MINUTES

The Oklahoma State Board of Examiners for Long Term Care Administrators (OSBELTCA) met January 31, 2007 at the Shepherd Mall Office Complex, 2401 NW 23rd, Ste 40 B, OK City, OK with Dr. Tom O'Connor presiding.

The meeting was called to order at 10:12 by Dr. Tom O'Connor, Chair. Due to the likelihood of losing a quorum, agenda items were discussed out of order.

Dr. Tom O'Connor introduced and welcomed Mr. Marc Edwards, Attorney, as our newest Board Member.

Dr. O'Connor led the discussion and possible action regarding the consideration of 60 day extensions on the following cases involving nursing home administrators:

Motion was made by Mr. Bill Weaver seconded by Ms. Eleanor Kurtz, to approve the 60 day extensions on the aforementioned cases. A public statement of grounds for such extensions was made. Motion carried with voting as follows: Affirmative – Ms. Nancy Atkinson, Ms. Eleanor Kurtz, Mr. Bill Weaver, Ms. Jeannie Gault, Dr. Tom O'Connor, Mr. Marc Edwards, Mr. Terry Williams and Dr. Maurice Payne. Negative – None. Abstaining – None.

Ms. Eleanor Kurtz led the discussion concerning possible action regarding the new potential licensees. Ms. Kurtz informed the Board members that the following candidates met the requirements for licensure as Oklahoma Nursing Home Administrators:

Motion was made by Mr. Bill Weaver, seconded by Ms. Jeannie Gault, to approve the aforementioned candidates as Oklahoma Nursing Home Administrators. Motion carried with voting as follows: Affirmative – Ms. Nancy Atkinson, Ms. Eleanor Kurtz, Mr. Bill Weaver, Ms. Jeannie Gault, Dr. Tom O'Connor, Mr. Marc Edwards, Mr. Terry Williams and Dr. Maurice Payne. Negative – None. Abstaining – None.

Dr. Tom O'Connor led the discussion concerning the possible action regarding the request for Provisional licenses. Dr. O'Connor informed the Board members that the following candidates met the requirements for Provisional licenses:

Motion was made by Mr. Bill Weaver, seconded by Mr. Terry Williams, to approve the aforementioned candidates request for Provisional licenses. Motion carried with voting as follows: Affirmative – Ms. Nancy Atkinson, Ms. Eleanor Kurtz, Mr. Bill Weaver, Ms. Jeannie Gault, Dr. Tom O'Connor, Mr. Marc Edwards, Mr. Terry Williams and Dr. Maurice Payne. Negative – None. Abstaining – None.

Ms. Brinda White, Assistant Attorney General informed the Board that there was no provision in the rule for an extension of a provisional license; therefore, the request for an extension regarding Ms. Kaylene McGurk was denied.

Dr. O'Connor led the discussion concerning the consideration and possible approval of the following continuing education programs:

Motion was made by Ms. Jeannie Gault, seconded by Mr. Bill Weaver, to approve the aforementioned continuing education programs for Oklahoma Nursing Home Administrators. Motion carried with voting as follows: Affirmative - Ms. Eleanor Kurtz, Mr. Bill Weaver, Ms. Jeannie Gault, Dr. Tom O'Connor, Mr. Marc Edwards, Mr. Terry Williams and Dr. Maurice Payne. Negative – None. Abstaining – Ms. Nancy Atkinson.

Motion was made by Ms. Eleanor Kurtz, seconded by Dr. Maurice Payne, that the minutes of the December 13, 2007 Board meeting be approved as written. Motion carried with voting as follows: Affirmative – Ms. Nancy Atkinson, Ms. Eleanor Kurtz, Mr. Bill Weaver, Ms. Jeannie Gault, Dr. Tom O'Connor, Mr. Marc Edwards, Mr. Terry Williams and Dr. Maurice Payne. Negative – None. Abstaining – None.

Ms. Jeannie Gault led the discussion regarding the Finance Report. Ms. Gault informed the Board that 30 bills had been paid to State agencies and that more were in the process of being paid. She also informed the Board that the Executive Committee along with Dr. Lanier had visited with Senators and Representatives concerning the agency becoming appropriated. They also have a meeting in February to visit with the Long Term Care Committee regarding this issue.

Dr. O'Connor informed the Board that we do have a Code of Ethics as required legislatively but there was no additional report.

Ms. Nancy Atkinson led the discussion concerning the additional proposed changes of rules and regulations. She informed the Board that the Attorney General's office had submitted comments and suggested changes and that the committee continues to work diligently on the rule changes.

Pursuant to 63 O.S. Supp. 2006, Section 330.65(A), the following Motion to Dismiss complaint is set for Hearing.

OSBELTCA vs. Pam cozort, NHA Case #05-71

Ms. Carrie Burnsed, attorney, was present representing Ms. Pam Cozort. Ms. Burnsed presented her Motion to Dismiss Complaint.

Motion was made by Ms. Nancy Atkinson, seconded by Mr. Marc Edwards, to convene into Executive Session pursuant to 25 O.S. Section 307(B)(8) regarding the Motion to Dissmiss Complaint of Ms. Pam Cozort. Motion carried with voting as follows: Affirmative – Ms. Nancy Atkinson, Ms. Eleanor Kurtz, Mr. Bill Weaver, Ms. Jeannie Gault, Dr. Tom O'Connor, Mr. Marc Edwards, Mr. Terry Williams and Dr. Maurice Payne. Negative – None. Abstaining – None.

Motion was made by Ms. Jeannie Gault, seconded by Ms. Eleanor Kurtz, to reconvene into Open Session. Motion carried with voting as follows: Affirmative – Ms. Nancy Atkinson, Ms. Eleanor Kurtz, Mr. Bill Weaver, Ms. Jeannie Gault, Dr. Tom O'Connor, Mr. Marc Edwards, Mr. Terry Williams and Dr. Maurice Payne. Negative – None. Abstaining – None.

Motion was made by Mr. Marc Edwards, seconded by Ms. Eleanor Kurtz, to deny the Motion to Dismiss Complaint, due to the fact that no statutory investigatory deadline was violated by the Board. Motion carried with voting as follows: Affirmative – Ms. Nancy Atkinson, Ms. Eleanor Kurtz, Mr. Bill Weaver, Ms. Jeannie Gault, Dr. Tom O'Connor, Mr. Marc Edwards, Mr. Terry Williams and Dr. Maurice Payne. Negative – None. Abstaining – None.

Mr. Bill Weaver left at 10:55.

Due to a lack of quorum, the remaining agenda items were not discussed or acted upon.A Special meeting will be held February 7, 2007 at the OklahomaEngineeringBuilding, 201 NE 27th St., Room 125, OK City, OK at 9:00 a.m. to discuss and act upon these agenda items.
