Particulars of Office

1.Contract

The appointment is whole-time, temporary and pensionable.

This is an appointment on a Type B basis under the Consultants’ Contract 2008 to be based at St. Johns Hospital, Limerick.

  1. Salary

The annual salary will be as set out in the Consultant Contract 2008 for New Entrant Consultants (Clinicans) (Type B) as follows:

(A)Appointees employed as a Consultant in the Irish Public Health Service before 31st December 2010: (Salary Scale at 01/01/2010): €173,620, €175,931, €176,000, €176,000.

(B)Appointees not previously employed as a Consultant in the Irish Public Health Service oremployed as a Consultant in the Irish Public Health Service after 1st January 2011: (01/01/2011): €156,258, €158,338, €158,400, €158,400.

  1. Annual Leave

The annual leave associated with the post is: 31 Working Days per annum and as determined by the Organisation of Working Time Act 1997.

4. Sick Leave

Eligibility to sick pay is in accordance with the Hospitals Sick Pay Scheme for Officers which provides for 6 months pay at full rate in 12 months and up to 6 months pay at half rate subject to a maximum of 365 days sick leave in 4 years.

5.Superannuation

The person appointed will participate in the Voluntary hospitals Superannuation Scheme and pay Superannuation contributions at the appropriate rates in accordance with the provisions of the Voluntary Hospitals Superannuation Scheme 1969 (as amended) and its allied Spouses and Children’s Pension Scheme.

The appropriate rates are:

  1. If appointee qualifies for the modified (class D) rates, the standard rate of contribution is 5%of *pensionable remuneration, with an additional contribution of 1.5% of *pensionable remuneration in respect of Windows and Orphans/Spouses and Children’s Pension Schemes.
  1. If the appointee is liable to pay full P.R.S.I. (class A) rates, s/he will contribute at the rate of 3.5%of **net remuneration (main scheme) and 1.5%of * pensionable remuneration with an additional 1.5% of * pensionable remuneration in respect of Spouses and Children’s Pension Scheme.

Note:

* Pensionable Remuneration means the aggregate of salary and pensionable allowances

**Net Pensionable remuneration means pensionable remuneration less twice the rate of Social Welfare old age contributory pension payable at the maximum rate to a person with no adult dependant or qualified child dependent.

6. Probation

Employment will be probationary for the first six months, during which time the Department Head will carry out periodic probation assessment reviews. The appointee will cease to hold office at the end of or during the probationary period unless during such period the Hospital has certified that their service is satisfactory.

7. Ethics in Public Office

Positions remunerated at or above the minimum point of the Grade VIII salary scale (€ 64,812as at 01.01.2010) are designated positions under Section 18 of the Ethics in Public Office Act 1995. Any person appointed to a designated position must comply with the requirements of the Ethics in Public Office Acts 1995 and 2001 as outlined below;

A) In accordance with Section 18 of the Ethics in Public Office Act 1995, a person holding such a post is required to prepare and furnish an annual statement of any interests which could materially influence the performance of the official functions of the post. This annual statement of interest should be submitted to the Chief Executive Officer not later than 31st January in the following year.

B) In addition to the annual statement, a person holding such a post is required, whenever they are performing a function as an employee of the HSE and have actual knowledge, or a connected person, has a material interest in a matter to which the function relates, provide at the time a statement of the facts of that interest. A person holding such a post should provide such statement to the Chief Executive Officer. The function in question cannot be performed unless there are compelling reasons to do so and, if this is the case, those compelling reasons must be stated in writing and must be provided to the Chief Executive Officer.

C) A person holding such a post is required under the Ethics in Public Office Acts 1995 and 2001 to act in accordance with any guidelines or advice published or given by the Standards in Public Office Commission. Guidelines for public servants on compliance with the provisions of the Ethics in Public Office Acts 1995 and 2001 are available on the Standards Commission’s website

Positions remunerated at or above €168,000 as at 1st January 2010 are designated positions under the Ethics in Public Office Acts 1995 and 2001.

Under the Standards in Public Office Act 2001, the post holder must within nine months of the date of appointment provide the following documents to the Standards in Public Office Commission at 18 Lower Lesson Street, Dublin 2:

  1. A Statutory Declaration, which has been made by the post holder not more than one month before or after the date of the appointment, attesting to compliance with the tax obligations set out in section 25(1) of the Standards in Public Office Act and declaring that nothing in section 25(2) prevents the issue to the post holder of a tax clearance certificate
  2. and either

(a)a Tax Clearance Certificate issued by the Collector-General not more than 9 months before or after the date of the appointment or

(b)an Application Statement issued by the Collector-General not more than 9 months before or after the date of the appointment.

A person holding such a post is required under the Ethics in Public Office Acts 1995 and 2001 to act in accordance with any guidelines or advice published or given by the Standards in Public Office Commission. 8. Medical Insurance

The appointee will not be required to provide themselves with separate professional indemnity cover against the cost of personal injury claims arising from their appointment as a temporary consultant. From 1st February 2004 any claims arising from incidents which occur after that date will be covered by the Clinical Indemnity Scheme established under the terms of the National Treasury Management Agency (Delegation of Functions) Order 2003 (S.I. 63 of 2003). This includes fee-paying patients treated by the appointee onsite in accordance with the provision of their contract.

As consultants are no longer required to provide their own professional indemnity cover for services provided under the contract they will no longer be reimbursed for any part of the cost of such cover.
