MINUTES, WEEK OF SEPTEMBER 28, 2015

The Board of Trustees met on Monday, September 28, 2015, at the Butler Township Government Center, 3780 Little York Road, Dayton, Ohio, at 7:00pm for a Regular Session to transact the business of the township.

Doug Orange, President, called the meeting to order.

APPROVAL OF MINUTES

The Minutes of September 14, 2015, Regular Session, were submitted for approval. Nick Brusky made a motion to approve the Regular Session Minutes of September 14, 2015, as submitted, with Michael Lang seconding and Doug Orange approving the motion.

NEW BUSINESS

Sinclair Community College – Levy Presentation

Steve Johnson, has been President of Sinclair for 13 years. He stated that he and Michael Carter, Senior Advisor are there tonight. He stated that a few weeks ago they began their 128 years of operation, which makes them the oldest community college in the nation. He gave a brief overview of the college studies that it has doubled in amount and is one of the largest in America. He also provided statics about the students that have graduated and that had moved on to be able to provide higher incomes.

Michael Carter stated that he is a Butler Township resident and that he has 4 children that graduated from Butler. He indicated that they are there to request the board to consider endorsing a 1 mil levy for an 8 year term to be used to provide job training initiatives. The 1 mil levy will cost the home owner $35 a year on a $1,000,000 home. These initiatives are centered on training the health care professions, IT and manufacturing. They are supporting high school students enrolling in college early and to get focus on an efficient career early. It is about providing the range of job training that no one else provides like Sinclair does.

Steve Johnson explained that the 1 mil levy will allow our training programs to be faster with better quality. He stated that they are one of the largest in health care providers in the region and also in IT and advance manufacturing. Sinclair is recognized for quality, achievements, and for great effectiveness. He stated that he appreciates their time and if the board would support Sinclair Community College in this matter.

Michael Lang stated that he is very appreciative of Sinclair College and all it provides. Steve Johnson explained briefly that students that finish Sinclair in 2 years then entered the work force. He stated that 40% that come to Sinclair with no intention of transferring, for example like registered nurses are either number 1 in the region or number 2. He indicated that were 850 registered nurses in the last 5 years that come with no intention of transferring and this includes the police and fire academies as well.

Nick Brusky asked about the satellite schools in the different counties. Mr. Johnson stated that those students do pay a 50% higher tuition rate than the Montgomery County students. He stated that all the levy monies stay in Montgomery County. He stated that the Dayton campus is one of the largest campuses in the world with 223 programs to study.

The board greatly appreciated them for coming out and for those great opportunities.

Resolution #15-071 was submitted Accepting the Amounts and Rates as Determined by the Budget Commission and Authorizing the Necessary Tax Levies and Certifying them to the County Auditor. Nick Brusky made a motion for approval of Resolution #15-071, as submitted, with Michael Lang seconding and Doug Orange approving the resolution.

Resolution #15-072 was submitted Retaining Beverly Meyer and the Firm of Bricker & Eckler to represent Butler Township with Respect to Labor and Employment and Other General Matters and Authorizing the Township Administrator to Sign the Letter of Engagement. Nick Brusky made a motion for approval of Resolution #15-072, as submitted, with Michael Lang seconding and Doug Orange approving the resolution.

Resolution #15-073 was submitted Objecting to Petition to Annex 189.66 Acres More or Less, in Butler Township, Montgomery County, to the City of Union. Nick Brusky made a motion for approval of Resolution #15-073, as submitted, with Michael Lang seconding and Doug Orange approving the resolution.

Resolution #15-074 was submitted By Finding It Necessary to Amend the Revenue and Appropriations Budget for FY2015. Nick Brusky made a motion for approval of Resolution #15-074, as submitted, with Michael Lang seconding and Doug Orange approving the resolution.

Resolution #15-075 was submitted Authorizing an Advance of Cash Funds to the Brockman Residential Incentive District (RID) Fund (#2907) from the General Fund. Nick Brusky made a motion for approval of Resolution #15-075, as submitted, with Michael Lang seconding and Doug Orange approving the resolution.

Resolution #15-076 was submitted Supporting the Transmittal of an STP/CMAQ Application for the Little York Road Reconstruction Project, Phase 1 to the Miami Valley Regional Planning Commission. Nick Brusky made a motion for approval of Resolution #15-076, as submitted, with Michael Lang seconding and Doug Orange approving the resolution.

INFORMAL BUSINESS

Assistant Township Administrator, Erika Vogel had no further business to report at this time.

Chief Cresie had no further business to report at this time.

Chief Alig had no further business to report at this time.

Administrator, Kimberly Lapensee reported on behalf of the Service Department that the County will be out tomorrow to start the pavement on Engle and Frost Roads, then move to Evermur and Meeker Woods. With respect to the Administration, she reported that the four-way stop was installed last week at York Commons and Towne Center Drive. She noted that the flags will be up for a 30 day period, then after that the police will be able to issue tickets. She mentioned that they received the thanks but no thanks letter from the TID concerning the rail extension in Butler Township and the City of Vandalia and that they will continue to move forward as planned with both phases.

Mark Adams, Fiscal Officer had no further business to report at this time.

Trustee, Nick Brusky reported that he met with Vandalia Mayer Arlene Setzer and School Board member Bruce Sucher, to following up on the joint governmental meeting that we had this past month. He stated that they also agreed that a resolution needs to be past that we believe should have more local control from the state; basically saying we need more local control. He indicated that they are meeting again Friday to come up with a draft resolution. He also made note of more truck traffic on township roads that is related to the P&G facility some that were not even near that location.

Trustee, Michael Lang indicated that he would like to follow up on an email from this afternoon signage. What is going right now, are signs are up for construction and with the road closures making problems worse. He asked the Administrator if those signs are up to the north to detour people down to Airpark Blvd or to 40. Ms. Lapensee indicated that there will be more signs up tomorrow plus a no truck sign on Dog Leg Road as you go north. There was a brief discussion on the signage regarding the P&G facility and GPS changes.

Trustee, Doug Orange questioned the Administration about the legislation from Senator Mike Henne with regards to annexations eliminating revenue. Administrator, Kim Lapensee stated she would check into the matter and get back with them. Trustee, Doug Orange stated that we should send a letter to express our displeasure regarding HB302 and ask him to represent Butler Township as well as the cities in his district. He also made note the need to be at the MVRPC and the meeting on October 17th.

Nick Brusky reported that the trustees have reviewed the financial statements and made a motion for approval to pay the bills of the township, as submitted, with Michael Lang seconding and Doug Orange approving the motion.
