Explanatory Statement:

This ordinance requires that building lots outside of the Sewer Service area contain enough space for both an approved primary septic field and an approved secondary septic field. The secondary field would be available if at some point the primary field became unusable.

An Ordinance of the Township of Bernards, County of Somerset, State of New Jersey, to Amend the Revised General Ordinances of the Township of Bernards, and More Specifically to Amend Chapter XXI Entitled “Land Development”, Article II Entitled “Definition of Terms”, and Chapter XXI Entitled “Land Development”, Article VII Entitled “Development Review Procedures” Concerning Septic Systems

BE IT ORDAINED by the Township Committee of the Township of Bernards, in the County of Somerset and State of New Jersey, as follows:

  1. Chapter XXI entitled "Land Development" of The General Ordinances of the Township of Bernards, Article II entitled “Definition of Terms”, Section 21-3 entitled “Definitions” is hereby amended to include the following new terms and definitions, to be inserted in alphabetical order, (new language indicated in bold):

DISPOSAL BED shall mean an individual subsurface sewage disposal system component consisting of a closed excavation made within soil or fill material to contain filter material in which two or more distribution laterals have been placed for the disposal of septic tank effluent.

DISPOSAL FIELD shall mean a disposal bed or group of one or more disposal trenches. The perimeter of the disposal field corresponds to the perimeter of the disposal bed, or a line circumscribing the outermost edges of the outermost disposal trenches and including the area between the disposal trenches.

DISPOSAL TRENCH shall mean an individual subsurface sewage disposal system component of a covered excavation made within soil or fill material to contain filter material in which a single distribution lateral has been placed for the disposal of septic tank effluent.

  1. Chapter XXI entitled "Land Development" of The General Ordinances of the Township of Bernards, Article VII entitled “Development Review Procedures”, Section 21-52.3 entitled “Details Required for Final Approval of Minor Subdivision”, Subsection 21-52.3.a.17 is hereby amended as follows (new language indicated in bold):

17.The locations of percolation tests on each existing/proposed lot and a copy of the written approval of the tests and locations from the Bernards Township Health Department, if sewage disposal is to be handled by individual septic system(s). For each lot, the applicant shall submit test locations and written approvals from the Health Department for both a primary and secondary septic disposal field. The applicant must show on the development plan the locations and dimensions of both septic disposal fields.

  1. Chapter XXI entitled "Land Development" of The General Ordinances of the Township of Bernards, Article VII entitled “Development Review Procedures”, Section 21-54.4 entitled “Details Required for Preliminary Development Plans”, Subsection 21-54.4.a.18 is hereby amended as follows (new language indicated in bold):

18.The locations of percolation tests on each existing/proposed lot and a copy of the written approval of the tests and locations from the Bernards Township Health Department, if sewage disposal is to be handled by individual septic system(s). For each lot, the applicant shall submit test locations and written approvals from the Health Department for both a primary and secondary septic disposal field. The applicant must show on the development plan the locations and dimensions of both septic disposal fields.

  1. All other ordinances in conflict or inconsistent with this ordinance are hereby repealed, to the extent of such conflict or inconsistency. In the event of any inconsistencies between the provisions of this Ordinance and any prior ordinance of the Township of Bernards, the provisions hereof shall be determined to govern. All other parts, portions and provisions of the Revised General Ordinances of the Township of Bernards are hereby ratified and confirmed, except where inconsistent with the terms hereof.
  1. If any article, section, subsection, paragraph, sentence, clause or phrase of this Ordinance is, for any reason, held to be unconstitutional or invalid, such decision shall not affect the remaining portions of this Ordinance and they shall remain in full force and effect, and to this end the provisions of this ordinance are hereby declared severable.
  1. This ordinance shall take effect immediately upon final passage and publication according to law.
