RIDDORstandsforthe"ReportingofInjuries,DiseasesandDangerousOccurrencesRegulations 1995",otherwiseknownasRIDDOR95.UndertheseRegulations,employers(orthepersonin controlof thepremises)arelegallyrequiredto reporttotheHSEif anemployeehassufferedany ofthefollowingwhileatwork:

•Deathorspecifiedinjury

•Injuriesresultinginmorethansevendaysoff work

•Diseasearisingfrom aworkactivity

•Dangerousoccurrence

Ifyouareself-employedandareworkinginsomeoneelse’s workpremisesandsuffereithera majorinjuryoranover-seven-dayinjury, thenthepersonincontrolof thepremiseswillbe responsibleforreporting,so,wherepossible,youshouldmakesuretheyknowaboutit.

Ifthereisareportableaccidentwhileyouareworkingonyourownpremisesorindomestic premises,orif adoctortellsyouthat youhaveawork-relateddiseaseorcondition,thenyouneed toreportit.

Thisrecordcanbekeptinanyform, butthebestoptionisto useaformalaccidentbook,which,if youareanemployer, youmustkeepundertheSocialSecurity(ClaimsandPayments)Regulations 1979,Accidentbookscanbeobtainedfrom officesuppliers,orinaloose-leaffileusingHSE approvedpre-preparedforms,andmustcomplywithDataProtectionlegislation.

Thestandardof asevendayinjuryisthat theemployeeorself-employedpersonisabsentoris unabletodoworkthattheywouldreasonablybeexpectedto doaspartoftheirnormalworkforsevenconsecutivedaysasaresultof anoccupationalaccidentorinjury.

Calculationof thenumberof daysshouldexcludethedayoftheincident,butincludeweekends, bankholidaysandrestdays.

SUMMARY

1.Takeinwhathashappenedquicklyandcalmly. Lookoutfor anydangersto yourselfandthe personinjured(includinganyloosehorsesorotherstrings).

SECTION3– ASBESTOS

Guidance/SpecificLegalPolicy

Guidance

Theuseof asbestoshasbeenbannedintheUnitedKingdomsince1999.Dueto theextensive useof asbestosproductsintheconstructionindustryinthepasttheynowposeasignificantrisktoworkerswhomaydisturbit - constructionandmaintenanceworkers.Ownersand/oroccupiers whohaveresponsibilitiesfor themaintenanceofcommercialpremisesnowhavealegaldutytoidentifyallasbestosintheirbuildingandto managetherisksassociatedwithasbestosproductsin thebuilding.

Thepurposeof managingasbestosinbuildingsisto preventor,wherethisisnotreasonably practicable,minimiseexposure.Therearethreeessentialstepstotake:

•Establishwhetherthebuildingscontainasbestos,and,if so, whereitisandwhatconditionit isin.Ifindoubt,materialsmustbepresumedto containasbestos;

•Assesstherisk; and

•Makeaplantomanagethatriskandactonit.

Whereasbestosmaterialsareingoodconditionandunlikelyto bedistributedtheydonotpresenta risk.Wherethematerialsareinpoorconditionorareliableto bedisturbedordamaged,asbestos fibresmaybereleasedintotheair, which,if breathedin,cancauseseriouslungdiseases, includingcancers.Thisinformationmust alsobemadeavailabletocontractorsandmaintenance staffbeforeanyworkisundertaken.

SECTION5-DRIVING

SpecificLegalPolicy/Samplepolicy

TheBusinessacknowledgesthat anyemployeedrivingwhilstonits businessisexposedto risk. Forthat reasonit hasadoptedthefollowingprocedure;

FixedElectricalInstallations

Itisimportanttoensurethat thefixedelectricalinstallationisconstructedandmaintainedtopreventdanger, inparticular:

2.Socketoutletswhichcanbeusedfor poweringportabletoolsshouldalwaysbeprotectedby a30milliampResidualCurrentDevice(RCD).AllRCD'sshouldberegularlytestedby pressingthe`test'buttononthedeviceandanydefectsremediedbyacompetent electrician.

