Mayor Walters announced that the meeting was now open. Adequate notice of the meeting was provided by posting a copy of the time and place on the Municipal Clerk’s bulletin board and mailing a copy of same to the Press and the Cape May County Herald on January 8, 2015.

NEW BUSINESS: ITEMS TO BE VOTED ON
RESOLUTION 2016-S-39 – (Refund $150 paid for Fire Inspection – House not being rented)

WHEREAS, the following submitted fees for Fire Inspection and for Rental Registration License (Fire Inspection Fee - $50.00, Rental Registration License Fee - $100.00) for 240 – 85th Street; and
WHEREAS, the property owner has notified the Borough that they will not be opening the cottage this year due to illness; and
WHEREAS, the Fire Official has approved the return of said fees.
NOW, THEREFORE, BE IT RESOLVED on this 2nd day of February, 2016 by the Borough of Stone Harbor that the Fire Inspection and Rental Registration License fees amounting to $150.00 be refunded to the following:

RESOLUTION 2016-S-40– (Refund #110 Fire Inspection Payment deposited in error, no inspection needed)

WHEREAS, the following submitted fees for Fire Inspection Fee - $110.00 for 9712 Third Avenue; and
WHEREAS, the fee was received and deposited through the construction office; and
WHEREAS, the fees did not apply since the building is a business and fire inspection is for residential only; and
WHEREAS, the Fire Official has approved the return of said fees.
NOW, THEREFORE, BE IT RESOLVED on this 2nd day of February, 2016 by the Borough of Stone Harbor that the Fire Inspection Fee amounting to $110.00 be refunded to the following:

WHEREAS, none of the fees were used in conjunction with the projects, and
WHEREAS, the Zoning Officer has requested and approved the return of the fees.
NOW, THEREFORE, BE IT RESOLVED this 2nd day of February, 2016 by the Borough Council of the Borough of Stone Harbor as follows:

RESOLUTION 2016-S-42 – (Refund Escrows –Zoning/Planning)

WHEREAS, some of the escrow money was used in connection with a project and a refund for the remaining fees have been requested; and

RESOLUTION 2016-S-43 (Legalized Games of Chance RIGI State License)

A RESOLUTION APPROVING AN AMUSEMENT GAME LICENSE
FOR RIGI’S ARCADE
WHEREAS, the Borough Clerk has issued permits to Rigi’s Arcade for its operations in the 200 block of 96th Street; and
WHEREAS, at this time the State of New Jersey Legalized Games of Chance Control Commission requires the passage of a Resolution by Borough Council in connection with the Commission’s oversight responsibilities for redemption activities at such operations; and
WHEREAS, Rigi’s Arcade has submitted the proper application and paid the appropriate fee, under and subject to the rules and regulations established by the Commission; and
WHEREAS, the Borough of Stone Harbor is a seashore resort community and State law allows such redemption activities within such operations in such towns; and
NOW, THEREFORE, BE IT RESOLVED, by the Borough Council of the Borough of Stone Harbor, County of Cape May and State of New Jersey, duly assembled in public session this 2nd day of February, 2016, that Rigi’s Arcade be and is granted an Amusement License by and from the Borough of Stone Harbor for the period January 1, 2016 through December 31, 2016; that the Borough of Stone Harbor has no objection to the State of New Jersey licensing and/or regulating redemption activities at Rigi’s Arcade, and that such licenses shall be kept on file for public review in the Borough Clerk’s Office.
BE IT FURTHER RESOLVED that this Resolution shall be effective only upon the affirmative vote of not less than two-thirds of the members of Borough Council.

RESOLUTION 2016-S-44 (Raffle License Approval – Lions Club)

WHEREAS, the Lions Club of Stone Harbor, Inc. made application on January 19, 2016 for a Raffle License under Application No. RA-2016-03; and
WHEREAS, it is the desire of the Borough Council of the Borough of Stone Harbor to issue a Certificate of Approval under Application No. RA-2016-03 to the Lions Club of Stone Harbor Inc. for holding of said Raffle;
NOW, THEREFORE, BE IT RESOLVED by the Borough Council of the Borough of Stone Harbor, in the County of Cape May, State of New Jersey, on this 2nd day of February, 2016 as follows:
1. That the Borough Council issue to the Lions Club of Stone Harbor Inc. a Certificate of Findings and Determination to be signed by the proper officer of said Borough Council under Application No. RA-2016-03 made by said Lions Club of Stone Harbor; and
2. That the Municipal Clerk of the Borough of Stone Harbor be, and she is hereby authorized, empowered and directed to cause the proper Raffle License to be issued to the Lions Club of Stone Harbor, Inc. in accordance with the application made therefor.

