Permit Conditions:
- Amaximum number of 12 participants, per session
- No more than 10 x 1.5 hour sessions per week
- Personal training may only commence after 6am, daily. Noise can be a serious issue for local residents, and is to be kept to a minimum
- No advertising signage is permitted and no promotional material is to be distributed in parks
- Pathways are to be kept clear and unobstructed of activity or related equipment
- Any running on the Tan Track in Kings Domain should be undertaken in small groups – respect must be shown for all other runners / walkers
- No vehicles permitted into any parks or gardens, excepting designated pathways and emergency vehicles
- No equipment or infrastructure is to be attached to trees or park infrastructure. Large or heavy structures such as marquees, sound systems, weight benches or exercise bikes are not permitted. No equipment is to be pegged into the ground, only free standing or weighted equipment is permitted. Please ensure there is minimal impact on lawns. Dragging of tyres and heavy weights is not permitted, nor is the use of spiked shoes
- It is the responsibility of the licensee to ensure that all supporting documents are kept up-to-date and current and a copy provided to Council when renewed and/ or changed.
- The City of Melbourne reserves the right to alter personal training availability dependent on sustainability and maintenance of our parks and gardens.

- Maximum number of participants per session is 15; at some locations this may be lower

- Maximum number of signs to be displayed is one per personal trainer or fitness group
- Organised ball sports (eg. soccer, rugby, football) is not permitted
- Use of amplified music or voice equipment is not permitted
- The offering for sale of clothing, merchandise, equipment, refreshments, goods, services or
- products is not permitted
- Static training on or along the foreshore of the City of Port Phillip’s six beaches at Elwood, St
is not permitted

Permit Conditions:
- No more than 15 participants
- Involve amplified music or audio;
- Permits will not allow activities to commence prior to 6.00am or extend beyond 9.00pm.
- Each session allocated to the Personal Trainer will have a maximum continuous training period of two (2) hours. Permits will allow no more than 15 two-hour sessions or 30 one-hour sessions per week at each location.
- Use running spikes and/or studded sports boots;
- Involve dragging tyres, vehicles and/or equipment across grassed areas;
- Cause damage or stress to grassed areas, park fixtures or trees;
- Engage aggressive activities and behaviour, including games or activities that may
- unreasonably interfere with the use or access to the parks or gardens by any other
- person;
- Cause a nuisance to members of the public and neighbouring residents;
- Unreasonably exclude or cause to obstruct the public from the use of parks fixtures
- such as exercise circuits, benches or pathways; and
- Use weight training equipment over 10kg on sports grounds.

Permit Conditions:
- Activities that involve amplified music or voice equipment.
- Training is not to take place before 6am daily and not after 8pm.
- Training must not take place under tree canopies to prevent compaction of soil and damage to root systems.
- The maximum numbers of participants must not exceed those specified for each of the categories of park as follows:
Category B – 15 people
Category C - 20 people
- No pegs and or markers are to be put into the ground.
- No loud speakers or mega phones to be used throughout a training session.
- The noise from a personal training session should not be heard from outside of the parks proximity.
- Temporary signage in the form of an ’A frame’ measuring 600mm wide by 1000mm height (including 100mm legs) may be permitted during the training session only and must be within sight of the personal trainer.
- A temporary table 1000mm by 1000mm maximum size may be used during training sessions for administration.
- No structures such as lights or moveable park furniture (e.g.: chairs or benches) are to be used.
- Personal training activities may be conducted near sport pavilions between 6am -8am (Monday to Fridays) at all other times personal training activities are not permitted within a 10 metre distance of sport pavilions.
- The minimal amount of distance that must be kept throughout personal training activities from other structures in a park is 10 metres, these structures may include but are not limited to;
b) Playgrounds and related equipment.
c) Public Toilets
d) Cricket nets
e) Monuments

- Training sessions must not commence prior to 6am and must finish by 9pm.
- Council will not approve an application request for more that20 training sessions per week.
- No fitness training will be permitted in high activity areas and / or areas of cultural, environmental or natural significance.
- Aggressive or intimidating activities including combat/ fighting training is not permitted
- Amplified music or use of amplified audio (voice) equipment is not permitted
- The setting up of gymnasium type equipment (e.g. weight benches, weight stacks, stationary bikes, treadmills, steppers etc). is not permitted
- Personal and Group Trainers shall not suspend boxing or kickboxing bags from trees and / or structures in the public reserves is not permitted

Allocation Permits will not be granted for activities that:
- involve amplified music or audio;
- involve dragging tyres, vehicles or equipment across grassed areas;
- cause damage or stress to grassed areas, park fixtures or trees;
- involve aggressive activities and behaviour, including games or activities that may unreasonably interfere with the use of or access to the parks or gardens by any other person; cause a nuisance to members of the public and neighbouring residents;
- unreasonably exclude or cause to obstruct the public from the use of parks’ fixtures such as exercise circuits, benches or pathways; and
- use weight training equipment more than 10kg on sportsgrounds
- Maximum group size and number of personal trainers allowed to operate from each site. Allocation Permits will be issued in accordance with group sizes on a first come first served basis.
- Activities conducted under Allocation Permits must not commence before 6.00am nor extend beyond 9.00pm.

Permit Conditions:
- Permits will authorise each Operator to use Council and/or Crown Land for fitness activities in accordance with these Guidelines and Conditions on a non-exclusive basis with a maximum of 4 sessions per park per week
- No organised sporting activities or commercial fitness training are permitted in the following areas or sites of high pedestrian activity; horticultural, cultural, or environmental significance; or areas designated for children’s play and or family amenity.
- No signage is permitted outside the park or training area. Any operator wishing to erect signage in or around the permitted training area must seek council approval prior to doing so
- Groups are to be no larger than 40 participants
- The use of whistles, mega-phones and any amplified music is strictly prohibited
- The Operator shall ensure that the requirements of the Health Act, Local Government Act, any Local Law or regulations or any other applicable legislative instruments, including those pertaining to water usage restrictions are met.
- Fitness Trainer will be liable for any breach of such Acts, Local Laws or regulations.
- The Operator has a duty of care towards any person participating in their activities to ensure that it is run in an orderly manner and does not place any person or property at risk to injury or damage.
- The sale of clothing, merchandise, equipment, refreshments, goods, services or products is not permitted
- Activities are restricted to those which they are suitably qualified for and that are approved by Council
- Activities may only operate throughout day light hours
- Activities are only to operate in the areas and at the times specified by Council in the permit
- The Operator must cooperate with Council to manage their activities to minimise wear and tear on grassed areas
City of Moonee Valley /
Permit Conditions:
- Trainers must ensure activities conducted during classes do not affect the general public’s usage of the park/oval/track or any surrounding residents.
- Trainers are limited to 6 hours training per day between all three venues (unless applying for casual permit)
- Noise cannot disturb the ‘quiet’ enjoyment of other users or Residents
- No training equipment is to damage or interfere with the surrounding parkland (no equipment pegged in ground, boxing pads hung from trees etc)
- Any equipment used must be portable by an individual by hand
- 3 types of permit will be available (refer to application form for fees)
3.2.2 Category B: Regular commercial user –fitness providers conducting less than 3 sessions per week. Category B users will be required to pay a one off annual application fee.
- 3.2.3 Category C: Casual commercial user – conducting ‘one off’ training sessions and camps will be charged at a casual rate per session (per hour).
