THIS INDENTURE, made on by owner(s) of property affected by the construction or improvement of the above mentioned highway, heirs, executors, administrators, successors, and/or assigns, hereinafter, whether singular or plural, called the OWNER, and , hereinafter called the PURCHASER,

W I T N E S S E T H:

WHEREAS the Purchaser a plan in the Recorder of Deeds Office of the aforesaid County indicating its authorization to condemn property required for the above transportation project; and

WHEREAS the amount of just compensation due the OWNER for the property of the OWNER required for the said transportation project has not yet been agreed upon; and

WHEREAS in order to avoid delay in construction of the aforesaid transportation project, it is necessary for the PURCHASER, through its employees, agents, and/or contractors to enter upon the OWNER's property prior to purchase or condemnation thereof; and

WHEREAS the OWNER is desirous that construction or improvement of the said transportation project be undertaken by the PURCHASER without undue delay;

NOW, THEREFORE, in consideration of the PURCHASER’S agreement hereby given to proceed with the improvement or construction, the OWNER hereby grants the PURCHASER, its employees, agents, and/or contractors the right to enter upon the portion of the OWNER's property which is required for the above transportation project as shown on the plans attached hereto and made a part hereof, for the purpose of undertaking the aforesaid construction or improvement, including the removal of any buildings and/or other structures located on the said portion of the property, said right to enter to take effect upon the execution of this instrument.

PROVIDED, HOWEVER, that this instrument shall in no way be construed as affecting the OWNER's right to receive just compensation for the property required for the transportation project, whether such property be eventually purchased or condemned by the PURCHASER.
