by your employer.

Giving of notice date- Any date when written notice is given by you or the company.

Grievances

If you have a grievance on any employment matter other than a disciplinary decision, please contact your line manager. If the matter is not resolved satisfactorily you are at liberty to raise the issue directly with the company MD.
