In relation to your recent request for information received at this office on 25 June2013 regardingFabricated or Induced Illness Investigations. Please see our response below;
Dear Cumbria Partnership NHS Foundation Trust,
In October 2012 one of the Trusts 'Named Nurse Safeguarding and Child Protection' requested the re-opening of a Fabricated or Induced Illness investigation following a complaint received from one of the parents involved.
Please provide copies of all correspondence relating to the handling of this complaint and how it was linked to the re-opening of this investigation.
Section 40(2) of the FOIA provides an exemption from disclosing personalinformation about other people if disclosure would breach the DataProtection Act 1998. The purpose of the Data Protection Act is toprotect people's private information and to ensure that it is handledproperly. In line with the Information Commissioner's Guidance, personalinformation of any other person must only be released if: the disclosurewould not be unfair on the individual concerned; there is a legitimatepublic interest in disclosure and the disclosure is only to the extentnecessary to meet this public interest; and the interest in disclosureoutweighs any detriment to the individual's privacy or other rights andlegitimate interests. In this case, I have concluded that this information is personal information and would not constitute fair processing ofpersonal data as the disclosure of that information into the public domainwould be outside of their reasonable expectations.
