Qx2Exemption from Stage II Vapor Control Systems
Note: Stage II Vapor Control Systems are required at GDFs located in the counties identified in OAC 3745-21-09(A)(4).
Note: Additional exemptions from OAC 3745-21-09(DDD)(1) (Stage II requirements) found in (DDD)(4) and not covered in the terms below include: marina and aircraft refueling stands, automobile and light-duty truck assembly plants meeting the requirements of the exemptions; and GDFs dispensing gasoline with an ethanol content of 85% (E85).

Use this term if the GDF is exempt from Stage II requirements due to their gasoline throughput. Fill in the applicable exempted throughput.

- The monthly gasoline throughput for this facility shall not equal or exceed [XXXX1] gallons per month. If during any month the gasoline throughput equals or exceeds this amount, the permittee shall no longer be exempt from Stage II vapor control system requirements and the vapor control system shall be installed and maintained as required per OAC rule 3745-21-09 (DDD), even if the monthly gasoline throughput subsequently falls below [XXXX1] gallons per month.

Use the following term if the GDF has demonstrated that it has a monthly gasoline throughput of less than 50,000 gallons for an independent small business marketer or less than 10,000 gallons per month for all other GDFs not qualifying as a small business marketer, to qualify the facility for the Stage II requirements exemption.
(2)The permittee shall maintain monthly records of the gasoline throughput, summed for each day and at the end of each month.

- At least 95% of the motor vehicles filled at this gas dispensing facility shall be equipped with an onboard refueling vapor recovery system.

(4)The permittee shall maintain records documenting each vehicle being fueled at the gas dispensing facility, as either being equipped or not equipped with an onboard refueling vapor recovery system. These records shall be maintained current for the vehicle fleet filled at this gas dispensing station (covered under the OAC 3745-21-09(DDD)(4)(f) exemption) and shall be made available to the Director or his/her representative, upon request.
