A.03-016Ken and Cynthia Morin
Application to construct residential dwelling and driveway

Attorney Dave Royston is present and discusses the response that he submitted to the Commission regarding off-site and on-site wetlands enhancement. Mr. Royston states that the applicants have agreed to all suggestions made by the Commission.
Paul Smith addresses the Commission and the public and states that the Morin’s property is a difficult site to develop and that he is genuinely impressed with the willingness of the Morins to protect and enhance the wetlands. Mr. Smith also states that he realizes the economic impact of the project and he feels that the Morins have gone above and beyond other applicants.
Frank Reichart refers to the part in the letter from Mr. Royston that states that the fish ladder will be complete in 30 days upon commencement of construction. Mr. Reichart asks if this will be enough time? Mr. Royston states that the fish ladder will probably not even begin until next summer but he is confident that it can be constructed within a 30 day period.
Bill Pollock states that he would reluctantly vote in favor of the application.
Judy Preston states that she would not be in favor of the application.
MOTION that application #03-016 be approved with close monitoring from Inland Wetlands Enforcement Officer, Chris Costa, and by Engineer, Mike Ott.

B.03-020Modern Home Construction
Construct single family dwelling.
21 Cricket Court (Map 16, Lot No. 22-21)

Attorney Dave Royston is present to represent the applicant. Mr. Royston shows the Commission the original site plan from 1972 when the subdivision was originally approved.
Stuart Fairbanks, P.E. is present to discuss the new plan. Mr. Fairbanks states that the proposed house is approximately 12 feet away from the wetlands and that the edge of the pond touches the property but is approximately 65 feet away from the house. Mr. Fairbanks continues and says that the grading slopes to the back of the property, clearing for construction would be up to the silt line and that the drainage easement drains to the road.
Paul Smith states that there is activity within the regulated area but that not all activity takes place within the wetlands and that the size of the residence is not unreasonable.
Attorney Royston discusses “grandfathered” site plans and wetlands statutes with the Commission. Attorney Royston also states that the applicants/owners are aware of the conservation restriction and are consentive.
Judy Preston asks if porous pavement could be considered for the driveway because she is concerned about what may seep into the ground from the cars. Mr. Fairbanks states that as a general rule, drippings from cars are better contained in a garage with a concrete floor because the concrete will contain them better as they evaporate. Ms. Preston continues and states that she would like to see the buffer zone maintained.
MOTION to approve #03-020 with the following stipulations: 1)staff must see the revised plan containing a proposed drainage swale off the driveway to divert water away from the wetlands and to the road and 2)there must be a maintained 10 foot buffer zone around the pond

Paul Smith discusses the application with the applicant George Bessoni. Mr. Smith states that the Commission has already evaluated and made the decision regarding the fire hydrant 2 times. Mr. Smith also states that he would like Mr. Bessoni to return with plans that reflect exactly what has been done on the property. Mr. Bessoni states that he would like to place the fire hydrant within the 100’ setback area and he feels that the pump would work there. Mr. Smith reminds Mr. Bessoni of the Fire Marshalls previous concerns regarding snow plows in the winter. Mr. Smith also states to Mr. Bessoni that he would like a Registered Surveyor to come before the Commission and state that “as constructed” locations and underground utilities are correct. Mr. Bessoni states that his surveyor will not give him the as built yet. Frank Jones tells Mr. Bessoni to get the as built without the fire hydrant on it.
Mr. Smith and Mr. McIntyre both state that they would like to see where the hydrant is on the existing permit and where it actually is today.
