Mayor Richard Travis called the meeting to order at 7:00 p.m. Roll Call-Present: Council members Breitsprecher, Diehl, Gallentine, Vegors. Absent: Benson. Also present: Randy Danielson, Nick Dunbar, Dean Gordon, Craig Johnson, and Pam Nees.

AGENDA: Council member Vegors moved to approve the agenda as printed. Second by Diehl. Ayes: Breitsprecher, Diehl, Gallentine, Vegors. Nays: none. Motion carried.

MINUTES: Council member Vegors moved to approve the September 14 minutes as printed. Second by Gallentine. Ayes: Breitsprecher, Diehl, Gallentine, Vegors. Nays: none. Motion carried.

BILLS: Council member Breitsprecher moved to approve the bills as presented. Second by Vegors. Ayes: Breitsprecher, Diehl, Gallentine, Vegors. Nays: none. Motion carried.

PRISONER LABOR: North Central Correctional Facility representative Pam Nees discussed their offender labor program with the Council. A City employee or private citizen can transport them from Rockwell City to Dayton. Prisoners can’t do anything that requires a driver’s license and can’t flag traffic. All supervisors must be trained. The City must execute a 28E agreement to participate, but is under no obligation to use the inmates after approval of the agreement. Council member Breitsprecher introduced Resolution 2011-22, “Resolution to Approve 28E Agreement with the Iowa Department of Corrections”, and moved its adoption. Second by Gallentine. Roll call vote. Ayes: Breitsprecher, Diehl, Gallentine, Vegors. Nays: none. Resolution adopted.

HOUSING REHABILITATION LOAN FORGIVENESS: The Council agreed to table this until more information is received from the homeowner.

CITY CODE UPDATE: The Council was informed that MIDAS had begun City Code update work.

DOT SIGN GRANT APPLICATION: Council member Vegors introduced Resolution 2011-23, “A Resolution Directing the Mayor to Participate in the Iowa Department of Transportation’s Small Town Replacement and Apply to Receive Traffic Control Signing Materials from the Iowa Department of Transportation”, and moved its adoption. Second by Breitsprecher. Roll call vote. Ayes: Breitsprecher, Diehl, Gallentine, Vegors. Nays: none. Resolution adopted.

2010-2011 FISCAL YEAR AUDIT: The Council was informed that Schnurr and Company had completed the audit field work and planned to have a draft report available by October 26 to October 31.

LIFT STATION PUMPS: After review of two proposals, Council member Gallentine moved to accept the proposal from Mississippi Valley Pump, Inc. to provide and install new pump impellers at a cost of $5,479, which includes standard freight. Second by Breitsprecher. Ayes: Breitsprecher, Diehl, Gallentine, Vegors. Nays: none. Motion carried.

LIBRARY LIGHTING: Council member Vegors moved to approve the Dayton Library’s proposed fluorescent lighting update project. The cost to the City is approximately $898. Second by Gallentine. Ayes: Breitsprecher, Diehl, Gallentine, Vegors. Nays: none. Motion carried.

WELL PIPE BIDS: The Mayor opened the one bid received for the advertised old well pipe. Council member Breitsprecher moved to accept the bid of $10 per pipe section for up to 15 sections from Randy Danielson. Second by Vegors. Ayes: Breitsprecher, Diehl, Gallentine, Vegors. Nays: none. Motion carried.

8th STREET SW: Following review of MER Engineering’s recommendations on how to open and surface part of 8th Street SW located north of 1st Avenue SW, the Council directed the Clerk to contact the adjacent property buyer and inform him of those recommendations.

DERELICT BUILDING GRANT APPLICATION: The Council agreed to apply for grant funds from this program for light plant building asbestos removal and roof coating.

MAINTENANCE POSITION: Mayor Travis reported that applicant interviews would be held during the week of October 17th.

