[1]Art.118.§1.Whoever, acting with an intent to destroy in full or in part, any ethnic, racial, political or religious group, or a group with a different perspective on life, commits homicide or causes a serious detriment to the health of a person belonging to such a group, shall be subject to the penalty of the deprivation of liberty for a minimum termof 12 years, the penalty of deprivation of liberty for 25 years or the penalty ofdeprivation of liberty for life.
§3.Whoever makes preparation to commit the offence specified under §1 or 2, shall be subject to the penalty of the deprivation of liberty for a minimum termof 3 years.
[2]Art. 118.§2.Whoever, for the purpose defined under § 1, creates conditions threatening the biological annihilation of such a group for persons who belong to it, resulting in the stoppage of births within the group or forcefully takes away children of persons who belong to this group,shall be subject to the penalty of deprivation of liberty for a minimum term of 5 years orto the penalty of deprivation of liberty for a term of 25 years.
§3.Whoever makes preparation to commit the offence specified under §1 or 2, shall be subject to the penalty of the deprivation of liberty for a minimum termof 3 years.
[3]Art.119.§1.Whoeveruses violence or unlawful threat with respect to a group of persons or a particular individual on grounds of their nationality, ethnic origin, race, political and religious orabsence of religious beliefs, shall be subject to the penalty of the deprivation of liberty for a term between 3 months and 5 years.
[4]Art.119.§2.The same punishment shall be imposed on anyone, who incites commission of the offence specified under§ 1.
This article was revoked on 8 September 2010 by provisions of the law of 20 May 2010 (Journal of Laws of 2010 No. 98, item 626).
[5]Art.256.§1.Whoever publicly promotes fascist or another totalitarian state system or incites or disseminates hatred or contempt on grounds of differences in nationality, ethnic origin, race, religion or a lack of religious beliefs, sex, gender, age, disability or sexual orientation shall be subject to a fine, the penalty of restriction of liberty or the penalty of deprivation of liberty for up to 2 years.
§2.The same punishment shall be imposed on anyone, who for the purpose of dissemination records or imports, purchases, stores, possesses, presents, carries or sends printed material, recording or another object with the content set out under § 1 orcarrying fascist, communist or other totalitarian symbols.
§3.A perpetrator of the prohibited act under § 2 does not commit a crime if the act was related to artistic, educational, collecting or scholarly activity.
§4.In the event of a conviction for the offence under § 2, the court shall rule on forfeiture of the objects specified under § 2, even if they were not the property of the perpetrator.
This article was revoked on 8 June 2010 by provisions of the law of 5 November 2009 (Journal of Laws of z 2009No. 206, item 1589). The previous wording of the article:

[6]Art.257.Whoever publicly insults a group of persons or a particular individual because or their national, ethnic, political or religious affiliation, or because of their lack of religious beliefs, as well as on grounds of sex, gender, age, disability or sexual orientation or for such reasons violates another person’s inviolability shall be subject to the penalty of deprivation of liberty for up to 3 years.
