Committee

The committee meet each month. Meetings commence at 4.45pm. An email is sent to the report author and team manager at the end of the meeting summarising the committee’s discussion and recommendation in order for child protection to proceed with the recommendations as quickly as possible. The full written advice is emailed within a fortnight of the meeting.

If a referral needs to be submitted earlier then the scheduled date, please contact the Secretariat as soon as possible in order for a special committee meeting to be convened. Referrals considered urgent:

·  pending court date in the Criminal Division of the Children’s Court prior to the scheduled meeting and/or

·  the child will turn 15 years of age prior to the scheduled meeting.

Advice from the Therapeutic Treatment Board

The Board’s recommendation is limited to advising the Secretary as to the appropriateness of seeking a therapeutic treatment order. The information contained in the advice is based on information provided in the TTR submitted by child protection to the Board.

Where a referral for advice from the Therapeutic Treatment Board has been made and child protection decides to act contrary to that advice, that decision must be endorsed by the divisional Child Protection Manager. The board should be advised of this decision and the reasons for the decision. This can be done via emailing the Board Secretariat at: therapeutic treatment

Other parties accessing the Board’s advice

The CYFA is silent on whether the Secretary may disclose the Board’s written advice to other parties. Therefore, the Information Privacy Act 2000 (IPA) and the Health Records Act (if relevant) must be considered.

The IPA allows disclosure of personal information about an individual to the individual (information privacy principle 6). Accordingly, personal information about the child can be provided to the lawyer who is representing the child. Please be aware that in the absence of a court order such as a subpoena, disclosure is discretionary and there may be reasons for not providing the requested advice eg: providing access to the advice may have an unreasonable impact on the privacy of other individuals.

The IPA also allows disclosure if it is required by or authorised by or under law (Information Privacy Principle 2.1(f)). A court can also issue a formal order such as a subpoena for the advice. A request by a court for the report in these circumstances equates to ‘required by or authorised by or under law’.

If child protection decide to disclose the advice, the advice should be de-indentified in the areas containing personal information (including the person who reported the concerns) that is considered to have an unreasonable impact on privacy of other individuals, and information likely to identify the reporters.

·  the committee is made up of representatives of public prosecutions, police, child protection and treatment agencies – find a balance between the evidence, family circumstances and analysis that will support the recommendation

·  the committee is not as intimate with child protection as you are – assume they know nothing

·  The committee do not have access to CRIS and are reliant on the information in the report to inform their advice to child protection.
