REGULAR BOARD OF SUPERVISORS MEETING MINUTES
APRIL 20, 2017

Call to Order/Pledge of Allegiance/Roll Call: Chair Booth called the meeting to order at 7:00 PM and the Pledge of Allegiance was said. Those present: Supervisors Greg Bennett, John Wulff, Arlene Schmit, Greg Booth, Yvette Adelman-Dullinger and Clerk/Treasurer, Faith Broberg. Sign-In Sheet attached.
Agenda: Supervisor Wulff moved to approve the amended agenda, seconded by Supervisor Adelman-Dullinger and the motion carried.
Clerk/Treasurer’s Report –
Minutes: Board of Supervisors Regular Mtg. – Supervisor Wulff moved to approve the amended minutes of 04-06-2017, seconded by Supervisor Adelman-Dullinger and the motion carried.
PUBLIC INPUT:
Cass County Sheriff Tom Burch – present to give his Annual Report for 2016.
His office had 811 calls for service from Sylvan Township. Kerry Swenson, Cass County Emergency Management Director has retired and Tim Norton has taken his place. Sheriff Burch has asked the County Commissioners if they would approve having the warning siren go off when the wind reaches 70 MPH alerting residents.
The question was asked if young kids on 4-wheelers needed to wear helmets when on their own property. Sheriff Burch said that young kids need to drive 4-wheels that are appropriate for their size. Helmets are required for those under 18 years old and they need to have ATV Training in safety. Those under 16 years old cannot ride in the road right-of-way.
East Lake Ridge Drive – this road has a cul du sac and one of the residents has seen lots of cans and debris. Sheriff Burch said that they would definitely patrol there and if there are others areas that need patrolling to let them know.
131st Street – there is a lot of 4-wheeler activity and we would appreciate the officers to patrol this area also.
K9 Patrol – Cass County has one K9 unit. “Yankee” has been trained in Narcotics, Obedience, Suspect Search, Evidence Search, Apprehension, and Tracking. He has been an asset to their department.
Pillager School – The Pillager School is very appreciative of the presence of deputies at the different school activities.
Old Business/Reports -
Bryan Drown Road Projects Report - Bryan wasn’t present tonight but had dropped off for the Board Members the Preliminary Cost Estimate for the Lower Sylvan Road Erosion. There was discussion on the cost estimate – costs were estimated on other projects that are similar to the Towns road projects --- It was decided that the Board would look at this road and W. Sylvan Drive SW on their Annual Road Review scheduled for Saturday, April 22, 2017. This will be put on the agenda for the next meeting, May 4, 2017.
Road Supervisor’s Report –
Valerie Johnson – Supervisor Wulff talked with her (East Lake Ridge Drive SW). She is concerned about the circle drive (cul du sac) and that it is getting torn up by the Snow Plow.
Dead Deer – Supervisor Wulff talked with the resident who reported the dead deer. It is more of a heads up to the Township. Discussion on where the Township would take road kill- Township has property east of Sylvan Lake Park where they could dispose of road kill.
W. Sylvan Drive Culvert – the water is flowing well. Discussion on an erosion mat for Sylvan Lane. They will check on this at the Road Review.
W. Sylvan/State 210 – the 4-wheelers are hard on the Township’s bituminous at the junction of W. Sylvan Drive SW and State 210. The Township (since part of this is in MN Dot’s ROW) probably can’t do anything in this area.
Deed Easements for Barnett Road SW – Supervisor Bennett reported that the deed easements have been signed by both the Barnetts and Mr. Crimmins.
Stop Sign Down – Supervisor Schmit reported that there is a stop sign down at Scearcyville Drive SW and Upper Sylvan on the east side of the road. The Clerk will do a work order for Holmvig Excavating on Friday.
Road Maintenance Contract – On Sylvan’s contract with Holmvig Excavating it calls for $1 million insurance and the Association of Township recommends a minimum of $1.5 million. The amount of insurance needed was changed on the contract to reflect this amount.
Anderson Brothers Forum - Chair Booth and Supervisors Schmit and Adelman-Dullinger went to this workshop on Tuesday, April 18, 2017. Darrick Anderson, Cass County Highway Engineer, mentioned that the State Park Road Account has quite a bit of money in it. The Township will check into this and see if 13th Avenue SW (which goes through the Crow Wing State Park) would qualify. There was discussion on whether or not the State Park allows paving in the park. Supervisor Schmit will be talking with Darrick Anderson and she will ask him about the State Park Road Account in regard to 13th Avenue.
Planning Commission –
PC Liaison – Supervisor Adelman-Dullinger reported that they had a quick meeting so some of the PC members could attend the Stormwatchers Meeting in Pillager. They did a quick look at some changes to the Sylvan Commercial Ordinance. They discussed Sylvan Lake Park – wondering if the Board would be interested in putting in some bike trails – multi-use.