ORDINANCE Deleting Business & Tourism Advisory Committee from RGO

DISCUSSION GOUGHER – To include use of trappers and pest control becoming responsibility of home owner. This is all being talked about in Natural Resources, about segregating it out, pest control and animal control. We talked about the skunk problem and if the Borough wants a contract for pest control, or whether or not you want the property owners to handle it themselves. If they have an issue they would call a pest control company. We discussed it in NR and believe that is the direction everyone was going in. If you are calling because you think you need a trap set on your property you will contact a pest control company. In most other municipalities the homeowner must call the pest control company, it is on the homeowner. Judy said one of the things Shore Animal Control said they would offer to us as a service, at the initial complaint of the skunk, they will come out and do a property assessment and advise to minimize the skunk problem. Gougher said the Council has to make a decision because right now the company that we are contracting with will only come out and do education. We either have to increase our budget to continuing covering a pest control company to come out to deal with skunks or we have to educate the public to the fact that they now would have to call a pest control company themselves. We will have to contract with a separate company for pest control, add to the budget or tell the property owner they will have to contact pest control themselves. Administrator said she needs a decision on which direction Council wants to go. No decision was made. Councilmember Davies-Dunhour, stated it is required by the State that we name an animal control officer, at this point we have not named one. Contract must be renewed, can’t go month to month. Administrator needs a decision with having the property owners deal with the pest control on their own, also mentioned the use of trappers which is offered to residents also. Don’t know if we should publicize that, but people have that option. Administrator will get financial information concerning costs from previous years and bring it up at the next meeting. No decision was made.
AWARD RFP - Tennis Pro/Instructor Councilmember Gallagher recommended we award this to the instructor that submitted the most responsive packet, we had two submittals and they were reviewed by our Solicitor. He recommended the Edwin Nusbaum package it was more responsive and included proof of insurance. Councilmember Gallagher stated that the Recreation Director is trying to put together her schedule and is recommending that we vote on this tonight. Councilmember Lane said we are not named on the insurance certificate. Solicitor said that is simply a phone call to get a new insurance certificate naming us as additional insured.
RESOLUTION 2016-S-45 (Award RFP – Tennis Pro/Instructor)

AUTHORIZING THE ACCEPTANCE OF A REQUEST FOR QUALIFICATIONS, TENNIS PRO/INSTRUCTOR AT THE STONE HARBOR RECREATON BUILDING
WHEREAS, the Borough of Stone Harbor is desirous of having a Tennis Pro/Instructor at the Stone Harbor Recreation Department; and
WHEREAS, Edwin Nausbaum 3 Corson Lane, Ocean View, N.J. 08230 responded to the Request for Qualifications advertised in the Atlantic City Press for the Summer of 2016; and
WHEREAS, the Request for Qualifications & Proposal attached lists the hours of operation, responsibilities, duration of contract among other items.
NOW, THEREFORE, BE IT RESOLVED by the Borough Council of the Borough of Stone Harbor, County of Cape May, State of New Jersey, assembled this 2nd day of February, 2016, that the proposal aforementioned, a copy of which is attached hereto and incorporated herein by reference, be and the same is hereby approved by the Borough of Stone Harbor contingent upon adding Borough of Stone Harbor to the insurance certificate as additional insured.
BE IT FURTHER RESOLVED, that the Mayor and Clerk hereby approve the Request for Qualifications attached proposal for Tennis/Pro Instructor at the Stone Harbor Recreation Building for 2016.

RESOLUTION – Changes to Recreation Department Bonuses
Councilmember Gallagher said two items to be amended in the current contract, first the bonus of $6.50 per day, worked during August 13th – Labor Day applies to Summer Employees only. Maximum bonus awarded would be $200, the other change at the request of the Finance department, bonuses will be distributed during the first pay period in November. She said the department had difficulty keeping people on after August 13th . The Resolution will be brought to the February 16th meeting with the appropriate changes.
