126 DECLARATIONS OF INTEREST
a)Councillor Graham signed the Register declaring that he is a County and City Councillor and a Member of the Down a Gate Committee.
b)Code of Conduct – a reminder from Carlisle City Council that if there is a change in councillor circumstances the Register of Interests must be updated.
127 MATTERS ARISING FROM THE PREVIOUS MINUTES – these are matters to note
a)2016/17 Precept - forwarded to Carlisle City Council November 2015 in the sum of £16,500 increasing the average Band D by 0.85 pence.
b)Bus Shelter, Edmund Castle – Installed 10 December. Seating to be installed at later date
The meeting was suspended at 7.04pm for:
128 PUBLIC PARTICIPATION
Mr Goode informed the council that there had been a complaint received before Christmas regarding the route taken by the quarry lorries. The vehicles are using a different route currently because of the road closures on the road leading from the A69 crossroads to the Coach House crossroads at Heads Nook.
Esk Quarries has the shortest opening hours of all the quarries close by and they have submitted an application to start operations at 7am to enable them to remain competitive.
Mr Goode went on to say that the council can make a claim for damages to the surrounding roads during the very long road closure of the main road leading to Heads Nook. There is considerable verge damage in the surrounding areas where the diversions are located. There is also a lot of dirt on the road requiring a road sweep when the work is completed. Lastly, the layby on the A69 where there is also traffic management installed should be re-tarmacked when the work is completed.
Councillor Clubbs added that the original works are running two weeks late and that the Gas Network is considering continuing the works for another 300 metres, which will involve the road being closed even longer.
Councillor Parsons said she had received a number complaints regarding the Heads Nook road closure. She had also received complaints regarding the lack of a landline telephone service in the Heads Nook area.
Councillor Clubbs said that the lines had been damaged when the fibre Broadband was installed and Openreach were considering the options for repair.
She went on to say that Down a Gate is in need of support following the flooding in early December.
The meeting resumed at 7.10pm.
129 SUPERFAST BROADBAND
The council has received a response from Connecting Cumbria and it is understood that Hayton Townhead should be connected during Phase 2 which will begin around Eastertime. There is some confusion as Connecting Cumbria can only use Government funds to connect areas where there is no other Broadband available and it appears that there is a company which can provide satellite broadband in the How Mill, Faugh area although it is understood that this type of Broadband is very expensive.
Resolved – to invite Connecting Cumbria to the Annual Meeting with Electors in March to explain the situation.
130 BUS SHELTER CORBY HILL
The Clerk had attached a written update to the agenda. There had been a meeting held earlier in the day with the main parties
It was agreed that:
- The bus shelter company would redesign, price and complete drawings for two bus shelters – one on the tarmac pad at the front of the site (the preferred option) and a much smaller one for the back of the site.
- Agreement was given to put in a tarmac pad to the rear of the site free of charge.
- Roadlink agreed to take both applications to Highways England, who are the owner of the land.
2. Wetheral Parish Council has requested that a noticeboard (given free of charge) be erected on the back of the new bus shelter and to be shared by Wetheral and Hayton parishes. Cllr. Graham said that the request was now obsolete as he had moved the grit bin to allow access near the Mill entrance.
The board will require a permit from Highways England as owners of the land.
Resolved– to approve the proposals for the A69 Bus Shelter.
To leave the matter regarding the bus shelter.
131 DOUBLE YELLOW LINES, HAYTON
The Chairman had met with Sarah Steel of Cumbria County Council. They had agreed where the single yellow line should go and the times for the No Waiting order. Ms Steel had agreed to submit some final drawings for the PC to look at andapprove before undertaking the work.
Resolved – to await the drawings.
132 HAYWAIN HILL
Before this item the Chairman addressed the council – he said that when this type of meeting was set up it was specifically for local authority officers and members of the parish council only. Parish councillors are there to represent the electors and their views. If anyone else is to be invited the Clerk needs to know so that it can be included in the arrangements. If this is not done the PC will lose the goodwill of the officers and they will be reluctant to attend meetings. The Chairman requested the Clerk send an apology to the officer in question although she had not made a complaint.
The county council officers had sent a report of the meeting which was issued with the agenda. There are several solutions to be investigated plus another that was submitted after the meeting. These will be investigated by the officers and a report sent to the council. There is no funding in the county council’s budgets for next year to carry out any work unless some allocated work cannot be undertaken and even then it will be part of a reserve list and may not be chosen.
Resolved – to await a further report from the county council
133 FINANCIAL REGULATIONS
The Financial Regulations have been updated to include new legislation and Statutory Instruments. The amendments have been recommended for approval by the Policies and Procedures Committee.

134 STANDING ORDERS
The Standing Order amendments cover cross referencing to the Council’s Policies and Procedures and updated Model Standing Orders.
The amendments have been recommended for approval by the Policies and Procedures Committee.