Jack Peterson – Landscaping Business – the PC thought this wasn’t a good fit in a residential area because of the large trucks. Chair Booth asked why the PC thought this wasn’t a good fit as there is a lot of land there. Brad Clark has his excavating business on the same road. The PC Chair, Dave Johnson had misread something in the Sylvan Commercial Ordinance regarding an interim use versus a Conditional Use Permit. Supervisor Adelman-Dullinger will check on this.
Draft Feedlot Ordinance – the Board had reviewed the draft copy. Supervisor Wulff had three items to discuss and possibly change.
PC Feedlot Recommendation – the Planning Commission has recommended to the Board of Supervisors that once the changes discussed at their meeting were completed that this will be the final draft and recommend it to be used for the Public Hearing. At tonight’s meeting the Board of Supervisors made a few more changes and Supervisor Adelman-Dullinger moved that the corrected draft copy with the changes that were discussed tonight be accepted as the final draft for the public hearing, seconded by Supervisor Wulff and the motion carried.
Park – Pillager Lake Park Liaison, Supervisor Schmit asked how often the Park Board should meet. There isn’t any set meeting dates but during the summer they usually meet once a month and then as needed. The Clerk has contacted the previous secretary for the Park and asked if she knew who the new representative from the City of Pillager would be. The Park Board has received a quote from Mosquito Squad to spray the Park on Thursdays, June 15, July 13 and August 17, 2017 at a cost (with discount deducted) of $491.45. In 2016, the Park Board had decided not to spray that summer due to the cost.
NEW BUSINESS
Resolutions #2017 – 01 through 05 – at the Spring Short Course it was mentioned that each Board Member should have a resolution authorizing a contract with an interested officer under MN Statute § 471.88, subd.5 for when they are doing minor maintenance for safety of the residents.
Resolution #2017-01 for John Wulff – Supervisor Bennett moved to approve Resolution #2017-01 authorizing a contract with Supervisor Wulff , seconded by Supervisor Adelman-Dullinger and the motion carried with Supervisor Wulff abstaining.
Resolution #2017-02 for Greg Bennett – Supervisor Wulff moved to approve Resolution #2017-02 authorizing a contract with Supervisor Bennett, seconded by Supervisor Schmit and the motion carried with Supervisor Bennett abstaining.
Resolution #2017-03 for Arlene Schmit – Supervisor Wulff moved to approve Resolution #2017-03 authorizing a contract with Supervisor Schmit, seconded by Supervisor Adelman-Dullinger and the motion carried with Supervisor Schmit abstaining.
Resolution #2017-04 for Greg Booth – Supervisor Wulff moved to approve Resolution #2017-04 authorizing a contract with Chair Booth, seconded by Supervisor Adelman-Dullinger and the motion carried with Chair Booth abstaining.
Resolution #2017-05 for Yvette Adelman-Dullinger – Supervisor Wulff moved to -approve Resolution #2017-05 authorizing a contract with Supervisor Adelman-Dullinger, seconded by Supervisor Bennett and the motion carried with Supervisor Adelman-Dullinger abstaining.
Gull River Cemetery Annual Meeting at Sylvan Town Hall – Supervisor Wulff approved the Gull River Cemetery holding their annual meeting at the Sylvan Town Hall on Friday, May 5, 2017 at 7:00 PM seconded by Supervisor Schmit and the motion carried. Supervisor Bennett will open the Town Hall for them.
OTHER TOWNSHIP BUSINESS –
Correspondence –
Notice of Emergency Management meeting in Backus on Tuesday, April 25, 2017 from1:00 PM to 3:00 PM/plus agenda.
Listening Session DFL – Here at the Town Hall on Tuesday, April 25, 2017 6:30 PM – 8:30 PM. Chair Booth will open up the Town Hall for them.
Chris Marquette – State MN Road Salt Contract – Return order form by Tuesday, May 16, 2017.
Driveway Permits Required Signs – there was discussion on the Township purchasing some “Driveway Permits Required.” They will wait until after the Annual Road Review on Saturday, April 22, 2017 to decide how many signs they would need.
Review Claims – Supervisor Adelman-Dullinger will be checking the Rinke Noonan claim regarding the prices charged. Supervisor Wulff moved to approve the payroll checks #22316-22317 in the amount of $1,705.17 plus claim #’s 22318-22329 in the amount of $4,601.39 for a total of $6,306.56, seconded by Supervisor Adelman-Dullinger and the motion carried.
Information on the Board of Supervisors Board Meeting Thursday, May 4, 2017
Both the Clerk and Deputy Clerk will be gone for this meeting. Marla Yoho, Clerk from Fairview Township will cover this meeting for the Town Board.
Supervisor Wulff will open the Town Hall for Marla at 6:00 PM.
Checks – Payroll & Claims: Supervisor Bennett moved to authorize the Deputy Clerk to sign the payroll and expense checks for the Board and Employees, before the meeting, seconded by Supervisor Wulff and the motion carried.
Adjournment: Supervisor Schmit moved to adjourn, seconded by Supervisor Wulff and the motion carried with the meeting adjourning at 8:45 PM.