3.Partsofthefixedelectricalinstallationwhichareoutsideormaybeexposedtoadamp environment(e.g.neartoapressurewasher)shouldbeofatypesuitableforuseinthis environment.Electricalsystemsfrequentlycarryan`IP'ratingwhichisaguidetothe environmentthesystemisdesignedfor.

4.Thefixedelectricalinstallationshouldbemaintainedto preventdanger.Thisinvolves havinga`periodicinspectandtest' carriedoutbyacompetentelectrician.Theduration betweentests willbeselectedinaccordancewithadvicefrom theelectrician;resultsfrom previoustests(i.e.ifdeteriorationisnotedbetweentests,thenthefrequencymayneedtobeincreased)andguidancepublishedbytheInstitutionof ElectricalEngineers,which statesthatformostindustriestheinitialdurationshouldbebetween3and5years.The resultof anyinspectionwillberecordedandkeptat leastuntilthenextinspection.

PortableAppliances

5.Portableappliancesshouldbesuitablefor theenvironmentinwhichtheyaretobeused.

Forexample,toughenedcable(e.g.armouredorspecialhardwearingpolyurethaneflexes) shouldbeusedinareaswheredamageto cablesmayoccur. In dampenvironments suitableweatherproofedequipmentwillneedto beused.Meansshouldbeprovidedtoprotectagainstimpact(e.g. hand-heldlamps).Insomeinstancestheriskswillbesohigh thatyouwillneedto consideralternativepowersources(e.g.batterypoweredorpneumatic tools).

6.Noextensionleadsorportableelectricalequipmentmaybeusedexceptwiththe permissionof (Name) andonlyafterit hasbeenchecked.Extension leadswhicharestoredonareelshouldalwaysbefullyextendedwhilstinuse.

7.Usingelectricalequipmentnearwatercanbeverydangerous.Allelectricalequipment, plugs,cables,leadsandextensionleadsshouldbekeptawayfrom waterat alltimeswhilst inuse.Theoperatorof anyelectricalequipmentmustinstructotheremployeesnotto spillor throwwaternearto electricalequipment.

8.Itisdangerousto allowahorseto walkacrossanelectricalcable.Piercingof alivecableby thehorse'shoovescouldresultinanelectricalshock,whichmaybefatal. Evenif thecable isunplugged,damagetotheprotectivecoveringislikelyto occur,whichcouldlaterresultin anelectricalaccident.

DONOTALLOWAHORSETOWALKOVERANELECTRICALCABLEEVENIFITISSWITCHEDOFFORNOTPLUGGEDIN.

9.Ifelectricalequipment(egclippers)isbeinguseddirectlyonahorse,thehorseshouldbe appropriatelyrestrainedandnotbeableto damageanypartof theequipment,cable,plug orswitch(egbybitingortreadingonit).Thehorseshouldnotbeleftunsupervisedatany timewhilstelectricalequipmentisbeingused,andallelectricalequipmentmust be removedfromthevicinityofthehorseifthehorsehastobeleftunsupervised,nomatterforhowshortatime.

10.Meansofisolatingthepowersupplyshouldbeprovidedwherenecessary(e.g.atsocket outlets).

11.Portableappliancesshouldbemaintainedtopreventdanger.Aformalinspectionand PortableApplianceTest(PAT) willnormallyneedtobecarriedoutatsuitableintervals, unlesstherisksarelowenoughnottojustifythis(e.g.fixedcomputersystems).Inanycase asimplevisualexaminationof equipmentanditspowercablesshouldbemadeperiodically onallequipment.AcompetentelectricianwillcarryoutthePATtest andinspection.

12.Theinspectionwillberecordedandanassetregisterof electricalappliancesismaintained.

Appliancesaremarkedbytheinspectorwithauniquenumbertorecordthat allhavebeen inspected/testedwhennecessary.

13.Repairsto portableappliancesshouldbecarriedoutproperlyandbyacompetentperson.

Forexample,nevermakerepairsto flexiblecablesusing`chocolateblocks'orsimilar connectors.

