The Board of Commissioners of Lorain County, Ohio met this day in a regular meeting, in the J. Grant Keys Administration Building,

226 Middle Avenue, Elyria, Ohio, at 9:30 a.m. with the following members present: Commissioner Ted Kalo, President, Commissioner Lori

Kokoski, Vice-President, Commissioner Tom Williams, Member and Theresa L. Upton, Clerk.

JOURNAL ENTRY

Commissioners said the Pledge of Allegiance.

Commissioner Kalo said Commissioner Kokoski will be a few minutes late.

A. BUDGET HEARINGS

9:30 a.m. Recorder – Judy Nedwick

David Keener, Chief Deputy Recorder stated the 2015 request for general fund is $562,262 and based on estimate revenue in 2015 of $1,112,500 hoped this year was going to be a little higher. The increase is based on workers compensation line item and have been monitoring with Budget Director. The Recorder’s office is on par to meet the goal of $1,112,985 and sitting at $872,485 as of November 17 these are the fees that have been collected and there will be a return to the general fund between $50-60,000.

Commissioner Kalo said the budget is status quo from 2014, Mr. Keener said yes.

Mr. Keener said the significant amount of money that was once going to the general fund to cover travel expenses and education expenses of the Recorder will now come from technology account. Recorder Nedwick said also supplies are coming from this account and has been very prudent and stated that the last couple of days have been very busy and not sure why but that is ok.

Commissioner Kokoski arrived. ______

9:50 a.m. Prosecutor – Dennis Will

Prosecutor Will has requested approximately $175,000 which is an increase of the 2014 budget of general fund expenditures in personnel. In the letter dated November 10, 2014 this budget request for 2015 is almost exactly the same as what was received in 2005 excluding his salary, FOJ subsidy and PERS. The 2015 request is approximately $34,000 more than what was provide in 2005 and salary request is $3,938 less than what was provided in 2005. The general fund request increase from 2014 to 2015 is primarily due to the removal of a prosecutor from a grant to the general fund and need for a law clerk to provide additional research capability, also a modest 2 1/2 % wage increase for personnel. He has also requested a modest increase in the title IV-D and IV-E budgets of 2.5% to 3.7%. The IV-D budget is reimbursed by 66% by the State of Ohio and IV-E salary budget is fully subsidized by the State of Ohio and Lorain County Children Services.

Prosecutor Will said through is 10 years in office, he has cooperative with the Commissioners in the budgetary matter, the average yearly expenditures in supplies, furniture, equipment, computer equipment and computer software from 2005-2013 was $5,000 less per year than average spending 2003-2004 by predecessors. He realizes that budgeting is difficult, however, the request to 2005 levels I more than reasonable. The attorneys have an average of 18 years of experience and are paid an average salary of $63,645/year and they deserve the support.

Prosecutor Will said yes crime looks to be done by population/city but has been driven up by crime offense and trials are happening weekly and people and resources are needed.

Commissioner Kalo said he appreciates the 2 ½% but all non bargaining employees will probably follow the union contracts which are 2.25% and asked what was given last year. Chief Staff Koury said that it was 2 ½% last year, Commissioner Kalo said correct but this year it is 2.25% by contract across the board. Prosecutor Will said if the Commissioners are asking if 2.25% is ok, compared to nothing, yes.

Commissioner Kokoski asked if all Prosecutors employees took cuts, or just a certain amount. Prosecutor Will said this would be an increase and they are almost close to where they were before they took 15-20% cuts, plus reduction in hours back in 2008/2009 so he is just trying to get them close. Commissioner Kalo said for a 3 year period there was nothing. Prosecutor Will said the courts did not lay off so the Prosecutor had to be opened, therefore he cut salaries and hours.

Commissioner Kalo said his only concern was the wage increase and the Prosecutor office helps out the Commissioners a lot with Mr. Innes and Mr. Pyanowski for the land bank.

Commissioner Kokoski said we should have some discretion on the 2.5 to 2.25 increase in that department what is that difference. Mr. Koury said it would be around $6,000.

Mrs. Beidleman said they hosted multiple high school and college students through WDA who provide an internship opportunity to a student from Ohio Business College and improve cross training, enable Legal Division to absorb the retirement of two employees without hiring additional staff.

