The meeting was attended by five (out of eight) members of the Tender Commission. A quorum is present.
6. Theprocedure for opening envelopes with open tender applications was held onJune 5, 2013 at 10:00 am (Moscow time) at:bld. 1, Yakovoapostolskiy Lane, 12, Moscow, 105064.
7. Before the last date for filing open tender applications as specified in the notice of the open tender, on June 5, 2013 at 10:00 am (Moscow time) 3 (three) sealed envelopes with open tender applications were receive, as recorded in the Logbook of open tender applications (see Appendix No. 1 to the Minutes No. 01v/16-1 on opening envelopes with open tender applications dated June 5, 2013).
8. Just before the opening of envelopes with open tender applications, no amendments were made to applications and no requests were received to withdraw open tender applications or other applications.
9. Envelopes with the open tender applications, filed in hard copy, were opened by S.A. Bondarenko, Secretary of the Tender Commission, as recorded in the Logbook of open tender applications (see Appendix No. 1 to the Minutes No. 01v/16-1 on opening envelopes with open tender applications dated June 5, 2013).
10. With regard to the filed open tender application, the following information was disclosed by the Chairman of the Tender Commission:

Quality of works and qualification of the tenderer:
Quality of works / 1. Goals and objectives of R&D work
The work is aimed at development of the draft Technical Regulation “On Safety of Bottled Drinking Water” (hereinafter – the Technical Regulation), as well as documents of the Customs Union required for implementation of the Technical Regulation.
The following objectives shall be achieved during development of the Technical Regulation:
1) identification of objects of technical regulation covered by the proposed Technical Regulation;
2) development of safety requirements for bottled drinking water and processes of production (manufacturing), storage, transportation, sale and disposal, related to safety requirements for bottled drinking water;
3) development of the terminology for unambiguous and consistent understanding of the text of the Technical Regulation;
4) development of requirements for packaging, marking, labeling and the appropriate rules (if necessary);
5) development of the rules for identification, the procedure for assessment of compliance of bottled drinking water with the Technical Regulation;
6) development of proposals on introduction of the Technical Regulation and transitional provisions;
7) development of the draft list of standards ensuring compliance with the Technical Regulation on a voluntary basis;
8) development of the draft list of standards containing research (test) and measurement rules and methods, including sampling rules, required for application and implementation of the Technical Regulation and assessment (confirmation) of compliance of the products;
9) development of the draft list of products for which, along with the customs declaration, it is required to submit the document on assessment (confirmation) of compliance with the Technical Regulation;
10) development of the draft program for development (amendment, revision) of interstate standards ensuring compliance with the Technical Regulation on a voluntary basis, as well as interstate standards containing research (test) and measurement rules and methods, including sampling rules, required for application and implementation of the Technical Regulation and assessment (confirmation) of compliance of the products.
For the purpose of these objectives, the analysis of existing legal and regulatory documents applicable in the area of technical regulation and the analysis of international experience in technical regulation shall be carried out.
2. Initial data for R&D work
The following are the initial data used for development of the draft Technical Regulation:
laws on safety of bottled drinking water in developed countries;
European Directives containing, among others, the requirements for bottled drinking water and health protection in the European Union;
1) legislation of the Republic of Belarus, the Republic of Kazakhstan and the Russian Federation in the area of safety of bottled drinking water;
2) international, regional, national standards, foreign regulations, scientific publications on safety of bottled drinking water;
3) rules and standards of state control (supervision) in the area of safety of bottled drinking water, modes and procedures for assessment of conformity in the Republic of Belarus, the Republic of Kazakhstan and the Russian Federation;
4) Agreement on the Principles of Harmonization of Technical Regulations of the Member States of the EurAsEC dated March 24, 2005;
5) Agreement on Coordinated Policy in the Area of Technical Regulation, Sanitary and Phytosanitary Measures dated January 25, 2008;
6) Agreement on Common Principles and Rules of Technical Regulation in the Republic of Belarus, the Republic of Kazakhstan and the Russian Federation dated November 18, 2010;
7) Provision on the Procedure for Development, Adoption, Amendment and Cancellation of the Technical Regulation of the Customs Union, as approved by Resolution No. 48 of the Board of the Eurasian Economic Commission dated June 20, 2012;
8) Guidelines on the Standard Structure of the Technical Regulation of the Eurasian Economic Community, as approved by Resolution No. 321 of the Interstate Council of the EurAsEC dated October 27, 2006;
9) Provision on the Procedure for Application of Standard Rules of Assessment (Confirmation) of Compliance with the Technical Regulations of the Customs Union, as approved by Resolution No. 621 of Commission of the Customs Union dated April 7, 2011;
10) Provision on the Procedure for Development and Approval of the Lists of International and Regional Standards or, if Unavailable, National (State) Standards of the Member States of the Customs Union, Ensuring Compliance with the Technical Regulation of the Customs Union and Required for Assessment (Confirmation) of Compliance, as approved by Resolution No. 306 of the Board of the Eurasian Economic Commission dated December 25, 2012.
