Sub: Amendment to Ordinance governing MBBS Degree course 2004

Pertaining to Pass Criteria.

Ref: 1) RGUHS Notification No. ACA/BOS-27/97-98, dated: 25/09/2004.

2) Orders of Hon’ble Supreme Court of India in Civil appeal No. 3883 of 2006 (W.P) Nos. 122 and 125 of 2007 dated: 1-6-2007 in Maharashtra University of Health Sciences V/s. Paryani Mukesh Jawaharlal and others.

3) Minutes of meeting of Academic Council held on 06/05/2009.

4) Minutes of meeting of Syndicate held on 05/06/2009.

5)Minutes of meeting of Syndicate held on 30/07/2009.

In exercise of the powers conferred under Section 35(1) of RGUHS Act, 1994, the Syndicate in its meeting held on 30/07/2009, after detailed discussion on the orders of Hon’ble Supreme Court of India in Civil appeal No. 3883 of 2006 (W.P) Nos. 122 and 125 of 2007 dated: 01/06/2007 in Maharashtra University of Health Sciences V/s. Paryani Mukesh Jawaharlal and others is pleased to amend the Ordinance governing MBBS Degree course 2004 pertaining to Pass Criteria as shown below:

NO.6 INTERNAL ASSESSMENT

1) / A student must secure at least 35% of total marks fixed for internal assessment in a particular subject in order to be eligible to appear in the University Examination of that subject. (Vide Medical Council of India Notification on Graduate Medical Education (Amendment) Regulations 2003, published in the Gazette of India Part III, Section 4, Extraordinary issued on 15th October 2003). / A student must secure at least 35% of total marks fixed for internal assessment in a particular subject in order to be eligible to appear in the University Examination of that subject. 1) / For declaration of pass in any subject in the University examination, a candidate shall pass both in Theory and Practical/Clinical examinations components separately as stipulated below:
The Theory component consists of marks obtained in University Written paper(s), Viva-Voce examination and internal Assessment (Theory). For a pass in theory, a candidate shall secure not less than 50% marks in aggregate i.e., marks obtained in written examination, viva-voce examination and internal assessment (theory) added together. For a pass in practical/clinical examination, a candidate shall secure not less than 50% marks in aggregate, i.e., marks obtained in university practical/clinical examination and internal assessment (practical) added together. / For declaration of pass in any subject in the University examination, a candidate shall pass both in Theory and Practical/Clinical examinations components separately as stipulated below:
The Theory component consists of marks obtained in University Written paper(s) & Viva-Voce examination only.
For a pass in theory, a candidate shall secure not less than 50% marks in aggregate i.e., marks obtained in University conducted written examination and viva-voce examination added together (excluding internal assessment marks).
For a pass in practical/clinical examination, a candidate shall secure not less than 50% marks i.e., marks obtained in university practical/clinical examination (excluding internal assessment marks).
A candidate not securing 50% marks in aggregate in Theory or Practical/Clinical examination in a subject shall be declared to have failed in that subject and is required to appear for both Theory and Practical /Clinical again in the subsequent examination in that subject. / A candidate not securing 50% marks in aggregate in Theory including viva (conducted by University) or Practical/Clinical examination (conducted by University) in a subject shall be declared to have failed in that subject and is required to appear for both Theory and Practical /Clinical again in the subsequent examination in that subject.

The above Amendment to Ordinance shall be applicable for MBBS Examinations for the students admitted from the academic year 2009-10 and onwards.