135 FOOTWAY LIGHTING
The footway lighting list was received from the Carlisle Parishes Association. The PC now has an up to date list of all footway lighting in the parish.
Resolved – to inform Carlisle City Council that Woodlands, Hayton is missing from the list.
136 ELECTRICITY NORTHWEST – TREES AT FAUGH PLAY AREA
The Clerk has attended a site meeting where Electricity Northwest has indicated trees which they wish to cut back or fell for safety purposes. The land is in the ownership of Carlisle City Council
Resolution – to pass the request to the City Council.
137 DOWN A GATE FLOODING
Since the last Parish Council meeting Down a Gate has been badly affected by the flooding in early December. Hayton Parish Council was asked to prepare a list of funders who may be able to assist in the restoration. This was done. The clear up has been started but there is a problem with the drains and an anxiety that flooding may occur again. There is now talk of knocking down the building and rebuilding at an elevated level in a bid to avoid it flooding in the future. There is to be another meeting and Cllr. Smith said he would report back.

139 GAS OUTAGE, HAYTON
The gas supply was cut off in Hayton a couple of days before Christmas due to there being water in the pipes. The Chairman has been approached by several residents requesting the council send a letter of thanks on their behalf for their prompt attention and work to reinstate the gas for Christmas Day. Members agreed with the Chairman but went on to say that it was the infrastructure that had failed and the matter should have been resolved before the matter reached the point of failure to properties. Apparently the pipe is again full of water.
Resolved –to send a letter of thanks but also point out the failure to fix the matter before the gas outage.
140 POLICE MATTERS AND REPORTS
Members were informed that there has been a number of serious thefts in the area in the past couple of weeks and to be vigilant. The police are investigating.

Hayton Parish Council wish to make the following comment: It is noted that renovation work has taken place on buildings at Fenton Farm which would need to be demolished and the roadside wall taken down to enable Condition 9 of Decision Notice for Planning Application 13/0083 to be adhered to. Condition 9 states that – “A footway that links continuously and conveniently from the application site to the nearest footway shall be provided”. 18.1.16
16/0001 – Rose Cottage, Faugh, Heads Nook, Brampton CA8 9EG. Single Storey and Two Storey Rear Extension to provide New Kitchen and Utility on Ground Floor with 1 Bedroom above; Erection of Detached Single Garage; Retrospective Change of Use of Land to Extend Garden Area into Adjoining Agricultural Field. Observation - The parish council cannot see any plans for drainage. Is the surface water just to drain into the road? Given the flooding problems experienced in the district the parish council suggests that all applicants ‘should do their bit’ to maintain or improve drainage when adding buildings etc. 14.1.16
16/0002 – Rose Cottage, Faugh, Heads Nook, Brampton CA8 9EG. Single Storey and Two Storey Rear Extension to provide New Kitchen and Utility on ground floor with 1 Bedroom above; Internal Alterations to Dwelling; Erection of Detached Single Garage (LBC). No comment
16/0003 – Closehead, How Mill, Brampton CA8 9LF. Erection of Replacement Farmhouse and Conversion of Redundant Barns to provide 2 Dwellings with Associated Outbuildings
16/0013 – Lands to the rear and east of Croftlands, Allenwood, Heads Nook, Brampton CA8 9AF. Erection of 6 Dwellings. Hayton Parish Council wish to make the following comments regarding the above planning application:
- The previous application (13/0762) made provision for a highway access on to the new development from the rear of Croftlands. This would have allowed any generated traffic from any future development, following its sale e.g. conversion into flats, to access to the main country road via this development rather than the existing very substandard access.
- A new footway was to be provided from this development up to Heads Nook Railway Bridge. To facilitate this the beech hedge fronting Crocus Hill, owned by the previous applicant, Mr Lawson, was to be moved back. Is the new developer in a position to be able to do this?
- Since outline planning approval was given for this development another development (13/0792), on the opposite side of the C1026 road has been received outline planning consent. This development has an access with visibility distances which do not meet Manual for Streets 2 standards.
Previous developments on that side of the road, i.e. The Whins and Rose Paddock, had to have their accesses 90m apart. The distances between The Whins and this new development access, on the same side of the road is only 26m. Manual for Streets 2 requires a distance of at least 43m.
As the County Council has not yet updated its Design Guide for Developers to take into account the Manual for Streets 2, reference should be made to those produced by Lancashire, or Leicestershire. Lancashire’s document, published in 2010 states that junction spacing on the same side of the road should use a minimum spacing equal to the stopping distances e.g. for 30mph a distance apart of 43m
Taking into account the substandard distance apart of the accesses to the new development 13/0792 and The Whins, plus the existing substandard access to Croftlands, Croft House, The Croft and Pig Farm, a Safety Audit should be carried out by the Highways Authority taking all the above into account. Hayton Parish Council would remind the Highways Authority that it has a duty under the 1988 Road Traffic Act Section 39 to carry out a Safety Audit when new roads come into use in order to reduce the possibilities of accidents occurring.

a)Carlisle City Council Consultation - Removal of equipment from the telephone boxes in Corby Hill and Hayton. Also the adoption of the Corby Hill Telephone Kiosk as an AED centre. Letter written to say that there would be no objection to the telephony being removed but that there was already an AED in Corby Hill. Emailed – Nov 2015. Carlisle City Council has written to Openreach requesting all kiosks that will house an AED to have 999 facilities too.
