RACE 2 – UBET PACE – 2079 METRES

YANKEE AVENUE galloped out at the start, will continue to be placed right out of the draw for stand starts. Then galloped excessively and lost considerable ground, tailed the field.

RACE 5 – DOWLING MCCARTHY TYRES PACE – 2079 METRES

ANOTHER CEEBEE galloped out at the start, will be placed on its last chance in the standing start draw.

GENERAL

An inquiry was held via telephone on the 29th December 2015 into the reasons for NANCES THRILL and ANOTHER CEEBEE racing in the wrong saddlecloth numbers in Race 5 – Dowling McCarthy Tyres Pace on Saturday 26th December 2015. After hearing evidence from race day chairman of stewards Jamie Clemmons, trainer/driver Peter Jakowenko and driver James Jakowenko, it was established that both runners had raced in the wrong saddlecloth numbers which also led them to starting from the wrong barrier positions. Trainer Peter Jakowenko pleaded guilty to two charges under AHRR 239A which states “A person whose conduct or negligence has led or could lead to a breach of the rules is guilty of an offence”. After taking into consideration Mr Jakowenko’s lengthy time in the industry, his forthright evidence andguilty plea, Mr Jakowenko was fined the sum of $500 on each charge with $250 of each charge being suspended for twelve months on the condition there are no negligence offences in that time. As part of the inquiry betting records of the race were examined. As NANCES THRILL and ANOTHER CEEBEE started from the wrong barrier position stewards ordered that both horses be disqualified pursuant to AHRR 64. The judge’s placings were amended as a result.
