INTRODUCTION

The school head, teachers and staff shall defend and protect all children in school from harm and abuse and any form of bullying. The school shows respect to the right of children, and foster them love and care including health and proper nutrition. The school shall teach every child in school to respect one another and how to care their peers in the school campus.

The students must be protected in any way and provide them an environment free from all forms of physical and mental violence, injury and abuse, exploitation and other forms of sexual abuse.

The Liberty National High School together with its stakeholders and partners, ensure that the school are conducive to education of children. It aims for the welfare of all children in school. The teachers and administrator exercise the special parental authority and responsibility while under their instruction. Every teacher and staff shall always consider in any way to safeguard the welfare of all students.

The school recognizes the cases of abuse that may arise within the school campus and give immediate attention and action.

DEFINITION OF TERMS

1. Child – refers to any person below eighteen (18) years of age or those over but are unable to fully take care of themselves from abuse, neglect, cruelty, exploitation or discrimination because of physical or mental disability or condition; ( RA 7610). For purposes of this Department order, the term also includes pupils or students who may be eighteen( 18) years of age or older but are in school.

2. Children in School- refers to bona fide pupils, students or learners who are enrolled in the basic education system, whether regular, irregular, transferee or repeater, including those who have been temporarily out of school, who are in the school or learning centers premises or participating in school sanctioned activities.

3. Pupil, Student or Learner- means c child who regularly attends classes in any level of the basic education system, under the supervision and tutelage of a teacher or facilitator.

4. School Personnel- means the persons, singly or collectively, working in a public or private school. They are classified as follows:

a.” School head” refers to the chief executive officer or administrator of a public or private school or learning center.

b.” Other School officials” include other school officers, including teachers, who are occupying supervisory positions or positions of responsibility, and are involved in policy formulation or implementation in a school.

c.”Academic Personnel” includes all school personnel who are formally engaged in actual teaching service or in research assignments, either on a full- time or part- time basis, as well as those who possess certain prescribed academic functions directly supportive or re-teaching, such as registrars, librarians, guidance counselors, researchers, and other similar persons. They may include school officials who are responsible for academic matters, and other school officials.

d.” Other Personnel” includes all other non- academic personnel in the school, whatever may be the nature of their appointment and status employment.

4. “ Child Protection” refers to programs, services, procedures and structures that are intended to prevent and respond to abuse, neglect, exploitation, discrimination and violence.

5. “Parents”- refers to biological parents, step parents, adoptive parents and the common- law spouse or partner of the parent.

6. “Guardians or Custodians” refers to legal guardians, foster

parents, and other persons, including relatives or even non-relatives, who have physical custody of the child.

7. “School visitors or Guest” refers to any person visits the school and has any official business with the school, and any person who does not have any official business but is found within the premises of the school. This may include those who are within the school premises for certain reasons, e.g. student’steachers, catechist, service providers, suppliers, bidders, parents and guardians of other children.

8.“Child Abuse” refers to the maltreatment of a child, whether habitual or not which includes any of the following:

a. Psychological or physical abuse, neglect, cruelty, sexual abuse and emotional maltreatment;

b. any act by deeds or words which debases, degrades or demeans the intrinsic worth and dignity of a child as a human being;

c. unreasonable deprivation of the child’s basic needs for survival, such as food and shelter; or

d. failure to immediately give medical treatment to an injured child resulting in serious impairment of his or her growth and development or in the child’s permanent incapacity or death.( Sec. 3 ( RA 7610).

9. ” Discrimination against children” refers to an act of exclusion, distinction, restriction or preference which is based on any ground such as age, ethnicity, sex, sexual orientation and gender identity, language, religion, political or other opinion, national or social origin, property, birth, being infected or affected by Human Immunodefeficiency Virus and Acquired immune Deficiency Syndrome (AIDS), being pregnant, being a child in conflictwith the law, being a child with disability or other status or condition, and which has the purpose or effect of nullifying or impairing the recognition, enjoyment or exercise by all persons, on an equal footing, of all rights and freedoms.

10. “ Child Exploitation” refers to the use of children for someone else’s advantage, gratification or profit often resulting in an unjust, cruel and harmful treatment of the child. These activities disrupt the child’s normal physical or mental health, education, moral or social emotional development. It covers situations of manipulation, misuse, abuse, victimization, oppression or ill- treatment.

11. “Violence against children committed in schools” refers to a single act or a series of acts committed by school administrator, academic and none- academic personnel against a child, which result in or is likely to result in physical, sexual, psychological harm or suffering, or other abuses including threats of such acts, battery, assault, coercion, harassment or arbitrary deprivation of liberty. It includes, but is not limited to, the following acts.

12.” Bullying or Peer Abuse” refers to willful aggressive behavior that is directed, towards a particular victim who may be out-numbered, younger, weak, with disability, less confident, or otherwise vulnerable.

13. Other acts of abuse by a pupil, student or learner- refers to other serious acts of abuse committed by a pupil, student or learner upon another pupil, student or learner of the same school, not falling under the definition of ‘ bullying’ in the preceding provisions, including but not limited to acts of a physical, sexual or psychological nature.

14. Corporal punishment- refers to a kind of punishment or penalty imposed for an alleged or actual offense, which is carried out or inflicted, for the purpose of discipline, training or control, by a teacher, school administrator, an adult, or any other child who has been given or has assumed authority or responsibility for punishment or discipline. It includes physical, humiliating or degrading punishment.

