Minutes of the Meeting held on Thursday, 9th June2016 at 7.30 pm in Hamilton Hall

There were fourmembers of the public present.

The Chairman opened the meeting for public comments.

Public: The Pavement on Salmonby Road by the unoccupied bungalow was extremely hard to access as the hedge had grown a long way out – the Clerk had reported it to Highways as the Council had no contact details for owners of the property – Cllr Renshaw to make enquiries & report back. Clerk to chase up Highways. The potholes on the left of Salmonby Bends are large – Clerk to report. The Footpath from East Road by the bridge to Mill Lane (adjacent to the river) was vastly overgrown – Clerk to report.

There were no further comments & the Chairman opened the meeting for business.

00147Declarations of Interest – Cllr Todd declared an interest in planning application S/177/01047/16 – Brian Todd Homes & noted he would answer queries then leave the meeting while it was discussed. Cllr Louis declared an interest in planning application S/177/00635/16 as being the applicant & noted he would answer any questions & then leave the meeting; Cllr Louis also declared an interest in S/177/01047/16 because of work commitments & would leave the room while it was discussed. Dispensations were requested from Cllrs Renshaw, Larder, Harden, Stockdale, Taylor, Louis (with the exception of S/17/01047/16 & S/177/00635/16) & Todd (with the exception of S/177/01047/16) as all the Councillors were very familiar with one another & friendly & without the dispensations the Council would not be able to transact the business of the Council with regard to Planning Applications due to the small size of the villages.

The Council had the power to delegate the power to grant dispensations to the Clerk. The power rests with the relevant authority under section 33(1) of the Localism Act 2011 and the basis is set out under section 33(2). The parish clerk or the parish council may grant a dispensation to a councillor who has a Disclosable Pecuniary Interest to participate in any discussion of a matter at a meeting and/or to participate in any vote on the matter (as per para. 2 above) if they consider that:

(a) so many members of the decision-making body have disclosable pecuniary interests that it would impede the transaction of the business (i.e. the meeting would be inquorate); or

(b) the authority considers that the dispensation is in the interests of persons living in the authority’s area; or

(c) it is otherwise appropriate to grant a dispensation & it was resolved to delegate the power to the Clerk.

As the applications being considered were both from Councillors & considering that the Council would be inquorate without the dispensations, the Clerk granted the dispensations to the Councillors for the date of 9th June 2016.

00148Planning Applications:

Cllr Todd declared an interest as being a member of Brian Todd Homes; Cllr Louis declared an interest as working with Brian Todd Homes.

S/177/01047/16 – Brian Todd Homes – Outline erection of up to 7 dwellings. Land south of ‘Upper Garth’, Salmonby Road, Tetford LN9 6PY.

Cllr Todd answered the following questions: What was planned for the power unit currently in situ? It would be moved & go underground. Query over driveways – Cllr Todd noted that it was a legal requirement that cars should be able to leave in a forward gear and that would be allowed for. How tall would the first house next to Upper Garth be – a lower level two storey.

Cllr Todd & Cllr Louis left the meeting.

Following debate when it was noted that Tetford as a major village was earmarked for growth but that smaller houses for younger residents would be desirable & it was resolved that the Council supported the application in principle but would state a request for two smaller houses to be included p MR s JL

Cllrs Todd & Louie re-joined the meeting.

S/177/00635/16 – Mr G Louis, Planning Permission – Change of use of land for the siting of 5 safari style tents – Fircome Hall, Clay Lane, Tetford, LN9 6QN.

Cllr Louis answered the following questions: Would the tents be seasonal? Yes, put up March and taken down in October. What construction were they? 9m x 5m, Canvas with hedges between each one & trees planted, decked out with furniture, no electric but sanitary units in the tents.

Cllr Louis left the meeting.

The Council considered that the application was in line with tourism, the villages had caravan parks, holiday cottages etc. and the application would bring benefits to the village & following debate it was resolved to support the application p RS s MR.

Cllr Louis re-joined the meeting.
