DECISION CLOSING PROCEEDING

Summary

On September 21, 2015, we issued Decision (D.) 15-09-015, which granted conditional authority to Linda and Tito Balling, operating a Limited Liability Corporation known as Traver Water, to sell and Del Oro Water Company, Inc. (Del Oro) to buy the Traver Water in Traver, California located in Tulare County. D.15-09-015 required Del Oro to acquire a permit from the State Water Resources Control Board, Division of Drinking Water to operate Traver Water and file a copy of the permit in this docket within 30 days of receipt of such authority. We kept this proceeding open in order to receive these permits.

On July 15, 2016, Del Oro filed the required permit as a compliance filing in this proceeding. Given Del Oro’s compliance with D.1509-015, we close Application 15-02-015.

1.  Waiver of Comment Period

This is an uncontested matter in which the decision grants the relief requested. Accordingly, pursuant to Pub. Util. Code § 311(g)(2) and
Rule 14.6(c)(2) of the Commission’s Rules of Practice and Procedure, the otherwise applicable 30-day period for public review and comment is waived.

2.  Assignment of Proceeding

Catherine J.K. Sandoval is the assigned Commissioner and Gerald F. Kelly is the assigned Administrative Law Judge in this proceeding.

Findings of Fact

  1. In Decision (D.) 15-09-015, the Commission granted conditional authority to Linda and Tito Balling, operating a Limited Liability Corporation known as Traver Water, to sell and Del Oro Water Company, Inc. (Del Oro) to buy the Traver Water in Traver, California, located in Tulare County.
  2. As a condition of the authority granted by D.15-09-015, we required DelOro to acquire a permit from State Water Resources Control Board, Division of Drinking Water to operate Traver Water and file a copy of the permit in this docket within 30 days of receipt of such authority.
  3. On July 15, 2016, Del Oro filed the required permits as a compliance filing in this proceeding, thereby complying with Ordering Paragraph 1 of D.15-09-015.

Conclusions of Law

  1. This proceeding should be closed.
  2. This Order should be effective immediately.

ORDER

Therefore, IT IS ORDERED that Application 15-02-015 is closed.

This order is effective today.