Particularcareshouldbetakenwithbalestoensuretheyareun-stackedsafely.Stacks ofsmallbalesshouldnotbeunderminedandlargebalesshouldbemechanicallymovedto a safepositionbeforeopening.

6.Bonfiresshouldnotbelitwithoutpermissionandshouldbesupervisedatalltimes.

7.Alltraffic routesonthepremisesshouldbesuitablefor people,vehiclesandhorsesas appropriate.Clearsignsindicatethecorrectroutetoensuresafety toallpeopleandhorses. Immediatelyandproperlyexaminingandtreatinginjuriesmaysavealifeorpreventminorinjuries becomingmajorones- especiallyinhighriskoccupationssuchasthoroughbredhorsetrainingand breeding.

Asanemployer, youhavelegaldutiesto notonlyprovidefirstaid,butalsoto informyour employeesofthefirstaidarrangements.

1.Theemployerisrequiredto carryoutanassessmentof firstaidneedsandthenumberoffirstaidersrequiredwilldependontheoutcomeof theemployer'sassessmentofthese needs.GuidanceonthisisavailableinHSEleaflet'FirstAidAtWork-yourquestions answered'INDG214(rev1)availableasaweb-friendlyversionatww.hse.gov.uk.

2.TherearetworecognisedFirstAidqualificationsplusAppointedPersons:

Thisrequiresattendanceonathree-daycoursethatincludesEFAWbutalsoallowstreatmentofmorespecificconditions.

EmergencyFirstAidatWorkCertificate("EFAW")

Allemployersarelegallyrequiredto haveEmployers'Liabilityinsurance;that isinsurance againstliabilityfor bodilyinjuryordiseasesustainedbytheiremployees,learners/trainees andanyworkexperiencestudentsinthecourseof theiremployment.

UndertheEmployers'Liability(CompulsoryInsurance)Act 1969,suchpoliciesmust be takenoutwithauthorisedinsurers,i.e.personslawfullycarryingonaclassof insurance businessinGreatBritainundertheCompaniesAct1985.Alistofauthorisedinsurance companiesisgiveninthe"InsuranceAnnualReport",publishedbytheDepartmentofTrade andIndustryandavailablefromTheStationeryOffice.

Anemployermustbeinsuredforaminimum£5millioninrespectof claimsarisingoutofanyoneincident,althoughtheindemnityundersuchpoliciesisusuallyupto £10million.

Itisrecommendedthatyousatisfyyourselfthatanysub-contractorsyouusecarry appropriateinsurance.

2.Documentation

UnderRule(C)25,theBHArequireseveryTrainertoensurethat wheneverapersonismountedon ahorseinhiscareinhiscapacityasatrainer, thatpersoniswearingasafetyvest whichmeetsthe standardlaiddowninSchedule(D)2,headed"safetyvests".Disciplinaryactionmaybetaken againstanytrainerwhoseemployeesarenotseento becomplyingwiththisRule.

Asaminimumrequirementnostableemployeeshallbemountedonahorseunlesshe/sheis wearingasafetyvestwhichmeetsthecriteriaset outintheRulesof Racingandcanbefoundon thefollowinglinkandissubjecttochangefrom timetotime:

Safetyvestsmustnotbemodifiedinanywayandfittedinaccordancewithmanufacturer's instructions.Theymustalsobeinaserviceablecondition.Itisrecommendedthatsafetyvestsare replacedat leastevery3years,howevertheyshouldbereplacedsoonerintheeventof an accident.

NOTE

DrawingontheRiskAssessments,theemployermaydecidethat someorallofthefollowing shouldbewornincertaincircumstances.For example:

Skullcap-whenclipping,leading,longreining,stallspractice,lungeing,loading,teasingor workinginthecoveringbarn.

1.Thisadviceappliestosit-astrideATVssometimesknownasquadbikes.Thesemachines aredesignedforoff-roaduse.Althoughtheyappearverystable,mostATVaccidentsinvolve overturningandthiscanhaveseriousconsequences.Themost importantsafetyissueswith respecttosit-astrideATVsaretraining,personalprotectiveequipment- particularlythe wearingof appropriateheadprotection- maintenanceanddrivingtosuittheterrain.