3. Scope of R&D work
R&D work shall be performed in two stages and include the following researches and works according to the Provision on the Procedure for Development, Adoption, Amendment and Cancellation of the Technical Regulation of the Customs Union, as approved by Resolution No. 48 of the Board of the Eurasian Economic Commission dated June 20, 2012 (hereinafter – the Provision).
Stage 1
1. Analysis of laws of the Republic of Belarus, the Republic of Kazakhstan and the Russian Federation in the area of technical regulation, regulatory documents and scientific publications, international, regional (interstate), national and foreign standards, modes and procedures for assessment of conformity in the area of safety of bottled drinking water.
Particularly, requirements that differ from the provisions of international and regional standards or mandatory requirements applicable in the territories of the Member States of the Customs Union shall be analyzed. Based on the results,the reasons for possible application of such provisions shall begiven.
The international experience in technical regulation shall be analyzed for the purpose of the best compliance with the security requirements and theeffective technical regulation.
Countries the international experience of which is to be analyzed shall bespecified and agreed by the Contractor and the Customer during execution of the Agreement.
Required conclusions and proposals on development of the draft Technical Regulation shall be made on the basis of analysis of legal and regulatory documents and analysis of international experience in technical regulation.
2. Development of the first revision of the draft Technical Regulation and explanatory notes thereto.
The draft Technical Regulation shall contain the following:
a) General information on the Technical Regulation, its development, information on harmonization at the international and regional levels, relationship with other technical regulations of the Customs Union;
b) Field of application of the Technical Regulation with an indication of technical regulation objects covered (not covered) thereby. The comprehensive list of technical regulation objects (can be included in the appendix). The objects shall be identified with an indication of exceptions, if necessary;
c) Basic definitions and terms used in the Technical Regulation;
d) Rules for market circulation or placing in service;
e) Safety requirements for bottled drinking water and processes of production (manufacturing), storage, transportation, sale and disposal, related to safety requirements for bottled drinking water.
Main requirements for packaging, marking, labeling and the appropriate rules.
If necessary, specific requirements that reduce the risk of personal injury and environmental damage;
f) Identification rules, modes and procedures for conformity of compliance of bottled drinking water with the Technical Regulation;
g) Provisions on application of the common market circulation mark to the products and rules (conditions) of using thereof;
h) Appendices (if necessary).
3. Development of proposals on introduction of the Technical Regulation and transitional provisions.
4. Development of the list of international, regional and national (state) standards, requirements of other documents (rules, directives, guidelines, and other documents adopted by international organizations or, if unavailable, regional documents (regulations, directives, resolutions, rules, and other documents)), national technical regulations underlying the draft Technical Regulation.
5. Development of proposals on the lists of standards defined in paragraphs 2 and 3, Article 6 of the Agreement on Common Principles and Rules of Technical Regulation in the Republic of Belarus, the Republic of Kazakhstan and the Russian Federation dated November 18, 2010.
6. Improvement of the draft Technical Regulation and the set of documents thereto based on the results of its consideration by the competent authorities of the Parties and at the meeting of the Advisory Committee on Technical Regulation, Sanitary, Veterinary and Phytosanitary Measures of the Board of the Eurasian Economic Commission (hereinafter – the Advisory Committee).
