EXISTING SOLAR PHOTOVOLTAIC SYSTEM AGREEMENT

This agreement forms part of the Residential Tenancy Agreement made between client name and Housing NSW for the occupation of the property at <property address. This property is currently fitted with a solar photovoltaic (PV) system that was installed by a previous tenant.

By signing this agreementyou are consentingto the following conditions in relation to the use and ongoing maintenance of this solar PV system while you reside at the above property:

  1. A kW capacity> kW solar PV system has been installed at <property addressthatconsists of <number of panels> panels located on thenorth/south/east/westroof area of the property. Thissolar PV system is available for you to use should you choose to do so.
  2. Ifyou choose to use the solar PV system at any time during your occupation of the property, you become responsible for any maintenance, upkeepor repair costs that may arise from the use of the system, if these costs are not covered under warranty.Housing NSW will not raise any work orders in relation to the maintenance, upkeep or repairs of the solar PV system.
  3. You are entitled to any electricity cost savings or revenue generated as a result of the use of the solar PV system. However you are responsible for undertakingyour own research intoanycost benefitsassociated with using the system and Housing NSWis not responsible for the level of costs incurred or savings generated.
  4. You are responsible for setting up the appropriate electricity billing system with your electricity provider if you choose to use the solar PV system.
  5. If you choose to use the system, it must be switched on safely by an accredited solar-trained electrician. Upon completion of your tenancy, you must also ensure the system is shut down safely prior to leaving the tenancy. In both of these circumstances, you must provide Housing NSW with an inspection certificate stating that your system is safe and has been switched on/off correctly. You should not touch any part of the system or switch the system on/off yourself. The Clean Energy Council website provides a list of accredited solar-trained electricians that can switch on/off or check your system.
  6. Copies of any manualsor certificates associated with the solar PV system will be provided to you for the duration of your tenancy, if available. You are required to keep these documents and any additional receipts/invoices, manuals, warranty certificates and safety certificatesrelated to the solar PV system that you receive through your use of the system. In addition, you are required to provide copies of any new documents to Housing NSW within seven days of the date of receipt.
  7. You may not remove any part of the solar PV system when your tenancy ceases.

I agree to the above conditions and wish to include this as part of my Residential Tenancy Agreement for the occupation of the property at <property address>.