15. Positive and Non- Violent Discipline of Children- is a way of thinking and a holistic, constructive and pro- active approach to teaching that helps children develop appropriate thinking and behavior in the short and long term and fosters self- discipline. It is based on the fundamental principle that children are full human beings with basic human rights. Positive discipline begins with setting the long- term goals or impacts that teachers want to have on their students, adult lives, and using everyday situations and challenges as opportunities to teach life-long skills and values to students.

POSSIBLE SIGNS OF ABUSE

*A student says that she has been abused or bullied.

* A student has unusual injuries in any part of the body.

* A student has a sudden change in behavior, she/ he does not mingle to his/ her classmates and other students in school.

* A student doesn’t want to go to school anymore.

GENERAL RULES AND REGULATION AND CODE OF CONDUCT OF LNHS STUDENTS

Minor Offenses:

1. Respect of the Philippine flag during ceremonies should be observed seriously. Stop and stand still wherever you are when ceremony is going on.

2. Students should wear the prescribed daily uniform in school and should have proper haircut. Hair with highlights is not allowed. Applying eyeliners blush on and lipstick are strictly prohibited for students.

3. Wearing of earings for male students is strictly not allowed.

4. Students should come to school regularly and punctually.

5.. Silence will be observed in the school building, racing, running in the corridors is not allowed.

6. Observe proper waste disposal. No littering of pieces of paper, cellophane and other wastes in and out of the school campus and classrooms.

7. Toilets and lavatories should be kept clean after use.

8. Walls must be free from vandalism.

9. Students are not allowed to go from the school to any swimming place to swim or to any questionable places to drink.

10. Nobody is allowed to leave the school campus during class hours or recess time unless with the principal’s permission. When not feeling well, permission to go home is asked from the principal or prefect of discipline before notifying your parents to fetch you or someone to accompany home.

11. For any Saturday activities, students must secure from parent’s permission slip to be surrendered to the Principal’s office.

12.Outsiders are not allowed to enter the school campus without important concerned and purpose.

GRIEVOUS OFFENSE

a.Carrying of deadly weapons

b. Drug taking or drug pushing

c. Immoral conduct

d. Storing pornographic videos in cell phones.

e. Joining fraternity organization that are not sanctionedby the school

f. Assaulting a teacher or any person in authority.

g. Forging or tampering school records or transfer forms.

h. Destroying school properties.

Anti- Bullying Policy

  • Do not say bad or harsh words to fellow students.
  • Don’t underestimate fellow students capability in doing tasks and academic ability.
  • Don’t humiliate any students in front of other students.
  • Don’t threat other students in school.
  • Don’t punch, kick, pinch, spank, or throw things to any student.
  • Treat fellow students as your brothers and sisters in school. Help one another and speak well of everyone.
  • Don’t make fun or ridicule other students or schoolmates or laugh at their mistakes or defect, but bear with them patiently.
  • Simple courteous phrase must always be used: “ Thank You”

“ Please” “ You are welcome” “ I am sorry” and “Goodbye”

  • Promote positive and non- violent discipline of children.

ACTION AND PENALTY:

Grievous Offense:

FIRST AND SECOND OFFENSE: written warning with parents/ Counseling

THIRD OFFENSE: Advise to transfer to other school

Minor Offense:

First Offense/ Second Offense: written warning with parents/ counseling

Third Offense: Suspension for 5 days

DUTIES AND RESPONSIBILITIES OF FACULTY AND STAFF

Teachers and school personnel have the following duties and responsibilities:

  • All teachers and staff of Liberty National High school shall abide by the vision and mission of the Department of Education.
  • Serve as the second parent of the children while they are in school and shall protect them from abuse.
  • Follow the School based child Protection policy.
  • Give attention to health, nutrition of the students.
  • Keep the records or any complaint of abuse and bullying

PROCEDURES IN HANDLING BULLYING INCIDENTS OR ABUSE

  • Listen to the complainant with open mind and open heart. Notify the advisers about the case.Settle the problem within the level of the teacher advisers, if the is not resolved call the attention of the parents of both parties to settle in thepresence of the Prefect of Discipline, guidance counselor/ coordinator and the head of the school.
  • If the problem is still not solved, the case will be brought to the Child protection Commiteee for a decision.
  • The CPC shall refer the case to MSWDO to determine appropriate interventions.

REFERRAL GUIDELINES

  • The complainant does not contain a very serious/ grievous offense.
  • The case shall be dealt with in the school level only.
  • Hence, if during the school level proceedings, the case appears to be difficult to resolve ,the committee shall make a decision whether the case shall be referred to the next higher authority or if a referral shall be made.

RERERRAL MECHANISM/ FLOW CHART

JURISDICTION

Complaints of child abuse, violence, exploitation, bullying, and other acts of abuse shall be within the exclusive jurisdiction of the school and shall not be brought for amicable settlement before the Barangay. Complaints for acts committed by any person or student in school shall be entertained by the school authorities.

CONFEDIALITY

The school and the CPC- Child protection Committee shall keep all records of abuse and bullying confidential to safeguard the welfare of the students concerned. The school shall cooperate with higher authorities for the purpose of case investigation. The school shall ensure that records shall be shared for child protection purpose to safeguard students welfare.