They relocated Lorain Branch Title office to more desirable location and will be doing passports

Expanded case types eligible for AG collections and has collected almost $274,000 to date on referred cases.

Initiated new disbursement procedures to align with IRS regulations

Entered into an agreement with General and probate division Courts to establish an Integrated Justice Information System

Restored North Ridgeville Branch Title office to full working condition in only 4 days during the several flooding in May

Liens filed by the state have increase significantly between last year and 2014 to date which is up 220% and project to be 6900 filings by end of 2014 and since September there have been 5177 state liens issued

The criminal cases ordered by the court to pay in 2009 was $3.9 million to date 36% of those funds owed by haven collected and as of September there were 1730 cases filed

The domestic violence civil protection order there is no charge but project by end of year will be 475 issued

Domestic relations filings are tentatively constant, there have been 340 dissolutions and 457 divorces filed as of September 30, 2014

Foreclosures are down but garnishment filings are exploding. IN 5 yeas time, they have doubled amount of money collected and disbursed on garnishments annually. Between January and September of this year 696 garnishments have been filed, about 24% of those are filed on judgments in favor of the state of Ohio and actual garnished funds through September were $697,955.03.

Notary public services as of date 494 renewal applications, 241 new and $3,675 collected for general fund.

Clerk of Courts budget hearing cont. November 18, 2014

Ms. Beidleman said the 2015 request for the legal division is $1,170,150, which is only a 3% increase from 2014 and a 6% increase from what was received in 2014 and the estimated revenue is $990,000 and they will absorb $50,000 due to an increase in foreclosure funds.

Commissioner Williams asked if this was 2 ¼% pay raises or additional. Ms. Beidleman said 3%, the Clerk of Courts office workers salaries are very low, a lot of single mothers in this office qualify for government assistance. Commissioner Kokoski said there in an increase of $148,000

Commissioner Williams asked why there is money for renovations. Ms. Beidleman said the carpet needs to be replaced and to serve the public better they are going to reposition the counters. She stated there are about 3 full time and 3 part time employees that work on foreclosure. Commissioner Kokoski stated that foreclosures are down, less work. Ms. Beidleman said no, there are senior staffs even trying to catch up with all the foreclosure that are in the process

Commissioner Williams asked how many cases were handled this year vs. last year. Mr. McDonald said there were about 860 cases last year and right now they are at 600 cases. Commissioner Williams asked how many hours it takes to do a foreclosure. Ms. Beidleman explained the job description

Tim Lubbe, Court Administrator, Common Pleas Court said the courts are struggling as well so they looked at the numbers and due to the decrease, that is why they are only providing $50,000 to the office for foreclosures and will revisit each year. County Administrator Cordes asked if it was less work, Mr. Lubbe said yes, around 20-30%.

County Administrator Cordes said he will review to see if the land bank money could be used to offset some of the foreclosures the county is doing, Ms. Beidleman said there were about 150-200 tax liens sent over by the county. Mr. Cordes said this would only be temporary money and apply towards OFHRA grant.

Ms. Beidleman said Jean Tucker will explain the Title Office.

Ms. Tucker said the title division issues certificate of title to motor vehicles and watercraft, process passports, has 4 locations and offers Saturday hours for greater convenience. The title transaction for 2014 as of date is 208,448 will exceed last year number which had been our highest transaction volume since 2008.

The Lorain title office was relocated next to Palace on Broadway and will offer passports and other fees collected through title of Limited authority deputy registrar is $11,096 and passports are $58,540.

The request for the 2015 budget is $1,581,790 and estimated revenue is $1,600,000 and they will donate $300,000 back to the general fund

Commissioner Kalo moved, seconded by Commissioner Kokoski to recess into an executive session at 10:40 a.m. to discuss personnel complaints. Upon roll call the vote taken thereon, resulted as: Aye: Kalo & Kokoski / Absent: Williams was not in the room.

Commissioner reconvened from executive session and no action was taken.

With no further business before the Board, Motion by Kalo, seconded by Kokoski to adjourn at 11:50 a.m. Ayes Kalo & Kokoski / Absent: Williams he left