HOUSING REHABILITATION GRANT APPLICATION: Council member Gallentine moved to hold a public hearing regarding the grant application at the November 9 regular meeting. Second by Vegors. Ayes: Breitsprecher, Diehl, Gallentine, Vegors. Nays: none. Motion carried.

BUILDING PERMITS: Council member Gallentine moved to approve a permit for a house addition for Becky Comp. Second by Diehl. Ayes: Breitsprecher, Diehl, Gallentine, Vegors. Nays: none. Motion carried. Council member Gallentine moved to approve a permit for a fence for Tyler and Laura Sandstrom. Second by Diehl. Ayes: Breitsprecher, Diehl, Gallentine, Vegors. Nays: none. Motion carried. No application had been received from Lawrence McCoy.

RESERVE POLICE POSITION: Police Chief Nick Dunbar reported that Reserve Officer Robbie Pepper had recently resigned. He recommended two applicants for reserve police officer positions. After discussion, Council member Breitsprecher moved to offer a reserve police officer position to Jason Reynolds at $8.50 per hour, not to exceed 32 hours per 2 week pay period until Nick Dunbar begins attendance at the Iowa Law Enforcement Academy. Second by Vegors. Ayes: Breitsprecher, Diehl, Gallentine, Vegors. Nays: none. Motion carried. At 7:48 p.m., Mayor Travis called for a 5 minute recess. The meeting was continued at 7:53 p.m. Council member Diehl then moved to offer a reserve police officer position to Nicole Spencer at $7.50 per hour, not to exceed 16 hours per 2 week pay period until Nick Dunbar begins attendance at the Iowa Law Enforcement Academy. Second by Breitsprecher. Ayes: Breitsprecher, Diehl, Gallentine. Nays: Vegors. Motion carried.

MOWING ASSESSMENT: At 7:55 p.m., Mayor Travis opened the public hearing regarding assessment of City mowing charges. No comments were voiced and none had been received. Following closure of the hearing at 7:57 p.m., Council member Diehl introduced Resolution 2011-24, “Resolution Directing the Special Assessment of the Costs of Mowing Against a Property”, and moved its adoption. Second by Gallentine. Roll call vote. Ayes: Breitsprecher, Diehl, Gallentine, Vegors. Nays: none. Resolution adopted.

WINE PERMIT RENEWAL: Council member Diehl moved to approve renewal of the Native Wine Permit for Bella on Main. Second by Gallentine. Ayes: Breitsprecher, Diehl, Gallentine, Vegors. Nays: none. Motion carried.

LIGHT BOARD APPOINTMENT: Council member Diehl moved to re-appoint Harold Rentschler to a six-year term on the Dayton Light and Power Board of Trustees. Second by Vegors. Ayes: Breitsprecher, Diehl, Gallentine, Vegors. Nays: none. Motion carried.

SHOP OVERHEAD DOOR: Council member Gallentine moved to keep the current shop overhead door and to add weather stripping to it as needed. Second by Vegors. Ayes: Breitsprecher, Diehl, Gallentine, Vegors. Nays: none. Motion carried.

HEALTH INSURANCE: The Council tabled action on the 2012 employee health insurance until their November 9 meeting.

COMMENTS FROM THE FLOOR: Dean Gordon and Mayor Travis discussed street sweeper operation and sanitary sewer installation at 505 1st Avenue SW.

OTHER BUSINESS: The Clerk informed the Council of additional DOT funding for the Lake Ole Bridge project. Police Chief Dunbar reported on an upcoming search and rescue exercise at Grandview Health Care Center. The Council reviewed a list of trees needing to be trimmed and requested an estimate for trimming one tree.

Following discussion of 4th Avenue SE drainage concerns, Council member Diehl moved to hire Dayton Farm Drainage to grade an adjoining field to reduce the water flowing down 4th Avenue SE for a cost of $500 to $600. Second by Gallentine. Ayes: Breitsprecher, Diehl, Gallentine, Vegors. Nays: none. Motion carried. Craig Johnson reported on the recent use of a wrecker at the golf course.