Stage 2
1. Based on the results of public discussion, preparation of summarized reviews to the draft Technical Regulation (if necessary). Consideration of comments and proposals with indication, for each comment and proposal included in the summarized reviews, of information on adoption thereof or reasoned rejection.
2. Improvement of the draft Technical Regulation and the set of documents thereto based on comments and proposals received during public discussion and preparation for intrastate approval.
3. Technical editing of the draft Technical Regulation.
4. Metrological evaluation of the draft Technical Regulation and the set of documents thereto and preparation of the appropriate conclusion.
5. Development of the draft list of products for which, along with the customs declaration, it is required to submit the document on assessment (confirmation) of compliance with the Technical Regulation.
6. Development of the draft lists of standards defined in paragraphs 2 and 3, Article 6 of the Agreement, as prescribed by the Board of the Eurasian Economic Commission.
7. Improvement of the draft lists of standards and the explanatory note thereto based on the results of public discussion.
8. Development of the draft program for development (amendment, revision) of interstate standards ensuring compliance with the Technical Regulation on a voluntary basis, as well as interstate standards containing research (test) and measurement rules and methods, including sampling rules, required for application and implementation of the Technical Regulation and assessment (confirmation) of compliance of the products.
Periods of performance of individual work stages and their cost shall be clarified and agreed between the Contractor and the Customer during execution of the Agreement.
4. Results of R&D work
The following scientific and technical products shall be obtained at the first stage:
1. First revision of the draft Technical Regulation and explanatory notes thereto, prepared for public discussion.
2. Proposals on introduction of the Technical Regulation and transitional provisions.
3. List of international, regional and national (state) standards, requirements of other documents (rules, directives, guidelines, and other documents adopted by international organizations or, if unavailable, regional documents (regulations, directives, resolutions, rules, and other documents)), national technical regulations underlying the draft Technical Regulation.
4. Proposals on the lists of standards defined in paragraphs 2 and 3, Article 6 of the Agreement on Common Principles and Rules of Technical Regulation in the Republic of Belarus, the Republic of Kazakhstan and the Russian Federation dated November 18, 2010.
The following scientific and technical products shall be obtained at the second stage:
1. Summarized reviews to the draft Technical Regulation based on the results of public discussion.
2. Draft Technical Regulation and the set of documents thereto improved on the basis of comments and proposals received during public discussion and preparation for intrastate approval, including technical editing.
3. Conclusion based on the results of metrological evaluation of the draft Technical Regulation.
4. Draft list of products for which, along with the customs declaration, it is required to submit the document on assessment (confirmation) of compliance with the Technical Regulation.
5. Draft lists of standards defined in paragraphs 2 and 3, Article 6 of the Agreement, improved on the basis of the results of public discussion.
6. Draft program for development (amendment, revision) of interstate standards ensuring compliance with the Technical Regulation on a voluntary basis, as well as interstate standards containing research (test) and measurement rules and methods, including sampling rules, required for application and implementation of the Technical Regulation and assessment (confirmation) of compliance of the products.
Scientific analyses and reports shall be prepared in compliance with the requirements of interstate standard GOST 7.32-2001 “The Research Report. Structure and Rules of Presentation” brought into force by Regulation No. 367-st of the State Committee of the Russian Federation for Standardization, Metrology and Certification dated September 4, 2001.
All reports shall be submitted to the Customer on paper and electronic media in 2 copies. The report shall be accompanied with the R&D work stage acceptance certificate in 3 copies.
Qualification of the tenderer
a) Number of works performed by the bidder in the area of technical regulation relating to the proposed Technical Regulation / 22 (twenty two) works performed by the bidder in the area of technical regulation relating to the proposed Technical Regulation
b) Number of staff contractors having experience in development of technical regulations, as well as international, regional and national standards / 10 (ten) contractors involved in performance of works, having experience in development of technical regulations
c) Experience of participation in organizations developing international standards / No experience.
