CreditReporting lawsMUSTfollowthe federalconsumerprotectionlaws.Acts, like the Fair Credit Reporting Act, helpdefineand protect thelegal rightsofthe consumerandlimitthe powerof thecreditor.Theygivereliefwheretheconsumermay have been infringedon, and providelegal discoursethat the consumercantakefor correctiveaction.Theseare greatlaws, but unfortunately mostpeopleare unaware oftheir existence,andtherefore have no idea on how to takefulladvantageof theprotectionthey offer.All Legal Credit Guide teaches consumers how tousetheselawsin the defenseoftheir credit reports,againstmany reportingbycreditreportingagencies.When properly used, theyareextremely effective.
TheFTC’sFair CreditReportingAct(FCRA)isdesigned to maintain[CS1]accuracy, fairness,andprivacyof informationinthe filesof everyConsumer ReportingAgency(CRA).Most CRAsarecreditbureaus that gather andsellinformationaboutyou- suchasif youpayyour billsontimeorhavefiled bankruptcy-- tocreditors,employers,landlords, and other businesses. Youcanfindthe completetextof theFCRA,15

Youmustbetoldifinformationinyourfilehas beenused againstyou. Anyonewhousesinformation fromaCRAto takeactionagainstyou-- suchasdenyingan applicationfor credit, insurance,or employment--musttellyou, andgiveyouthename,address,andphonenumber ofthe CRAthat providedthe consumerreport.
Youhavethe righttoknowwhatisonyour report. Atyour request,aCRAmustgiveyouthe information inyour fileandalistof everyonewhohas requested itrecently. Thereisnochargeforthereportif a personhastaken actionagainstyoubecauseof informationsupplied bytheCRA if yourequestthe
reportwithin60daysof receivingnoticeoftheaction. Youalsoareentitledto onefreereportevery
twelve months uponrequestif youcertify that(1)youareunemployed andplantoseekemployment within 60days, (2)youareon welfare,or(3)your reportisinaccurateduetofraud. Otherwise,aCRA maycharge youupto$9.50.
YoucandisputeinaccurateinformationwiththeCRA.If youtell aCRAthatyour file contains inaccurate information,theCRAmustinvestigatetheitems(usually within30days)bypresentingtoitsinformation sourceall relevantevidenceyousubmit, unlessyour disputeisfrivolous. Outdated informationmay notbereported. Inmostcases, aCRAmaynotreport negativeinformation that is morethansevenyears old;tenyears for bankruptcies.Access toyour fileis limited.A CRAmay provideinformationaboutyouonlytopeoplewith aneedrecognized bytheFCRA-- usuallytoconsider an applicationwith acreditor, insurer,employer,landlord,orother business.
